Box 445 Greeley, CO 80631 Kersey, CO 80644 Case No. USR-1474 To Whom it May Concern; This letter is to express my concern over the proposed business going in east of my property. My concern if what the new owners have planned, as far as any new buildings; new driveways/roads;and/or additional raising of existing driveways or roads. As you well know, this area is in the flood plane of the Platte River. The house that is there now was built in the late 1990's. The original land owners raised the land for the house and made a driveway to the house, raising the ground approximately 18 inches. I spoke to the land owner, he understood my concerns, but had the building permit, so the house, as well as the road, were built. During the spring of 2000, this area was flooded. My property was under water, and the water was as high as it had ever been. I believe the water was higher, and it took longer to dissipate, because of the raising of the ground of the property next to ours. Although I believe that this was not the worst flood we have had, as far as the volume of water coming down the river, the water was higher up around our home than ever before. I again spoke with the land owner, and he assured me he would not raise the road or the area around the house. This property had been sold several times, and the last owners/renters were not aware of how high the floods can be in this area. Now the property has again been sold, and a new business is being proposed. Will this mean new buildings? More driveways or roads? More soil being brought in? There is no way they can get in and out of their property, if they build next to the existing house, without again raising the ground. If this happens, flood water will not be able to flow down stream like it should. Instead, it will back up and not only flood our yard, as it always has, but could cause it to enter our home. I hope that you will help us, address this potential problem to keep it from occurring. Weld County, Colorado (South of and adjacent to CR 38; Yz mile east of State Highway 37) Dear Ms. Katyryniuk; I am writing in response to a letter dated April 9`h regarding the referenced case (copy attached). Prima Oil & Gas Company ("Prima") has property within 500 feet of the referenced lands and the letter is somewhat vague in the relief sought for the applicant. Would you please advise Ms. Cindi Danner-Weide, Senior Landman for Prima, as to what the permit is for and how it affects oil and gas. Additionally, if possible, please also provide Prima with a plat showing the requested improvements including the township(s), range(s), section(s), quarter- quarter parts as it would be most helpful in determining the exact location of our property near the referenced lands. Please feel free to contact Ms. Danner-Weide at the letterhead address/phone number or via email cadanner@primaenergy.com. I appreciate your attention to this letter and thank you for your consideration. Sincerely, r 1 n \ nI V J Kathleen R. Vigil Land Department kv Attachment cc: C.
