RE: APPROVE LETTER OF AGREEMENT FOR STEPS PROGRAM AND AUTHORIZE
CHAIR TO SIGN - GREELEY-EVANS SCHOOL DISTRICT 6
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Letter of Agreement for the STEPS
Program between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Department of Public Health and
Environment,and Greeley-Evans School District 6,commencing September22,2004,and ending
September 21, 2005, with further terms and conditions being as stated in said agreement, and
WHEREAS,after review,the Board deems it advisable to approve said agreement,a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Letter of Agreement for the STEPS Program between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Weld County Department of Public Health and Environment, and Greeley-Evans
School District 6 be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 24th day of November, A.D., 2004, nunc pro tunc September 22, 2004.

SUBJECT: Letter of Agreement with Weld County
School District Six for Steps to a
Healthier Colorado Program
Enclosed for Board review and approval is a letter of agreement between Weld County School
District Six and the Weld County Board of Commissioners on behalf of the Department of
Public Health and Environment. In the fall of this year, the Board approved a task order option
to renew letter with the Colorado Department of Public Health and Environment for the Steps to
a Healthier Colorado Program with renewal funding of$525,814. Approximately, $44,373 of
this funding will be used to reimburse School District Six for the services of School Health
Coordinator from September 22, 2004 through September 21, 2005.
In collaboration with WCDPHE, School District Six has employed a School Health Coordinator
whose responsibilities will include coordinating the K-12 health, physical education, and
nutrition programs as well as curriculum specific to program objectives. The Coordinator will
also have other responsibilities such as assisting in the evaluation of educational programs and
services and coordinating staff development in subjects relative to the Steps Program.
I recommend your approval of this letter of agreement.

Letter of Agreement
Between the Weld County Board of County Commissioners for the County of Weld, State of
Colorado, on behalf of the Weld County Department of Public Health and Environment
(WCDPHE), and the Greeley-Evans School District 6.
Name of Contractor:
Greeley-Evans School District 6 (sometimes hereinafter referred to as"School District 6")
Term for Agreement:
November 1, 2004—October 31, 2005,with a possibility of four automatic renewals for a term
of one year each, but this Agreement will end, in any event, no later than September 22, 2008.
General Purpose:
The purpose of this Agreement is to foster and facilitate collaboration in cooperative service
delivery. The parties intend to follow the guidelines set forth in the STEPS to a HealthierUS.
Scope of Work:
Steps to a Healthier Colorado (STEPS) is a project meeting the Steps to a HealthierUS
requirements for State-Coordinated Small City and Rural Community Applicants. The Colorado
Department of Public Health& Environment (CDPHE)will coordinate STEPS projects in four
communities: Mesa County,Pueblo County, Teller County, and Weld County.
Community intervention strategies are evidence based and include community level
interventions, environmental interventions, and educational interventions. The Colorado
STEPS project's planned shod-term outcomes include: increased exposure of community
members, educators, health care professionals, and school-aged children to education about
disease prevention and self-management,healthy lifestyles, increased availability of health care
services and screening, and increased access to and consumption of healthy foods. Major
planned intermediate outcomes include: increased awareness of the benefits of a healthy
lifestyle, the risks of diseases and the advantages of proper treatment for chronic diseases; more
community residents engaging a healthier lifestyle; increased access to healthier environments;
and increased correct diagnosis of and appropriate care for people with chronic diseases. A
scope of work can be reviewed in Attachment A.
Method of Accountability:
On-going evaluation of the progress and achievements of the STEPS programs will play a key
role in each program implemented within the school district. The Weld County Department of
Public Heath& Environment(WCDPHE) and Greeley-Evans School District 6 will continue to
conduct the Youth Risk Behavioral Survey throughout the duration of this grant. Based upon the

