The Weld County Public Works Department has reviewed the proposal; this project falls primarily under the Use by
Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
WCR 39 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance, Section
20-1-30, as a local gravel road, which requires a 60-foot right-of-way at full build out. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback measured from the future right-of-way line.
Our most recent traffic count (ADT) reflects 157 vehicles taken in a 72-hour period on 11/21/2002 on WCR 39 between
WCR 6 and WCR 8.
Within the application, there are two names associated with the proposed USR: Ralph and Barbara May, and Rebecca A.
,Haynes. Also on the plat drawing, there are two existing homes shown. The Assessors records indicate that the Mayes
e the owners of the property.
In researching the second replat of Lots 5 and 6, Apollo Subdivision, it reflects 1/2 of an acre parcel in the northeast corner
of Lot 6 identified, but it is not shown on the Assessors aerial. Is this the Roberta A. Haynes parcel?
This is a special use permit tied to the ''/ acre parcel, which appears to belong to Rebecca A. Haynes only and not the
entire Lot 6 parcel.
REQUIREMENTS:
Access: There is a main access point between the two residential structures and an existing parking area adjacent to the
south residence. This will be designated as your main access and parking area. A second access exists on the south
side of the Mayes residence. Utilize this as a residential access only. The third access point is at the south property line.
The applicant should justify in writing the need for this additional access point. According to Section 8, Article II of the
Weld County Code, it states that direct access from a public road should be limited to one access per legal parcel for
residential purposes. No circle drives will be allowed. If justification is required for any additional new or existing access
points.
Application Requirements: Section 23-2-260 D, Special Review Plan Map, Item No. 2, Dimensions of the map shall be
36" wide by 24" high. Item No. 4, Vicinity Map. A Vicinity map shall be drawn on the Use by Special Review permit plan
map A. The scale of the vicinity map shall be 1" = 600 feet or at another suitable scale. The existing maps provided are
unreadable.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed
to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.

Environmental Health Services has reviewed this proposal for a dog kennel. We have
no objections to the proposal, however, we do recommend that the following conditions
be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The septic system serving the Haynes home shall be reviewed by a Colorado
Registered Professional Engineer. The review shall consist of observation of the
system and a technical review describing the systems ability to handle the
proposed hydraulic load. The review shall be submitted to the Environmental
Health Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed, the system shall be brought into compliance with current
Regulations.
2. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
evidence that the applicant is not subject to the PACFA requirements.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
7. The applicant shall operate in accordance with the approved "waste handling
plan".
8. Adequate handwashing and toilet facilities shall be provided for visitors of the
facility.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.

(Agricultural) Zone District.
USR-1451
The following permits are on record for this parcel number or address: PR-9730281, to install a
56 X 26 manufactured home as a medical hardship; MP02844, to replace an existing mobile
home on ZPMH-1485; MP02967, to set up a mobile home with no water or sewer connections
on ZPMH-1484; BP40146, to replace a furnace in a dwelling; and BP40152, to install a metal
storage building with a dirt floor for personal use. All permits received final inspection approval
except for BP40152 which was expired.
1. A building permit will be required for the kennel. A new building permit will be required to
conduct inspections for the building for which BP40152 was issued.
2. The applicant shall check with a plans examiner to determine if a plan review is required for
each building. If a plan review is required, two complete sets of plans will be required when
applying for the permit.
3. Buildings shall conform to the requirements of the codes adopted at the time that permits
are applied for. Current adopted codes include the 1997 Uniform Building Code, 1998
International Mechanical Code, 1997 International Plumbing Code, 2002 National Electrical
Code and Chapter 29 of the Weld County Code. (Weld County intends to adopt the 2003
International Building, Residential, Mechanical, Plumbing and Fuel Gas Codes on February 1,
2004).
4. Building height, wall and opening protection and separation of buildings of mixed occupancy
shall be in accordance with the codes adopted at the time of permit application. Setback and
offset distances shall be determined by Chapter 23 of the Weld County Code.

Upon review of my computer and files,a Zoning Violation (VI-0100341)was noted. The violation was initiated
as a result of complaints received regarding the number of animals located on the property. During the
violation process it was determined that the property did require a Use by Special Review due to the number
of dogs. This case was presented to the Board of County Commissioners on September 10, 2002. At that
time the Board of County Commissioners referred this case to the County Attorney's Office, but delayed legal
action for 60 days (November 10, 2002). As a result, please be advised that the investigation fee is required
in addition to the Use by Special Review application fee.
If this case is approved and once a plat has been recorded, the violation will be closed; however, if for any
reason this application is denied,the violation process will continue. If denied,within 90 days from denial,the
number of dogs would need to be reduced to 4(four)or this case would be forwarded to the County Attorney's
Office for legal proceedings.

