RESOLUTION
RE: APPROVAL OF AMENDED APPLICATION CONCERNING CONSTRUCTION OF A
GRADE CROSSING AND AUTHORIZATION FOR COUNTY ATTORNEY TO SIGN
THE SAME.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, an application to the Public Utilities Commission
concerning the construction of a signalized grade crossing over
the right-of-way and tracks of the Great Western Railway was
previously presented to the Board of County Commissioners of
Weld County, Colorado and approved by said Board for submittal
to the Public Utilities Commission, and
WHEREAS, pursuant to said application, a referee recommended
that such signalized grade crossing be allowed, and
WHEREAS; said application concerns the following location:
Westerly approximately 100 feet from the
intersection of State Highway 257 and Weld
County Road 66 on the proposed extension
of Weld County Road 66; also being approxi-
mately 100 feet West of the Northeast
corner of Section 28 , Township 6 North,
Range 67 West of the 6th Principal Meri-
dian, Weld County, Colorado.
WHEREAS, due to the extremely light train traffic through
the subject crossing, coupled with the extremely small length
of said trains and the low maximum speed on the subject tracks,
it is the belief of this Board that a signalized grade crossing
is not required and that a cross buck with a flagman will con-
stitute sufficient safety precautions so that accidents may be
prevented at the subject crossing and that the safety of the
public may be promoted, and
WHEREAS, the Board deems it necessary to amend its applica-
tion previously submitted in order to eliminate the need for a
signalized grade crossing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-

missioners of Weld County, Colorado that approval is hereby given
to submit an amended application concerning grade crossing to
\ the Public Utilities Commission.

BE IT FURTHER RESOLVED by the Board of County Commissioners
that the County Attorney is hereby authorized to sign said appli-
cation.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd day of
February, A.D. , 1981.
