July 23, 2003 FAX: (303) 536-4753 Kim Ogle, Planner Weld County Planning Department 1555 N. 17th Avenue Greeley, CO 80631 RE: Case Number USR-1437 Moises Rodriguez Dear Kim, The Board of Trustees of Hudson has reviewed the referral on Tract 12, Ireland Gardens, Case No. USR-1437 and strongly objects to the consideration and approval of the proposed Special Review Permit for this property. The site is located just north of the Hudson Memorial Park and the Hudson Water Treatment Plant and appears to have been in violation of its Conditional Use Permit issued April 6, 1977 for many years. The application, as we view it, is an attempt to legitimize a problem site with a new permit while the incompatible land use issues remain unresolved. Accordingly, we wish to submit the following concerns: 1. The proposed land use is incompatible with the Town's adopted Comprehensive Plan. The Comprehensive Plan has designated this area as commercial/industrial area buffering the residential area to the south with the existing Memorial Park. 2. The current use of this property has not only violated the previous Conditional Use Permit but is also not in conformance with the representations made in the current application. Many surplus and junk vehicles of all sizes are stored on the site, some of which we understand have been also used as shelter for transients. Enclosed please find several recent photos of these vehicles. In addition, the animals on the site have not been limited to two dogs as the sheds and pens along the north edge of the property contain chickens and at one time we understand pigs for consumption on site. 3. There is no dedicated public access to the site, instead considerable traffic uses a ditch company and utility service road for access. Due to excessive traffic in and out of the site, the Town has had dust complaints from the senior housing complex to the south. 4. The Town has noted considerable vandalism in the park, the senior housing EXHIBIT 18 property and numerous complaints regarding intimidation, and use of alcohol by groups in the park. These groups were then witnessed returning to Rodriguez facility. We understand from Commissioner Masden that during a baseball game at the park with children present, the Sheriff had to be called twice when gunfire was heard coming from the Rodriguez site. 5. Recent activities in our Town Municipal Court citing tenants of the property for various violations of local ordinances while within Town, suggests that a good number of existing tenants are not migrant workers at all, but long term renters of apartments at the site. 6. The septic system on the property has been overloaded leading to a complaint of raw sewage and foul stench coming from the property. Upon investigation of the problem, the Town Code Enforcement Officer reported the problem to the Weld County Health Department. We are unaware that this problem has been resolved. 7. The existing well capacity does not appear to be sufficient for the demand being placed on it. The Town's deep well, only a few hundred yards away has noted considerable drop in the water table and pumping capacity has been reduced to two- thirds of permitted capacity. The Town will not provide additional municipal water to the site without annexation of the property and the payment of tap fees. 8. The abandoned pond on the site does not appear to have a working outlet such that stagnant water remains after heavy rains. This ultimately becomes a mosquito breeding ground and a health hazard to our community. This problem needs to be addressed regardless of the action on the Special Review Permit. The Town of Hudson respectfully requests that approval of the application for a Site Specific Development Plan and Special Review Permit be denied. The lagoon holds by-product of the pickling process. The 1.6 MG must be treated or land applied. The Dean Pickle Company has asked the Town of Hudson to prepare a cost to treat the liquor. Description: The 1.6 MG must be transported to either the Hudson wastewater treatment plant or an undetermined land application site. The method of transportation is either the existing sanitary sewer system or hauling by trucks. If the liquid flows through the sanitary system, it must be diluted and afterwards, the system must be flushed. Provided below are four possible options for the disposal of the pickle liquor. Included with the description is the estimated cost. Option#1 consists of pumping the lagoon to a nearby manhole at a rate of not more than 50 gpm. Dilution water will be added at a 0.5:1 ratio to decrease the concentration of the liquor. The actual dilution ratio may vary. The liquid will be treated at the treatment plant and the cost is on a per pound of BOD basis. Additional costs include pumping, jetting, and sludge hauling. The estimated cost of option #1 is $36,600 (see Table 4-1). If this option is implemented, pumping should be delayed until the fall, when influent flows to the plant start to drop. The option #2 procedure is exactly the same as option #1, but the fee structure differs. The cost of treatment is based on volume, not BOD. Including the dilution water, approximately 2.4 MG of liquid would require treatment. The total cost of option #2 is $12,000 (see Table 4-2). As with option #1, pumping should not start until the fall time. Option #3 does not require treatment but rather land application. The entire contents of the lagoon (liquid and sludge) to be hauled off site and land applied. This would not require pumping or treatment at the Hudson plant. The estimated cost of option #3 is $70,400 (see Table 4-3). The advantage of option #3 (and option #4) is without treatment, the wastewater plant will not encounter a hydraulic or organic overload. Option #4 is identical to option #3, but the destination of the liquid and sludge is the dormant lagoon at the Hudson plant. The liquid could be hauled to the empty lagoon and allowed to evaporate. The estimated price of option #4 is $35,200 (see Table 4-4). The cost per gallon is less than option #3 because the site is closer and the contents will not require land application. Recommendation: Based on the simplicity of the procedure, RGCE recommends option #4. Though it is not the least expensive, this option is the easiest for the Town of Hudson. It requires a third party to haul r\153001\winword\pickle.doc the sludge to the old lagoon and from there it is allowed to evaporate. The process can start immediately and does not impact the treatment plant's hydraulic or organic capacities. The second best alternative is option #1. This option allows the town to make a small profit, but will not cost Dean Pickle too much (as with options #2 and #3). The buildings, RV units and other modular buildings appear to need major repairs and may be in serious violation of building, health and safety codes. 