Home My WebLink About20041399.tiff 5j RESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR AGREEMENT CONCERNING EARLY RELEASE AND ISSUANCE OF BUILDING PERMIT FOR AMENDED USE BY SPECIAL REVIEW PERMIT, USR #1047 - REGENT BROADCASTING OF FORT COLLINS, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #2003-2556 dated September 3, 2003, the Board approved an agreement concerning early release and issuance of building permit for Amended Use by Special Review Permit, USR #1047 with Regent Broadcasting of Fort Collins, Inc., Go Kenneth Lind, Attorney, Lind, Lawrence and Ottenhoff, LLP, P.O. Box 326, Greeley, Colorado 80632, and WHEREAS, on September 3, 2003, Regent Broadcasting of Fort Collins, Inc., as a requirement of said agreement, posted a Performance Guarantee deposit in the amount of $105,600.00, which was to be held pending completion of the Use by Special Review Permit (USR #1457) application process, and WHEREAS, said agreement indemnified and held harmless the county for costs and attorney fees incurred in the defense of said early release which are shown in Memorandum from Lee D. Morrison, Assistant County Attorney, a copy of which is attached hereto and incorporated by reference, and WHEREAS, staff from the Weld County Department of Planning Services has verified that the Use by Special Review Permit has been approved, the building permit finaled, and the old tower demolished, and WHEREAS, the Board deems it advisable to release said collateral, less $5,596.18 for attorney fees. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Performance Guarantee posted for the above stated matter be, and hereby is, canceled and released. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is, directed to process a County warrant, in the amount of$100,003.82, plus interest, and return said collateral to the appropriate issuing party. Regent Broadcasting COLORADO Regent Broadcasting posted cash to secure the agreement of September 2003 for early release of building permits for second Am USR-1417. That agreement indemnified and held harmless the County for costs and attorney fees incurred in the defense of said early release. The attached listing itemizes the expenses incurred by this office in defense of the litigation entitled Fox v. Regent Broadcasting. Regent Broadcasting has completed the other requirements of the agreement: the USR is approved, the building permit finaled and the old tower demolished. The agreement of the same date required Regent to post a Performance Guarantee deposit in the amount of$105,600.00 which was to be held pending resolution of the Regent USR application (USR-1457). Said USR was approved, and the USR(and SE)plats have been submitted to the Department of Planning for recording. Additionally, Regent Broadcasting, Inc. acquired a demolition permit regarding the old tower and on April 2, 2004, the Weld County Building Inspections Department inspected the demolition site and signed off and finalized the demolition permit. Finally, on April 28, 2004, the new tower received final inspection approval from the Weld County Building Inspections Department(copy of permit enclosed). As the old tower has now been properly removed, the USR and SE plats submitted for recording, and the new tower approved, Regent Broadcasting of Fort Collins would respectfully request that the guarantee deposit of $105,600.00 be returned to Regent Broadcasting of Fort Collins, Inc. We would request that the check be issued payable to Regent Broadcasting of Fort Collins, Inc. but mailed to this office at the above address.
