Dear Ms. Lockman:
Thank you for the opportunity to review this Site Specific Development Plan and Special Review
Permit of an oil and gas production facility. The City of Greeley Planning staff has reviewed the
application for this USR from Prima Oil and Gas located east of and adjacent to HWY 257 and
adjacent to WCR 64 and wish to forward the following comments.
This proposal is outside the City of Greeley 2020 Growth Area. It is suggested that landscaping
be provided along both Highway 257 and WCR 63 to screen the facility. The Greeley Public
Works Department noted a reservation of a minimum of 75' of right-of-way from the centerline
of Highway 257 and 60' of right-of-way from the centerline of WCR 64 would be appropriate to
facilitate future development of this area if the proposal is approved by the County. Also, with
the proximity of this property to Windsor it is advised that Windsor be notified of this request.

Environmental Health Services has reviewed this proposal for an oil and gas production
facility (nine oil and gas wells). We have no objections to the proposal, however, we do
recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. According to the application materials submitted the site will temporarily store oil
and water in aboveground storage tanks. Therefore, the applicant shall submit
evidence of an Aboveground Storage Tank permit from the Colorado Department
of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground
storage tanks located on the site. Alternately, the applicant can provide evidence
from the (CDL&E), Oil Inspection Section that they are not subject to these
requirements.
3. In the event that 1 or more acres are disturbed during the construction and
development of this site, the applicant shall inquire with the Water Quality Control
Division (WQCD) of the Colorado Department of Public Health and Environment
if they are required to obtain a stormwater discharge permit. Alternately, the
applicant can provide evidence from WQCD that they are not subject to these
requirements.
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The operation shall comply with all applicable rules and regulations of the
Colorado Oil and Gas Conservation Commission.
6. If applicable, the applicant shall comply with all provisions of the Underground
and Above Ground Storage Tank Regulations (7 CCR 1101-14).
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
9. Adequate toilet facilities (port-a-potty) shall be provided during the construction of
the facility.
10.Bottled water shall be utilized for drinking and hand washing.
11 .All potentially hazardous chemicals must be stored and handled in a safe manner

in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
12.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.

The Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:

Access:
From the Weld County Access Information Sheet and the plat drawing provided with the application, it appears
that the access points are from State Highway 257 or from the internal Kodak road system.
REQUIREMENTS:

The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any
additional requirements that may be needed to obtain or upgrade the permit.
Notification to Eastman Kodak should be verified by Planning Services or the Public Works Department.
The Town of Windsor annexed the part of Section 34 which appears to be in the proposal. Verification is
needed from the Town of Windsor indicating that they are aware of the proposed USR and had an opportunity
to comment.

Permits will be required for the installation of all new equipment and all electrical work, but not
for the replacement of equipment on existing foundations, including the piping and electrical
connections to that equipment, norfor the addition of minor equipment such as filters and
coolers, however electrical permits are required for any new electrical circuits provided to added
equipment. Permits are not required for process piping for liquids or gas.

Reference is made to the above-mentioned project located in Section 34, Township 6 North,
Range 67 West, Weld County, Colorado.
If any work associated with this project requires the placement of dredged or fill material, and
any excavation associated with a dredged or fill project, either temporary or permanent,in waters of the
United States at this site, this office should be notified by a proponent of the project for proper
Department of the Army permits or changes in permit requirements pursuant to Section 404 of the Clean
Water Act. Waters of the U.S. includes ephemeral, intermittent and perennial streams, their surface
connected wetlands and adjacent wetlands and certain lakes, ponds, drainage ditches and irrigation
ditches that have a nexus to interstate commerce.