5. The property is not compatible with the Town's current Comprehensive Plan for the area. 6. Significant utility development costs would be involved to serve the property if it were annexed to the Town. 7. A large pond in the southwest corner of the site maybe contaminated from manufacturing operations previously conducted on the site and is currently a dumping ground for trash and other debris. The Town would be reluctant to the consideration of any annexation petition for the property until the above issues and concerns could be satisfactorily resolved. This project falls primarily under the preview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: Access: The existing 20-foot ingress/egress easement is adjacent to the Neres Canal Farmers Reservoir & Irrigation Co. The existing access is from State Highway 52. Our most recent traffic count identifies 1,450 vehicles taken in a 24-hour period on the state highway system. REQUIREMENTS: Access: The Colorado Department of Transportation (CDOT) has jurisdiction over all access to the state highway. Please contact Gloria Hess-Idler or Tess Jones at the Greeley office to verify the access permit or for any additional requirements that may be necessary to obtain or upgrade the permit. The applicant should provide verification of the existing 20-foot egress/ingress easement to the property. We have no objections to the proposal, however, we have concerns that need to be addressed: During a site visit to the property on July 31, 2003, I observed a marshy area near the west property line and fence. The marshy area is located in close proximity to the septic system leach field as indicated by the applicant on the Statement of Existing for a septic system. Upon examination of this area, a sewage odor was detected as well as what appeared to be soap suds. It is this departments concern that the "marshy water" may be caused by the failing septic leach field. We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 2. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The septic system(s) serving the bath house/laundry room and apartment building shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. / EXHIBIT I til 3. The applicant shall submit evidence to the Department of Planning Services, from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the multi-family use. 4. The facility shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. 5. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. There shall be no open burning conducted on the site, with exception to burning defined as "agricultural open burning" as defined by Regulation No. 1 of the Colorado Air Quality Control Commission Regulations. 2 6. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 7. All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 8. The applicant shall operate in accordance with the approved "waste handling plan". 9. Adequate handwashing and toilet facilities shall be provided. 10.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.The water system shall comply with the requirements for a community water system as defined in the Primary Drinking Water Regulations (5 CCR 1003-1). 12.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 3 Memorandum TO: Kim Ogle, Weld County Planning DATE: August 12, 2003 FROM: Pam Smith, Environmental Health Services (� �- CASE: USR-1437 NAME: Mioses RodrigtTes do Fred Otis COLORADO Environmental Health Services has reviewed this proposal for multi-family dwellings for persons principally employed at or engaged in farming, ranching or gardening. The Department has supplemental comments in addition to a memo dated August 7, 2003. An additional site visit was conducted by Pam Smith and Kim Ogle on August 8, 2003. The purpose of the site visit was to evaluate the source of water that has allowed a stand of cattails to grow in the railroad easement. At the time of inspection several washing machines were operating in the laundry building, and although there was no obvious area where wash water was leaving the absorption field (no wet ground, etc), or where it was entering the wetlands area (some absorption field sized rock, but no pipe), it appeared that a portion of the water in the wetlands was coming from the laundry facility as evidenced by slightly soapy water. No sewage odor was detected at the time of inspection. A further observation around the property found that the Hudson City Park lies north of Highway 52 and that between the park and the Rodriguez property is a small ditch that directs runoff into the railroad easement. An old discharge pond lies in the southwest corner of the Rodriguez property left over from the Dean Pickle food processor. This pond is lined (the liner is visible), fenced and holding some water from recent storm events. My understanding is that the processing plant was on the west side of the railroad tracks and brine water was pumped under the railroad tracks to the pond. At the time of inspection, no discharge pipe could be located that appeared to contribute to the source of any wetlands water(a capped, above-ground discharge pipe was found between the pond and wetlands). Mr. Javier Rodriguez stated that after a recent storm, a nearby property owner told him that water was overflowing from the east wetlands area to the west side of the railroad tracks through a pipe. The septic system for the migrant housing facility has failed in the past (Summer 2002) and enforcement action was initiated at that time. The system has been preliminarily evaluated for adequacy by a registered professional engineer and determined that the system is undersized for the facility. Because of the size of the facility and number of people inhabiting it, any repairs/modifications/enhancements must be conducted through the Colorado Department of Public Health and