The Department of Planning Services has reviewed this application and has the following
comments:
This application was submitted to bring the property into compliance as the facility is in violation
of the Weld County Code via VI-0100341.
The applicant is proposing to Kennel an unknown number of dogs of a known breed, Pug.
Information shall be provided stating their typical daily requirements. The application materials
state that there will be up to 10 adult dogs, presently there are four females, three of which are
viable for breeding. Litters range from 1 to 5 pups. Given these numbers it appears the
upstand limit would be fifty dogs for this facility. The applicant shall define this number prior to
the PC Hearing.
The Kennel is proposed for lands located on Lot 6 of the Apollo Subdivision, situs address 2827
and 2831 County Road 39, Brighton 80601. There are two residential structures on this parcel.
One is a manufactured building (2827) permitted as the principal residence and the second is a
medical hardship (2831) residence permitted in 1998. The Haynes residence is the medical
hardship residence.
The applicant's USR Map delineates chain link fencing surrounding the Haynes residence and
yard. It is unclear how the individual "play yards" and "dog run" areas are separated from the
remaining "domestic yard". Given that the proposed facility is within an existing subdivision with
neighbors in close proximity, the Department of Planning Services will require the fence to be
modified. The fence shall be constructed of an opaque material at all locations where the
kennel is in operation.
There is an area west of the residential structure and west of the dog shed/ dog run area. It is
unclear as to the use of this area. Should there be additional animals on site, the number shall
be in compliance with Chapter 23 of the Weld County Code, under the heading of Animal
Units, Section 23-1-90. The applicant shall further describe the separation required between
this use and the fenced enclosure for the kennel, as required.
There is an area delineated as parking east of and adjacent to the Haynes residence, further
there is parking delineated in the ingress/ egress location on site, between the two residences.
The applicant shall provide delineation as to the number of spaces present, and circulation on
site for both parking areas. The application's descriptive narrative states there will be 15 to 30
people utilizing this site in addition to the three family members associated with this facility. The
number of parking spaces for this facility will be thirty-five spaces including one space that
meets the intent of the Americans with Disabilities Act standards. Given that this number is
extremely high for a facility of this type, it is highly suggested that the applicant review their
parking requirements and submit additional information to the Department of Planning Services
prior to the PC Hearing.
The application states that there are structures on site, one is an existing 10 foot by 11 foot
(110 square foot building) and the second a proposed 10 by 10 (100 square foot building). It is
unclear from the descriptive narrative if the 20 foot by 10 foot dog run with roof structure is
constructed. Given the size of the existing and proposed structures, a building permit may not
be required, however, the applicant shall contact the Department of Building Inspection to verify
if there are any building related issues that should be addressed.
The application states that water for the property is obtained via a commercial well, permit
number 59127-F dated February 19, 2003. The well will serve the requirements of the
domestic, commercial and irrigation water for this facility and site.
The application states that there are two leach fields on site. The application narrative states
that wastes will be disposed of in a trash dumpster, located on premises. Disposal of other
wastes should be coordinated through the Department of Public Health and Environment.
The application does not address the issue of drainage. The Department of Public Works shall
be contacted to determine what issues, if any are required to be addressed for the on-site
natural drainage and the potential requirement for a retention/detention basin to release water
at a historic rate.
Points of ingress and egress and storm drainage shall be addressed by the Department of
Public Works.
Section 23-3-250.A.6 states "Areas used for trash collection shall be screened from public
rights-of-way and all adjacent properties. These areas shall be designed and used in a manner
that will prevent wind- or animal-scattered trash." It is unclear from the applicant's drawing
whether the trash collection area is screened from the public rights-of-way and adjacent
properties. Written and /or graphic evidence shall be submitted to the Department of Planning
Services for review and approval.
Section 23-3-250.A.9 addresses "Outside storage. Uses involving outdoor storage of vehicles,
equipment or materials when permitted shall be screened from public rights-of-way and all
adjacent properties." It is unclear from the applicant's drawing whether there is an area for
outdoor storage. Written and /or graphic evidence shall be submitted to the Department of
Planning Services for review and approval.
Section 23-3-250.6 addresses Operation Standards. Section 23-3-250.6.6 addresses the
issues of Light. "Any lighting, including light from high temperature processes such as welding
or combustion, shall be designed, located and operated in such as manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties; neither the direct nor reflected light from any light
source may create a traffic hazard to operators of motor vehicles on public or private streets;
and no colored lights may be used which may be confused with or construed as traffic control
devices." It is unclear from the applicant's drawing whether there is an any exterior lighting
associated with the Haynes residence and proposed kennel area. The applicant shall provided
written and /or graphic evidence to the Department of Planning Services for review and
approval. A Lighting Plan is required.
Section 23-3-250.B.7 states "Property shall be maintained in such a manner that grasses and
weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property
owners allow the growth of noxious weeds. (Weld County Codification Ordinance 2000-1)
The USR Plat shall be drawn at a scale of 1"=10 feet. If necessary, a detailed enlargement of
an area may be delineated at a larger scale. The LocationNicinity Map shall be drawn at
1"=2000 feet.
The existing on-site landscape treatment is adequate for this facility. The hours of operation
shall be 8 am to 5 pm daily with special appointment hours as required.

The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
