RESOLUTION RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING USE BY SPECIAL REVIEW PERMIT #654 FOR A FERTILIZER STORAGE, MIXING, LOADING, AND SALES OPERATION-PERMAGREEN PRODUCTS COMPANY,C/O ROXYVENDENA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 18, 2002, a Show Cause Hearing was conducted to consider revocation of Use by Special Review Permit#654 for a Fertilizer Storage, Mixing, Loading,and Sales Operation, issued to Permagreen Products Company, 5520 Harlan,Arvada,Colorado 80002,and WHEREAS, Roxy Vendena is the current owner of the facility located on property being further described as follows: NE1/4 of Section 24, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing of November 18, 2002, the Board deemed it advisable to continue said matter to February 3, 2003, to allow Permagreen Products Company, c/o Roxy Vendena, adequate time to submit a Design and Operations Plan, as well as complete any additional requirements of the Departments of Planning Services and Public Health and Environment, and WHEREAS,at said hearing on February 3,2003,the Board deemed it advisable to continue said matter to April 7,2003,to allow the operator additional time to complete the requirements of the Departments of Planning Services and Public Health and Environment,as well as the requirements of the Colorado Department of Public Health and Environment, and WHEREAS,at said hearing on April 7,2003,the Board deemed it advisable to continue said matter to June 9, 2003, to allow the operator additional time to complete the requirements of the Weld County Department of Public Health and Environment, as well as the requirements of the Colorado Department of Public Health and Environment, and WHEREAS,at said hearing on June 9,2003,the Board deemed it advisable to dismiss said Show Cause Hearing at such time as, and upon the condition that the following items were completed within 180 days, or the matter will be heard by the Board of County Commissioners on November 19, 2003, at 10:00 a.m.: 2004-1556 PL0846 SHOW CAUSE HEARING - USR #654 - PERMAGREEN PRODUCTS COMPANY, C/O ROXY VENDENA PAGE 2 A. The revised site-specific topographical survey will be submitted to both the Weld County and Colorado Departments of Public Health and Environment and, if required, any additional revisions will be completed. B. Permeability results of the collections structures will be obtained and if necessary, the structures will be appropriately constructed. C. A final draft of the Design and Operations Plan will be submitted to both the Weld County and Colorado Departments of Public Health and Environment. D. The facility will submit a financial assurance plan to the Colorado Department of Public Health and Environment for review and approval. E. During the June 6,2003, site inspection, it was observed that a stormwater and leachate collection area was mistakenly located on Section A. A retention structure will be designed within Section B and a berm or swell will be constructed in accordance with the Storm Drainage Retention Plan,dated September 24, 1991, and the Solid Waste Regulations, and WHEREAS,on November 19,2003,the Board deemed it advisable to continue the matter for 180 days, until May 17, 2004, at 10:00 a.m.,to allow additional time for Permagreen Products Company,do Roxy Vendena,to review and make appropriate changes to the facility's Design and Operations Plan, and complete the above listed conditions, and WHEREAS,on May 17,2004,the Board again deemed it advisable to continue this matter for 150 days, until October 13, 2004, at 10:00 a.m., to allow time for the Colorado Department of Public Health and Environment, to approve the Design and Operations Plan, and WHEREAS, on October 13, 2004, the Board deemed it advisable to dismiss said Show Cause Hearing based on staffs recommendation, dated October 11, 2004, indicating the facility operator has obtained State and County acceptance of the financial assurance proposal and approval of the Design and Operations Plan. Standard 6 - The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq., of the Weld County Zoning Ordinance. r"", Case Summary ContinueL August 21, 2002 Page 3 Standard 8 - The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. Standard 9 - The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Additionally, the property is currently in noncompliance with the State of Colorado, Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2). In accordance with the Regulations, Section 14.1.3(D) existing composting facilities are required to comply with the applicable requirements of Section 14 within one hundred and eighty (180) days of the effective date of the Regulations. The effective date of the Solid Waste Composting Regulations in Section 14, came into effect September 1, 2000. Bethany Salzman, Zoning Compliance Officer for Weld County Department of Planning Services accompanied me. The purpose of the inspection was to inspect and assess the facility's compliance with the"Regulations Pertaining to Solid Waste Disposal Sites and Facilities" (the Regulations) (6 CCR 1007-2) as promulgated by the Solid Waste Disposal Sites and Facilities Act, Title 30, Article 20, part 1, C.R.S., as amended, and the development standards set forth in Use by Special Review Permit#654 (USR-654). On this date, it was observed that the site did not comply with both the Regulations and USR - 654. The results of the inspection are enclosed with this inspection letter. Please correct any noncompliance indicated on the inspection sheet. Please also address the solid waste material (trash) that was incorporated into the soil berms constructed on your facility. This is considered disposal of solid waste. According to the Regulations, it is unlawful to dispose solid wastes without a certificate of designation. Additionally, according to the Weld County Code, a Use by Special Review (USR) permit and a certificate of designation is required for a solid waste disposal site. However, Title 30, Article 20, part 102(3) of C.R.S, does allow any person other than a governmental unit to dispose of his own solid wastes on his own property, as long as the disposal site complies with the rules and regulations of the Colorado Department of Public Health and Environment and does not constitute a public nuisance. The disposal area on your property is considered an illegal solid waste disposal site and facility at this time. This facility has two(2)available options, which can be pursued at this time: 1. The facility may choose to remain open under current operational practices. The facility must make application for a certificate of designation and amend its USR permit to Weld County. 