HomeMy WebLinkAbout20041124.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0300264 AGAINST ALLAN MEHL FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Allan Mehl,VI#0300264, is allegedly in violation of the Weld County Code,and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of April, 2004, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS,Allan Mehl was not present or represented at said hearing, although all parties were notified of said hearing by the Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. Additionally, if you should choose screening as the option you wish to utilize, please be advised that all of the vehicles that you choose to screen must have been lastly registered or currently registered under the current owners or legal occupants. NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand materials are stored or handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered last or currently registered under the property owner and/or tenant's name. SCREENED: Construction and maintenance of fences, earth berms or the USE of LANDSCAPING materials or other materials USED with the approval of the Department of Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding uses. A SCREENING PLAN shall be submitted and approved by the Department of Planning Services. This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance to answer any questions the Board of County Commissioners might have about the violations. Please also be advised that I will be taking video and/or pictures from the road or adjacent properties the business day before or as soon as possible to the above mentioned Violation Hearing date. The Department of Planning Services' staff will be recommending that the Board of County Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Hopefully the property owner would be allowed minimal time to bring the property into compliance of Weld County Codes. We as neighbors, both to the west and north of this property, have watched this entire property(dwelling, barns and outbuildings) fall into such disrepair that we feel they would be unsafe for both human and animal habitation. Adding to this the accumulation of junk on these ten acres over the last few years, gives us reason to feel such above legal action should be taken. We do not believe the house is being lived in nor should it be lived in judging from the Highway 66 or public right-of way southern view of the property. The main home has an old mobile home temporarily attached by previous owners for farm help and is in a state of general dilapidation resulting from improper lack of maintenance. The entire structure has large stacks of wood piled in front or against it which appears to be a serious fire hazard. Since Mr. Mehl was first advised in August of 2003 that he at least needed to screen his "non commercial junkyard" and junk from adjacent property andor public right-of way, he has made no attempt to do so. This junk consists of a number of barrels, tires, bicycles, vehicles, piles of scrap, wood, pipe & metal objects, appliances, & boats. This debris is not only piled or parked in front of the dwellings & barns facing Highway 66, but is strung for at least 500 feet along the east side visible from both north and east. We have no idea of the extent of hazardous materials that maybe included in this debris, but the barrels alone concern us. Mr. Mehl has recently leased this property for the boarding of horses and these animals are allowed to wander throughout this so called "junk." These horses have now depleted these few acres of any grass that was left which again will give rise to the continual weed problem that spreads onto our property. This property has a lake or reservoir behind the dwellings but the owner has not irrigated nor filled this lake in order to encourage any agricultural use of this property since he has owned it. Aesthetically this property is a detriment for us as well as people entering Weld County along State Hwy. 66 and is definitely not contributing to our desire to keep not only our property but property that surrounds us in a manner that enhances the agricultural use as well as the environmental safety of farm property.
