Two letters from the Division of Water Resources dated July 12, 2004 and July 28, 2004 The comments provided from the Department of Public Health and Environment have already been included in the Planning Commission resolution. Staff is requesting that the following condition be placed in the resolution. New 2.D and re-number accordingly, The applicant shall incorporate the recommendations made by the Division of Wildlife in the letter dated June 4, 2004 into the HOA covenants for Nesting Crane Ranch written evidence of such shall be provided to the Department of Planning Services. Add to 2.B The applicant shall address the requirements (concerns) of the Department of Public Works, as stated in the referral response dated June 7, 2004 and June 22, 2004. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. Department of Public Health and Environment CASE NO.: PZ-1000 NAME: Stenerson, Olson & Lowery Development At the Planning Commission hearing June 15, 2004 the applicant stated that horses would be allowed on the lots. Because of the expectation that the septic systems will be engineer designed and now that statement that horses (and associated outbuildings, etc)will also be allowed on the property. Therefore, based on the discussions at the hearing, the following conditions were added: 2.O. 8. Primary and secondary septic envelopes shall be placed on each lot. All septic system envelopes must meet all setbacks, including the 100-foot setback to any well. 9. Language for the preservation and/or protection of the absorption field envelopes shall be placed in the development covenants. The covenants shall state that activities such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. The following condition was also added to the Change of Zone plat notes as item D (renumbering subsequent plat notes) D. Language for the preservation and/or protection of the absorption field envelopes shall be placed in the development covenants. The covenants shall state that activities such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. Today, June 16, 2004 I had a conversation with Wayne Wentworth regarding these additional conditions. The applicant may choose to state specifically in the covenants that no horses or other livestock will be allowed on the lots in order to remove the above conditions. I would be in agreement with this since the potential for horses, pasture, corrals, outbuildings, etc. would be eliminated from competition with septic system space on the lots. The parcel is currently agricultural land and generally cannot be considered as critical habitat for any wildlife species. According to the Colorado Division of Wildlife Natural Diversity Information Source Map for Weld County, the area provides winter range for bald eagles, foraging areas for ducks and geese, and is within the overall range for pheasant and mule deer and white-tailed deer. Coyote, fox, raccoon, skunk, songbirds, other raptors and herptofauna may also occur in this area. Upon disturbance of any areas, noxious weeds should be monitored and controlled. Homeowners should also be aware that planting trees, shrubs and other herbaceous plants may attract wildlife. Subsequently, ornamental landscaping may be damaged by wildlife. Homeowners will need to be responsible for damages incurred and will not be eligible for any reimbursement by the Colorado Division of Wildlife. Homeowners should be made aware of the presence of native predators. Pets should not be allowed to roam free. All domesticated livestock and farm animals should be secured with wildlife proof fencing appropriate for the species being raised. Pets as well may negatively interact with wildlife even on the home-sites and homeowners will be responsible for handling these problems. Homeowners should secure pet and animal feeds, trash containers, and charcoal/gas grills. Pets should have current shots. All control of nuisance wildlife will be the homeowner's responsibility with the possible exception of bears and mountain lions. Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments Internal Roadways: ❑ The internal roadway(Nesting Crane Lane)exceeds the County's maximum block length of 1,500-feet permitted by County Code Sec. 24-7-40-E. The applicant has addressed the excessive length of the internal roadway (Nesting Crane Lane) with an emergency access proposed at approximately 1,600-feet along Nesting Crane Lane. Public Works finds no design geometry conflicts. ❑ The applicant must provide written documentation, verifying that the roadway layout is acceptable to the fire department of jurisdiction prior to recording the change of zone plat. o Should the applicant fail to obtain acceptance by the fire department, an eyebrow shall be added at the 1,500-foot length along Nesting Crane Lane to accommodate an intermediate turn-around point within the subdivision and meet Code requirements. ❑ This proposed subdivision is in the vicinity of rapid development and in proximity to an urbanizing area. Elmore Road is paved, which is directly west of the proposed Nesting Crane Ranch subdivision. Elmore Road is maintained by and under the jurisdiction of Weld County. ❑ The Weld County Geographic Information System (GIS) indicates right-of-way available to connect the emergency access of Nesting Crane Lane and Elmore Road. Public Works finds no objections to this proposal, which would be a safety measure mutually beneficial to both adjacent subdivisions. ❑ The applicant must indicate control for the emergency access proposed. Often these emergency accesses are gated in cooperation with fire departments. Recommendation ❑ The Public Works Department recommends approval of this change of zone. The applicant shall address the comments listed above at the specific step of the review process stated. The review process will continue only when all appropriate elements have been submitted. Water Division 1, Water District 5 Dear Ms. Hatch: We have reviewed the above referenced proposal to subdivide a 39.64-acre parcel into 9 single-family residential lots. The Water Supply Information Summary Sheet included in the submittal material indicates that the household use water requirement for the residential lots is 6480 gallons per day or 7.25 acre-feet per year. The Longs Peak Water District (District) has been proposed, as the source of water and a letter of commitment from the District was included in the referral material. Based on the information from the above-mentioned letter, the District is committed to provide water service to the subdivision per terms and conditions of the District. Although the District is able to serve this subdivision, the State Engineer's Office does not have any recent information concerning the District's water supply in our files. Our most recent information is dated December 15, 1998. Pursuant to CRS 30-28-136(1)(h)(II), a municipality or quasi-municipality is required to file a report with the county and the State Engineer documenting the amount of water which can be supplied to the proposed development without causing injury to existing water rights. A report of this nature was not included. See the attached Guidelines for Subdivision Water Supply Plan Reports for the necessary information. To expedite the evaluation of the water supply for the subdivision, a water supply report or statement should include a summary of water rights owned or controlled by the District, the yields of these rights both in an average year and dry year, the present demand on the system and the anticipated demand due to commitments for service entered into by the District and the amount of uncommitted firm supply the District has available for the future.