size of School District 6, approximately 18,000 students, the potential effects of the HealthierUS
grant in conjunction with the `Improving the Health Education and Well-Being of Colorado's
Young People' grant, recently received by the Colorado Department of Education, are
tremendous! In order to ensure open communication the Project Coordinator and the School
Health Coordinator will meet weekly to share lessons learned and assure collaborative efforts
between the Weld County Department of Public Health&Environment and School District 6.
Personnel for obtaining objectives, and Compensation:
A. Personnel - Greeley-Evans School District 6 agrees to provide a School Health
Coordinator to work toward the objectives set forth in the grant and in this Agreement.
The School Health Coordinator will be responsible for:
1. Coordinate K-12 health and physical education and nutrition programs and curriculum
specific to the project objectives
2. Work closely with the Nutrition and Service Center Supervisor
3. Represents School District 6 on related community committee's
4. Attend Monthly Consortium Meetings
5. Attend all related work task force meetings
6. Work closely with and reports progress regularly to the supervisor
7. Coordinates staff development in all related subjects
8. Assists in the evaluation of educational programs and services of program objectives
9. Ability to work in diverse communities with focus on, but not exclusively Hispanic, low-
income, at-risk, chronic illnesses
10. Performs any and all other duties as assigned.
B. Compensation -The Weld County Department of Public Health&Environment agrees to
pay to School District 6 approximately$47,373 for the initial term of this agreement, and for
each renewed term thereafter, in a total amount not to exceed$189,492, contingent upon
anticipated funding from the grant. Payments will be in the form of reimbursement, and will be
made in equal monthly payments over the course of the term of this Agreement, and any
renewed terms,not to exceed four(4) years. Such payments will be made in the form of
reimbursement to Greeley-Evans School District 6 for salary costs for the School Health
Coordinator. School District 6 shall present a billing statement to Weld County Department of
Public Health &Environment at the end of each month that the School Health Coordinator has
provided services associated with the grant objectives. If there are no disputes concerning the
billing statement, WCDPHE will pay the reimbursement billed within thirty(30)days of receipt.
In the event of any dispute concerning any billing statement, the parties will use timely and good
faith effort to resolve any such disputes within thirty(30) days.
Default or Termination
If either party is in default under any of the terms and provisions contained herein, the non-
defaulting party shall notify the defaulting party of the default. The defaulting party shall then
have 15 days after such notice in which to cure any default. If any default is not capable of being
cured within the requisite period of time, then so long as the party charged with the default has
diligently pursued such cure of the default within the prescribed period of time, the defaulting
party shall be given the necessary time to cure the default.
If the default continues after the period for cure passes, and the defaulting party has not
diligently pursued a cure of such default, the non-defaulting party may terminate this Agreement
by giving ten(10)days written notice of the non-defaulting party's intent to terminate.
In any case, this Agreement may be terminated by either party by giving the other party written
notice of intent to terminate the Agreement at least thirty(30) days prior to the annual
termination date. Upon termination, WCDPHE shall pay to School District 6 any amounts not
yet paid which are due and owing as reimbursement for services previously rendered.
Miscellaneous
(1) No Third Party Beneficiaries. No third party may claim any right or benefit under this
Agreement and the obligations of this Agreement shall be for the benefit of the parties
hereto, their successors and assigns.
(2) Non-Discrimination. The parties agree that all actions and activities of the within
Agreement shall be accomplished without discrimination on the basis of race, creed,
color,national origin, gender, disability or age.
(3) Entire Agreement. This Agreement constitutes the entire agreement between the parties
for the subject matter hereof. This Agreement may be modified only by a writing
executed by the parties.
(4) Independent Contractors. Each party is an independent contractor of the other and
neither shall be liable for the actions of the other. Employees of the Weld County
Department of Public Health& Environment do not become employees of Weld County
School District 6 by reason of this contract and employees of the Weld County School
District 6 do not become employees of the Weld County Department of Public Health&
Environment by this contract.
(5) No Assignment. Neither party shall assign or transfer this Agreement to any third party
without the prior written consent of the other party.
(6) Severability. If any term or condition of this Agreement shall be held to be invalid,
illegal, or unenforceable, this Agreement shall be construed and enforced without such a
provision, to the extent this Agreement is then capable of execution within the original
intent of the parties.
(7) Liability. The Weld County School District 6 shall be solely liable for any and all
claims, costs, and expenses arising of any act or omission of School District employees in
performing services under this Agreement. WCDPHE shall be solely liable for any and
all claims, costs and expenses arising out of any act or omission of employees of
WCDPHE in performing services under this Agreement.
(8) Immunities. No portion of this Agreement shall be deemed to constitute a waiver of any
immunities the parties or their officers or employees may possess, nor shall any portion
of this Agreement be deemed to have created a duty of care with respect to any persons
not a party to this Agreement.
(9) Budget Restraints. No portion of this Agreement shall be deemed to create an
obligation on the part of the County of Weld, State of Colorado, or upon the Weld
County Department of Public Health and Environment to expend fiords not otherwise
appropriated in any relevant year.
(10) Law Governing. Except to the extent that the within contract shall be performed in
accordance with the STEPS to a HealthierUS and other applicable federal law, the
interpretation of this contract will be governed by the laws of the State of Colorado,
including its choice of law rules. This contract is executed and will be performed in
Weld County, Colorado.
(11)Notices. Any notice to be given under this Agreement shall either be hand delivered,
with signed receipt, sent by facsimile with confirmed receipt, or mailed to the party to be
notified with return receipt, at the address set forth below, until such time as written
notice of a change is received from the party wishing to make a change of address or
facsimile number. Any notice so mailed, served by facsimile, or any notice served by
personal delivery shall be deemed delivered and effective upon receipt or upon attempted
delivery. This method of notification will be used in all instances, except for emergency
situations when immediate notification to the parties is required.
