HomeMy WebLinkAbout840447.tiffRESOLUTION RE: APPROVE CHANGE OF OWNERSHIP REQUEST FOR TAVERN LICENSE, WITH EXTENDED HOURS, FOR JOHN SIPRES, D/B/A SIPRES' LOUNGE - EXPIRES OCTOBER 2, 1985 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, John Sipres, d/b/a Sipres' Lounge, has presented an application for a Change of Ownership for a Tavern License, with extended hours, which license was previously held by Ralph Trujillo, d/b/a Ralph's Bar, and WHEREAS, said license was issued pursuant to Section 12-47- 119.5, CRS, as amended, and the licensee was granted extended hours, pursuant to Section 12-47-128(5)(C)(II), CRS, as amended, for the sale of malt, vinous and spirituous liquors for consump- tion by the drink on the premises only, outside the corporate limits of any town or city in the County of Weld at the location described as follows: 1490 Weld County Road 27, Brighton, Colorado 80601 WHEREAS, pursuant to Weld County Ordinance 6-A, said appli- cant has paid the sum of $250.00 to the County of Weld for the change of ownership of the existing license, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, has found the following with respect to the applicant, pursuant to Sections 12-47-106(4)(C), CRS, as amended, and 12-47- 111, CRS, as amended: 1. The applicant has paid all applicable fees to Weld County and the Colorado Department of Revenue for said license, with extended hours, 2. Pursuant to the provisions of Section 24-4-101, CRS, as amended, the applicant has been found to be of good moral character. Weld County Attorney's Office Box 498 915 10th Street Greeley, Colorado 80632 Dear Mr. Barker: Please be advised I represent the United Spanish American Association who presently has a contract for sale and purchase of property with John and Mary Sipres who have applied for a liquor license. It is my understanding that the processing of that liquor license is being stayed because of a threat of a mechanics lien being filed by Ralph Trujillo. If Mr. Trujillo files a lien against the subject property he will do so unlawfully since more than four (4) months have expired since he furnished any labor in the improvement of the property. There is a dispute between my client and Mr. Trujillo as to the reasonableness of his wages for past work done, but Mr. Trujillo cannot properly file a lien against the property. If he does, in my opinion, he has slandered the title and my client will sue. I don't see how an improper lien being filed by Mr. Trujillo should stay the processing of the liquor license application by the buyer. Even if an improper lien were filed, the sellers can bond around it and close the real estate transaction with the buyers. I would ask that the application of Sipres be processed as soon as possible.
