A public hearing was conducted on May 19, 2004, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 30, 2004, and duly published May 5, 2004, in
the Fort Lupton Press, a public hearing was conducted to consider the request of Jeff Stamp for
a Site Specific Development Plan and Minor Subdivision Final Plan, MF#1017,for nine(9) lots with
E (Estate) Zoning. Lee Morrison, Assistant County Attorney, made this a matter of record. Sheri
Lockman, Department of Planning Services, presented a brief summary of the proposal and
entered the favorable recommendation of the Planning Commission into the record as written. She
gave a brief description of the location of the site, which is within the three-mile referral areas for
the towns of Mead, Berthoud, and Johnstown, but not within any Intergovernmental Agreement
(IGA) boundaries. Ms. Lockman stated the development will be served by the Little Thompson
Water District and individual septic systems. She stated 15 referral agencies reviewed this
proposal, and 10 responded with comments that have been addressed through the Conditions of
Approval and Development Standards. She further stated the Town of Mead and the St. Vrain
Valley School District each responded with comments in opposition to the proposal, and staff
received no correspondence from surrounding property owners. Responding to Commissioner
Geile, Ms. Lockman stated Condition of Approval#1.1 addresses the cash-in-lieu payment required
by the School District.
Pam Smith, Department of Public Health and Environment, stated the lots meet the minimum
2.5-acre requirement, and they will have engineered septic systems due to poor perk rates, which
is consistent with the system for the existing residence on the site.
Donald Carroll, Department of Public Works, stated Weld County Road 38 is designated as a
minor arterial, and staff is requesting the applicant reserve additional right-of-way. He stated the
access road will be surfaced with gravel, and will not be maintained by the County. He further
stated there is an On-site Improvements Agreement for construction of the internal road, as well
as an Off-site Improvements Agreement for stabilization on Weld County Road 38 from the

entrance to the site to Weld County Road 13. Responding to Chair Masden, Mr. Carroll stated staff
will be requesting an additional 25 feet of right-of-way be reserved in addition to the 60 feet of
existing row.
Todd Hodges, Todd Hodges Design, LLC, represented the applicant and stated the applicant has
met with many of the referral agencies and adjacent property owners in an effort to mitigate their
concerns. He stated following discussions with the St. Vrain Valley School District, the applicant
has agreed to write a check for the entire cash-in-lieu amount and submit the receipt as evidence
prior to recording the plat. Responding to Chair Masden, Mr. Hodges stated the cash-in-lieu fee
will be $781 per parcel for the High School and $648 per parcel for the Elementary School. In
response to Commissioner Geile, Mr. Hodges clarified those amounts reflect the land mitigation
and school impact fees. He gave a brief description of the surrounding land uses and stated the
applicant has met the criteria of the Mead IGA, although it no longer exists, and annexation is not
a viable option. He stated there will be nine estate lots ranging from 2.5 to 16.2 acres, and the
internal roadway will be constructed predominantly on an existing roadway which leads to the
existing improvements on Lot 5. Mr. Hodges stated the applicant has been working with the oil and
gas interests, which have started to drill on the sites indicated on the plat, and he reviewed the
criteria of approval as detailed in Exhibit F. Responding to Chair Masden, Mr. Hodges stated due
to the length of the road and low fire flow, the Mountain View Fire Protection District did require
a bump out between Lots 2 and 3 for emergency vehicles, and fire sprinklers for each structure
(Switched to Tape #2004-23). In response to Commissioner Vaad, Mr. Hodges stated the
sprinklers are being required regardless of the square footage, and that seems to be the trend with
various Fire Protection Districts throughout the area.
No public testimony was offered concerning this matter. In response to Chair Masden, Mr. Hodges
stated he and the applicant have reviewed and concur with the Conditions of Approval. He
requested Condition of Approval #1.1 be modified to correct the amount and clarify that evidence
of payment is satisfactory, rather than requiring an agreement. Commissioner Vaad commented
that evidence of a receipt meets the intent of the Condition. Ms. Lockman stated $645 was the
amount provided by the School District in its referral response. Mr. Barker suggested the Condition
be modified to state, "The applicant shall submit evidence that the agreed upon cash-in-lieu
payment of$781 per lot for the High School and $648 per lot for the Elementary School has been
paid to the St. Vrain Valley School District."
Commissioner Vaad commented he appreciates the applicant's efforts to mitigate the issues,
therefore,he moved to approve the request of Jeff Stamp for a Site Specific Development Plan and
Minor Subdivision Final Plan, MF #1017, for nine (9) lots with E (Estate) Zoning, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval as entered into the record. His motion also included modifying Condition #1.1 to state,
"The applicant shall submit evidence that the agreed upon cash-in-lieu payment of$781 per lot for
the High School and $648 per lot for the Elementary School has been paid to the St. Vrain Valley
School District." The motion was seconded by Commissioner Jerke, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:30 a.m.
