RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT#1289 - DYECREST DAIRY,
LLC, C/O TERENCE DYE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of ,
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #2000-2756 dated December 12, 2000, the Board did approve
Special Review Permit#1289 for a Livestock Confinement Operation (4,000-Head Dairy) and
Four Additional Accessory to the Farm Dwelling Units in the A (Agricultural) Zone District for
Dyecrest Dairy, LLC, do Terence Dye on the following described real estate, to-wit:
Lot B of Recorded Exemption #2331; located in part
of the W1/2 of Section 5, Township 7 North, Range
67 West, and part of the W1/2 SE1/4 of Section 5,
Township 7 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board has received a request from Dyecrest Dairy, LLC, do Terence
Dye, 1137 North County Line Road, Fort Collins, Colorado 80524, to vacate said Special
Review Permit#1289, as a Condition of Approval for Recorded Exemptions #3684 and #3685,
and Subdivision Exemption #1005, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Review Permit#1289 be, and hereby is, vacated.

SUBJECT: Vacation of USR-1289
The Department of Planning Services has received the attached letter dated February 23, 2004
from Dyecrest Dairy c/o Terence Dye. Mr. Dye is requesting that USR-1289 for a 4,000 head
dairy be vacated as a requirement of Recorded Exemptions RE-3684, RE-3685 and Subdivision
Exemption SE-1005.
Background information:
Legal Description: Part of Section 5, T7N, R67W of the 6th P.M., Weld County, CO.
Location: North of and adjacent to County Road 84 and east of and adjacent to
County Road 15.
USR-1000: USR-1289 was approved by the BOCC on December 13, 2000, for an
agricultural service establishment and a livestock confinement operation
(4,000 head dairy) and four additional accessory to the farm dwelling
units in the A (Agricultural) Zone District.

The following plat note from the above referenced cases requires the applicant
to submit a letter to the Weld County Department of Planning Services
requesting the vacation of Use By Special Review#1289.
The plat note reads as follows:
Prior to the release of the first building permit on either Lot A and/or Lot 8, the
applicant shall vacate USR-1289 for a 4,000 head dairy.
I hereby request vacation of USR#1289, based on the approvals of RE-3684,
RE-3885 and SE-1005.