Environment, Water Quality Control Division (WQCD), Site Application regulations. Brad Simons, WQCD, gave a preliminary assessment of the septic system in his August 8, 2003 comments and came to the same conclusion. In accordance with the Regulations, public drinking water systems that serve 25 to 1,000 people must submit a minimum of one bacteriological water sample per month from their distribution system. In accordance with the Regulations, public water systems must also have their treated water analyzed for nitrate/nitrite as nitrogen, inorganics, radioactivity, organics and lead and copper based upon annual drinking water monitoring schedules. Since being designated as a public water system, the Hudson Labor Camp has received: • a Compliance Advisory, dated November 26, 2002, for a failure to monitor violation associated with nitrate/nitrite, • a Failure to Monitor Violation, dated December 13, 2002, associated with a microbiological sample for the October 2002 monitoring period, • a Failure to Monitor Violation, dated February 19, 2002, associated with a microbiological sample for the December 2002 monitoring period, • a Maximum Contaminant Level Violation (Non-acute), dated March 7, 2003, associated with a microbiological sample for the February 2003 monitoring period. EXHIBIT 1 �i Mr. Kim Ogle August 8, 2003 ' Page Two In addition to the above violations, the public water system has other violations associated with its water system for November 2002, March 2003, April 2003 and May 2003, all of which related to monitoring. 2) On July 29, 2003, the Technical Services Unit of the Water Quality Control Division conducted a sanitary survey of the public water system. The results of the compliance inspection were summarized in a letter, dated August 4, 2003, to Luisa Chavez. Attached is a copy of the letter sent to Ms. Chavez via certified mail. The letter identifies two significant deficiencies and four violations of the Colorado Primary Drinking Water Regulations. The letter requires the Hudson Labor Camp to respond, in writing, to the significant deficiencies and violations by September 5, 2003. 3) During the July 29, 2003 sanitary survey, a discussion occurred with Javier Rodriguez regarding the Hudson Labor Camp's wastewater treatment and disposal system. We reviewed the layout of the collection, treatment and disposal system on-site. According to Mr. Rodriguez, the septic tank is located in front of the bath/laundry facility and receives waste from each of the three primary buildings. Two leach fields receive effluent from the septic tank—one field is south of the complex and the other field is west of the complex. According to Mr. Rodriguez, the field west of the complex was recently expanded due to failure of the existing infiltration beds. Based upon this information, and the proposed occupancy(i.e. 50 to 60 persons) of the complex, it is likely the Hudson Labor Camp will need to obtain a discharge permit for its wastewater system. In accordance with CDPHE Policy No. WQSA-8, the "design capacity" for domestic wastewater treatment facilities shall be based on the largest 30-day average load expected to be received by the domestic wastewater treatment facility during the identified planning period. In determining the expected flow and the required hydraulic capacity for an individual sewage disposal system, full occupancy of all structures to be served shall be assumed and days of little or no system use shall be excluded. Without conflicting water usage data, the "Table of Quantities and BOD5 Strength of Sewage" of the Guidelines on Individual Sewage Disposal Systems is used as a guide to represent average conditions. Attached is a spreadsheet summarizing the average conditions anticipated for the Hudson Labor Camp. As evident, the wastewater flows for the proposed occupancies exceeds 2,000 gallons per day. In accordance with the Colorado Water Quality Control Act, the Hudson Labor Camp will therefore operate a "domestic wastewater treatment works" and must obtain approval of the site location and the design for the domestic wastewater treatment works. The Hudson Labor Camp must also obtain a discharge permit for the domestic wastewater treatment works. Based upon the comments detailed above, the Water Quality Control Division requests that any approval of the subject application be conditioned upon satisfaction of the requirements of the Colorado Primary Drinking Water Regulations, the Colorado Water Quality Control Act and the Colorado Department of Public Health and Environment. In accordance with Article 2.1.5 of the Colorado Primary Drinking Water Regulations, no person shall commence construction of any new water works, or make improvements to or modify the treatment process of an existing waterworks, or initiate use of a new source, until plans and specifications for such construction, improvements, modifications or use have been submitted to, and approved by the Colorado Department of Public Health and Environment. A Professional Engineer registered in the State of Colorado shall design all treatment systems serving a community water supply. Please take immediate action to submit plans and specifications for your system to me. • At the time of the inspection, this public water system did not have an acceptable written microbiological contaminant sampling plan. This is a violation of the Colorado Primary Drinking Water Regulations, Article 3.1.1(1)(a). Please review the enclosed guidance document for assistance in complying with this requirement. • At the time of the inspection, there was no evidence available to demonstrate that the system is implementing a cross connection control program. This is a violation of the Colorado Primary' Drinking Water Regulations, Article 12.2(2). Please review the enclosed guidance documents for assistance in complying with this requirement. • At the time of the inspection, the water system was not under the responsible charge of a certified operator, which is a violation of 25-9-110(2)(a), C.R.S. To comply with the Colorado operator certification law, you must ensure that a properly certified operator is in responsible charge of the facilities. A Class "D" water treatment license is required for your water treatment system. A"Small System" license may be substituted for the required certification in your case.
