Rule Charter, is vested with the authority of administering the

WHEREAS, on November 25, 1981 the Board of County. Commissioners

approved a road improvement agreement between Weld County and

s Inc. for construction of a portion of County Road 39 . 5, .and

N WHEREAS, said agreement states in Section D. 2. : " . . .Exhibit

w 'A' which is attached hereto and incorporated herein. " and in

Section D. 3. : " . . .Exhibit 'B' and are incorporated herein. " , and

WHEREAS, said exhibits have now been presented and considered

LL NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that Exhibit "A" and Exhibit "B" are hereby approved
to be incorporated into said agreement.
' The above and foregoing resolution was on motion duly made
and seconded, adopted by the following vote on the 9th day of
December, A. D. , 1981.

c Description of Right of Way

I •• .6 A 60-foot wide road right of way which includes the
existing 30-foot right of way, known under the present
' Weld County -numbering system as Weld County Road 3911.

I \ o The new roadway will be located in a North-South direction
IN0 z generally between the Southwest and Southeast Quarters of
Section 29 , Township 6 North, Range 65 West of the 6th

v ,] P.M. , from Weld County Road 64 North to the right of way
of the Union Pacific Railroad Company and will be approxi-
,r = mately 10 feet wider on the East side of the existing
it L County right of way,
g and 20 feet wider on the West side of
.N z the existing County right of way.

The new surveyed right of way shall be surveyed and
approved by the Weld County Engineer prior to commencement

o Actual plans and specifications for construction of the

in Steel Co. , Inc. closes the purchase of lands pursuant

r = Incorporated as specified in paragraph 9 of this Road
w Agreement.

; -o Plans and specifications will be prepared in accordance
with the preliminary design criteria which call for the
following:

i w (1) Two, 12-foot drivelanes
(2) Eight inches base course and three inches asphalt
PC 's- (3) Two , 6-foot shoulders on each side constructed of

Iv ` (4 ) Necessary borrow ditch and culverts and drainage-ways
} and other structures necessary to provide adequate
