HomeMy WebLinkAbout20042866.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2401 - RONALD GRABRIAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners of Weld County,Colorado,on the 24th day of May,2004, considered the request of Ronald Grabrian,6325 Weld County Road 23, Fort Lupton, Colorado 80621, for a mobile home to be used as a second Accessory to the Farm, and WHEREAS,at said hearing on May 24,2004,the Board of County Commissioners deemed it advisable to continue this matter to September 27, 2004, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: NE1/4 NE1/4 of Section 35,Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS,on September27,2004,the Board of County Commissioners,having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The Individual Sewage Disposal System (I.S.D.S.) evaluation conducted on February 18, 2004, revealed sewage disposal conditions that are in violation of the Weld County I.S.D.S. Regulations. These conditions must be brought into compliance prior to closing the violation on this property. 2. Should the applicant be required to replace the existing travel trailers with mobile homes, Building Permits will be required. 3. Prior to the occupancy of the mobile home,the mobile home shall be connected to an approved septic system and a legal water supply. 4. The mobile home shall not be occupied until such time that the applicant has complied with Conditions #1, #2, and #3 stated above. 5. The applicant shall submit a statement of an exit plan acknowledging that the temporary permit shall cease to exist at any such time as the mobile home is used for other than the permitted use. Such statement shall include detailed plans for removal of the mobile home upon expiration of the permit,or at such time the permit is not renewed by either the Department of Planning Services or the Board of County Commissioners, the applicant will have 30 days to put the exit plan into place. 6. The mobile home will be occupied by persons principally employed at,or principally engaged in,the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis as follows: evidence shall be submitted by the applicant or property owner by the 2004-2866 PL1467 ZPMH #2401 - RONALD GRABRIAN PAGE 2 first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant is principally employed at,or engaged in,the farming operation on the subject property. The evidence shall consist of tax records, employment agreements, or other documentation as determined suitable by the Department of Planning Services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. 7. The mobile home will not be used as an income source by the applicant for rental to persons who are not principally employed upon the lot. 8. The applicant shall submit documentation to the Department of Planning Services by May 1st of each year describing the status of the accessory farm unit. This permit is temporary and shall terminate once the use ceases to exist, at which time the applicant shall have thirty (30) days to remove the mobile home from the property. 9. All temporary permits for mobile homes shall not be transferable by the applicant and/or owner to any successor;the Zoning Permit shall terminate automatically upon conveyance or lease of the property. The mobile home shall be removed from the property, or a new Zoning Permit shall be applied for and approved. 10. The property is in violation of Chapter 23 of the Weld County Code (VI#0100207). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the Weld County Code. 11. All vehicles located on the property must be operational with current license plates, or be screened from all adjacent properties and public rights-of-way,or be removed from the property. All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. 12. All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 13. Derelict manufactured(mobile)home:a manufactured(mobile)home that is partially or totally damaged by fire,earthquake,wind, or other natural causes,or is in a state of general dilapidation, deterioration, or decay resulting from improper lack of maintenance, vandalism, or infestation with vermin or rodents. Any such derelict manufactured(mobile)home shall be returned to and maintained in the condition as originally established on site and as inspected by the Weld County Department of Building Inspection, or it shall be removed from the site. 2004-2866 PL1467 ZPMH #2401 - RONALD GRABRIAN PAGE 3 14. Any future structures or uses on the site must obtain the appropriate Zoning and Building Permits. 15. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County-Wide Road Impact Program. 16. All construction or improvements occurring in the floodplain as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Map 080266 8064 C,dated September 28, 1982,shall comply with the Flood Hazard Overlay District requirements of Chapter23,Article V, Division 3,of the Weld County Code. 17. The installation of any septic system within the 100-year floodplain shall comply with the Weld County I.S.D.S. Floodplain Policy. In accordance with the State of Colorado I.S.D.S. Regulations, no septic system shall be installed within the floodway. 18. Prior to the release of Building Permits, the applicant shall submit evidence to the Department of Planning Services that the mobile home has an adequate water supply of sufficient quality, quantity, and dependability. 19. Weld County Road 23 is designated on the Weld County Road Classification Plan as a collector status road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. 20. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County Code. 21. The applicant shall maintain compliance with Section 23-4-170 of the Weld County Code at all times. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-4-170 of the Weld County Code, as follows: a. The mobile home will be occupied by persons principally employed at or principally engaged in the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis as follows: evidence shall be submitted by the applicant or property owner on the anniversary of the permit's issuance for review and acceptance by the department of planning services verifying that the mobile home occupant is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records (W-2 forms), employment agreements or other documentation as determined suitable by the department of planning services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. Although the applicant has provided documentation for a person employed, it is unclear as to if the employee is full or part time according to his W-2 form. b. Adequate water and sewage disposal facilities are available to the mobile home. The existing septic for this mobile home is failing and needs to be brought into compliance. c. In addition, the travel trailer does not meet the definition of a mobile home. Therefore, it is Planning Staffs recommendation that these structures be replaced by mobile homes per the definition located in Section 23-1-90. d. Should the Board of County Commissioners approved this request,the Department of Planning Services'staff recommends the following conditions be attached: 1. The ISDS evaluation conducted on February 18,2004,revealed sewage disposal conditions that are in violation of the Weld County ISDS code. These conditions must be brought into compliance prior to closing the violation on this property. 2. We(Jax&myself)re-explained to Mr. Grabrian that once he submitted his septic applications he would need to submit ZPMH applications on the remaining 3 Accessory units(+the one ZPMH we received last Thursday).Again,he claimed that the 1 mobile home was a permanent structure.Again,we explained that he is only allowed 1 permanent structure per parcel. Therefore, he needed to permit both mobile homes and both camper-trailers(per staffs determination). Again, I explained that staff would be recommending denial of the 2 camper-trailers(per staffs determination). We briefly argued about staffs determination of the camper-trailers vs. mobile homes. I then explained that he would have a hard time anyway,because most people are only granted 1 Accessory unit. Personally,I have been in the Real Mobile Home Business for nearly 33 years. Ronald Grabrian from Fort Lupton recently requested for me to come and inspect two units be currently has available for his hired help to reside in. It seems some have thought that they inn recreational vehicles instead of mobile homes. After the inspections,I found that the units,a 1979 model and a 1972 Mobile Villa, are what the mobile home industry terms as"park models." They are designed for permanent living which such proofs were only being designed for city or septic sewers, mobile home sized appliances(not RVs),etc. They could have somewhat of the same appearance of a recreation vehicle because during these years mentioned,the mobile born industries had manufacturers that made both mobile homes and recreational units. A good guide to remember is that recreational vehicles will have either no restruom facilities or when they do, as most do and did these years,they will have holding tanks and will be designed electrically and in other ways to be constantly free for travel. This is not the case with Mr. Grabrian's units as they are designed only to be moved occasionally and for year- round living.