2. The facility may choose to cease operations entirely. A closure plan must be developed which addresses removal and/or covering of wastes, mitigating any contamination, and revegetating the disposal area to self-sustaining conditions. Staff determined that the continued storage of composting "material" (not compost) on 'Area A' would be considered a substantial change to your existing Use by Special Review (USR-654) permit. This finding was partially based upon the "Storm Drainage Retention Plan" map, dated September 24, 1991. According to the map, next to 'Area A', it specifically states, "This portion of site will not be used for composting activities". Additionally, the following Operation Standards are in violation: Standard 3 The Use by Special Review shall be limited to one (1) access point on Weld County Road 13. An eighteen (18) inch minimum diameter culvert forty (40)feet in length shall be installed at the point of ingress and egress to the subject site. Standard 4 The applicant and/or operator shall implement a runoff containment program for the Use by Special Review area as approved by the Department of Planning Services. Standard 5 The applicant shall comply with the design standards for;the Use by Special Review, Section 24.5 et seq., of the Weld County Zoning Ordinance. Standard 6 The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq., of the Weld County Zoning Ordinance. Standard 8 The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. I hope this reply will be helpful to you in reviewing our case and making recommendations to the Board of Commissioners . Operation Standard #4 - The design that we submitted on September 25th for your approval is the plan that would be implemented with one exception - the culvert system that was designed for us to have access to areas B and C would prove to be dangerous for our composting ma- chinery to cross over . We would like to eliminate this culvert system entirely and leave the swale com- pletely open . At this time , we would also like to request another driveway that would enter into areas B and C from Weld County Road 13 so that we can bring our composting machinery into that area in a more effi- cient and safe manner . Depending on weather conditions , this project will be completed and ready for your inspec- tion on or before November 1st . Operation Standard #5 - With the ponding and berm design laid out in our plan , the area should be more than adequate for a 100-year event . Operation Standard #6 - Observing the height of the weeds adjacent to us , including weeds in the ditches , we felt that this might be a requirement that , generally speaking , didn ' t affect anyone . Both of these demonstrate the facility is able to comply with the requirements of the Solid Waste Disposal Sites and Facilities Act and the facilities Use by Special Review Permit No. 654. The following activities have taken place since the previous hearing: • A final draft of the D&O Plan, dated May 13, 2004, was submitted to both the Weld County and Colorado Departments of Public Health and Environment (Division) for review and approval. The D&O Plan was conditionally approved by the CDPHE on June 3, 2004, provided the facility comply with all health and environmental laws, standards rules and regulations of the Division, and all applicable local laws and ordinances. The letter also required financial assurance be established and approved by the Division and County on or before August 11, 2004. The D&O Plan was approved by Weld County on October 11, 2004. • Final revisions to the financial assurance proposal were submitted to both the Weld County and Division for review and approval on October 8, 2004. In consultation with Weld County, on October 8, 2004, the Division approved the financial assurance proposal, provided the facility annually adjust cost estimated to account for inflation, replace original cost figures every five years or as needed, maintain continuous coverage and to promptly initiate an appropriate financial assurance mechanism. The comments from the state are summarized first and the clarification and justification follows in the order of your October 5 letter. 1. Verification that the estimates use the 5-year median volume of materials as a basis for the cost figures. The financial assurance agreement outlines in items 2 and 3 respectively that the "CONTRACTOR" shall perform any necessary reclamation of composting materials at the site and CONTRACTOR shall perform the complete site reclamation in exchange for the value of any and all finished or finish-able compost on site. The intent of this language is CONTRACTOR understands and is obligated to reclaim the subject site regardless of the minimum, average or maximum quantities of materials on site for the contracted compensation. Your "Pro Ag"Environmental Professionals October 6, 2004 Page 2 2. Regarding text in the document clearly indicating that each firm will provide the services stated at the price stated if the State of Colorado calls for closure. The preamble of the financial assurance agreement outlines the following: "WHEREAS, both parties warrant to uphold the obligations outlined herein to the "State"; and "WHEREAS, both parties agree to initiate their obligations under this agreement at the direction of the "State" The intent of these statements of the preamble state both the obligation and initiation of this agreement is to and at the direction of the "State" of Colorado. 3. It is not clear if the $15,000 figure in item #3 of the agreement includes groundwater monitoring. The financial agreement does not include any post-closure care or monitoring other than what is outlined in paragraphs 4.a through 4.e. First, post-closure care such as groundwater monitoring is only necessary for the StroMo, LLC site and not the Permagreen site. Second, AGPROfessionals, LLC submitted a separate estimate for post-closure monitoring of the StroMo, LLC site. Finally, as discussed, the two documents must remain separate as the financial assurance agreement for reclamation is between two specific parties, the operator and the CONTRACTOR. AGPROfessionals, LLC is not a party in these documents. Therefore, the AGPROfessionals, LLC estimate for post-closure care must remain separate but shall be added to the cost of reclamation for the StroMo, LLC facility. A copy of the AGPROfessionals, LLC estimate is attached. 4. Item# 2 of the agreement should be modified to include language that the contractor will "... perform any necessary reclamation of composting materials at the site of [facility name here] in accordance with the regulations applicable at that point in time. " A difficulty exists for contractors to bid on work to be conducted under future conditions that may not be known. As discussed, we believe that the State's concerns are covered in item 4.f of the financial assurance agreement as submitted which states: 4.f The CONTRACTOR shall follow the requirements outlined in the facility's Design and Operations Plan effective at the time of Reclamation.
