Patina has reviewed memoranda from the Department of Environmental Health Services (attached as Exhibit A) and from the Public Works Department (attached as Exhibit B) regarding this proposed request. Pursuant to Exhibit B, Patina has negotiated a Long-Term Road Maintenance and Improvements Agreement (attached as Exhibit C). Based upon Patina's acceptance of the conditions set forth in the memoranda and the execution of the Long-Term Road Maintenance Improvements Agreement, we request that the Department of Planning Services approve the requested amendment to USR-729 as a minor change. Patina understands that, upon approval, these conditions and the Long-Term Road Maintenance Improvements Agreement would become enforceable standards of USR-729. Please indicate such approval of the Department of Planning Services by countersigning the enclosed copy of this letter and returning it to the attention of the undersigned. It is our understanding that the facility owner has requested to increase the number of disposal trips to an average of 20 trucks per day from the existing use of approximately two trucks per day. Below is a summary of physical improvements that Environmental Health Services suggests be required should approval be granted to increase the number of truck to an average of 20 per day. Our suggestions are based upon similar existing facilities under the same ownership and with input from Ed Dimatteo of the Colorado Oil and Gas Conservation Commission. 1. A sufficient concrete receiving pad should be constructed. The pad should be constructed to ensure that spilled waste and wash down water is contained within the receiving area. A sump may need to be constructed and installed. 2. Disposal of waste should only be allowed by hose-type connections. No intentional dumping of waste water should be allowed upon the receiving pad. 3. Secondary containment structures, made of concrete, surrounding each tank or battery of tanks should be required. The volume of each containment structures should be 150% greater than the volume of the largest tank in the structure. Realizing the initial cost of this type of permanent installation, it would be acceptable to allow this construction to be completed at a later date. 4. Appropriate records concerning truck trips and disposal quantities should be maintained for inspection. 5. It is suggested a monitoring well network be installed and routine monitoring of groundwater be conducted to detect possible contamination from the operation. Also,below please find a listing of operational-type standards that would normally be suggested as a part of any recommendation from this Department: 1. The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. 2. A manager, knowledgeable in operating an injection well, shall be on site when the facility is receiving waste. 3. No disposal of waste, other than Class II, as defined by the Environmental Protection Agency is permitted. Any change from the approved Class II use would require an amendment to this Special Review Permit. I 4. The maximum permissible noise level shall not exceed 70 db(A), as measured according to Section 25-12-102, C.R.S. 5. Fugitive dust must be controlled on this site. 6. All chemicals stored on-site must be in locked buildings, on an impervious surface, provided manufacturer recommendations for safe storage and handling are in accord. In any event, manufacturer recommendations will take precedence. 7. The surfaces around the disposal area shall be constructed of an impervious material, and graded to insure that all spilled waste is contained within the unloading pad. 8. Any analysis of waste will be forwarded to the Weld county Department of Public Health and Environment. The Department reserves the right to require monitoring at a later date. 9. This facility must comply with the laws, standards, rules and regulations of the Air Quality Control Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste Division,the Colorado Oil and Gas Conservation Commission, any other applicable agency, and all applicable Weld County zoning laws and ordinances. 10. Any petroleum contaminated soils on the facility shall be removed and disposed in accordance with all applicable rules and regulations. 11. The concrete receiving pad shall be cleaned at a frequency that prevents oils and other wastes from building up on the pad. 12. During winter months,the facility shall maintain the receiving pad free of ice. 13. A safe and adequate sewage disposal system shall be available on the facility premises. 14.
