Dear Property Owner:
On Wednesday, May 26, 2004, at 7:00 p.m., the Board of County Commissioners of Weld County and the Hudson
Board of Trustees will hold a joint meeting to discuss the adoption of a proposed Coordinated Planning Agreement
("the Agreement") between Hudson and Weld County. The meeting will take place at the Hudson Elementary
School Gym, 300 Beech, Hudson, Colorado. The meeting is to allow for informal discussion between the two
Boards about the Agreement. Input from the public will also be heard.
The Agreement is designed to increase planning coordination between Hudson and Weld County regarding growth
in the area of the county adjacent to the town. The Agreement would not automatically annex your property to
Hudson. Instead, it would define an "Urban Growth Area," where urban services, such as public water and sewer,
could be extended to accommodate urban growth. A copy of the map showing the proposed Urban Growth Area is
enclosed. Please note that the Area has been significantly reduced from that which was proposed and reviewed by
the Weld County Planning Commission earlier this year. A copy of the Agreement is also enclosed.
The Weld County Planning Commission is scheduled to consider the Agreement and the reduced Urban Growth
Area map at it regular meeting at 1:30 p.m., on June 15,2004. The Planning Commission meeting will take place at
Weld County's Southwest Administration Building, located at 4209 WCR 241/2, Longmont.
The Board of County Commissioners will then consider the Agreement and reduced map through a three reading
process to amend the Weld County Code. The first reading has not been scheduled yet, but will probably take place
in July or August, 2004, at the Weld Centennial Center, 915 10th Street, Greeley, Colorado. Please visit the Weld
County web site at www.co.weld.co.us to get the exact date and time of the first reading before the Board of
County Commissioners.
You are welcome to attend any or all of these meetings to express your thoughts regarding the Agreement and

SUBJECT:Intergovernmental Agreement for Hudson and Weld County
Since 1994, Weld County has been working with communities in establishing Intergovernmental
Agreements. For your consideration, the Hudson and Weld County agreement has been
prepared. It is the Department of Planning Services recommendation that the above mentioned
Intergovernmental Agreement meets the intent of the Weld County Comprehensive Plan as
follows:

municipality in establishing an intergovernmental urban growth boundary agreement. The
following UGB.Policy 1 states, Weld County recognizes that municipalities can and should plan
their own futures in terms of the nature and rate of growth.
Comprehensive Plan UGB.Policy 1.1. The County recognizes that municipalities can and should
plan their own future in terms of the nature and rate of growth.
Comprehensive Plan UGB.Policy 1.2. Revise intergovernmental agreements as required by
changing conditions.
Comprehensive Plan UGB.Policy 1.3. The County encourages each municipality to plan its future
in coordination with individual landowners in unincorporated Weld County. The individual
landowners of property within the urban growth boundaries shall be notified of any negotiations
and consideration of intergovernmental urban growth boundary agreements.
The Town of Hudson has worked with Weld County in establishing this proposed
Intergovernmental Agreement. Through this agreement, the Town of Hudson has indicated their
interest in planning for responsible growth. The Department of Planning Services has sent out
notification to all property owners in the influence area. This IGA serves as a direct outcome of
a commitment to conserve natural and managed resources while directing growth and enhancing
economic development through efficient use of infrastructure.
2. Comprehensive Plan UGB.Goal 2 suggests concentrating urban development in or adjacent
to existing municipalities, an approved intergovernmental agreement, the 1-25 Mixed Use
Development area, urban growth boundary areas, urban development nodes, or where urban
infrastructure is currently available or reasonably obtainable. UGB.Policy 2.1 indicates Land use
development proposals within an urban growth boundary area will be determined according to the
procedure set forth in Chapters 22 and 23 of this Code.
The Town of Hudson has delineated their Urban Growth Boundary on the attached map. Through
this Intergovernmental Agreement, the Town of Hudson has specified the future growth of their
community. Further, it is noted that Weld County recognizes that it is appropriate for its
municipalities to plan for growth at their current boundaries and in the surrounding areas.
However, based on the magnitude of the boundaries the Department of Planning Services has
concern that municipal services such as public water and sewer may not be readily available to
service urban uses in the proposed boundary.
3. Comprehensive Plan L . oal 3 states that the County and m .cities should coordinate
land use planning in urban growth boundary areas, including development policies and standards,
zoning, street and highway construction, open space, public infrastructure and other matters
affecting efficient development.
Through this Intergovernmental Agreement with the Town of Hudson, these principles will be met.
The county recognizes that an intergovernmental urban growth boundary agreement is by far the
best tool for coordinating development for municipal/county interface. It is further noted that the
County Commissioners imparted the following criteria to guide the municipalities in developing
their urban growth boundaries. These guidelines are the impetus for many communities in
establishing an Intergovernmental Agreement with Weld County (Section 22-2-100)
Efficient and orderly land development and the conservation of agricultural land suggest that
urban-type development take place in or adjacent to existing municipalities or where adequate
infrastructure is currently available or reasonably obtainable. Urban development adjacent to
municipalities is appropriate if urban services can be extended to serve the area.
The intergovernmental urban growth boundary agreement is a tool for coordinating development
at the municipality/County interface. The individual I andowners o f property within the urban
growth boundaries shall be notified of any negotiations and consideration of intergovernmental
urban growth boundary agreements. In the spring of 1994, believing that each community should
direct its growth, the Board of County Commissioners began contacting each municipality to
establish their own tailor-made growth areas. The Board of County Commissioners imparted three
(3) criteria to guide the municipalities:
1. Growth should pay for itself in terms of initial costs, and in the long range, through
good design and functional efficiency.
2. Annexation patterns should directly correlate with municipal service areas.
3. When a municipality and the County enter into an urban growth boundary
agreement, the County agrees to consider the municipality's vision for future
development in the area. Likewise, the municipality agrees to limit its expansion
to the defined areas where it plans to provide municipal services. It is understood
that urban growth is an ongoing process and urban growth boundary agreements
will be subject to revision as needed.
The purpose of this Intergovernmental Agreement between the Town of Hudson and Weld County
is to establish procedures and standards pursuant to which the parties will move toward greater
coordination in the exercise of their land use and related regulatory powers within unincorporated
areas surrounding each municipality. The Town of Hudson exercises governmental authority over
the same matter within its boundaries; including annexations. The premise for this
Intergovernmental Agreement is similar to the agreement for the fourteen previous agreements
this board has approved. Customized modifications include the following:
It is the opinion of the Department of Planning Services staff and at the direction of the County
Attorney that this Intergovernmental Agreement be forwarded to the Planning Commission with
favorable recommendation.
This recommendation is based, in part, upon a review of the application materials submitted by
the applicant, other relevant information regarding the request, and responses from referral
entities. The Department of Planning Services recommends the following condition:
1. The Town of Hudson shall provide evidence that municipal services such as public
water and sewer, are available or can be reasonable obtained or modify the
boundary to be consistent with the area that can be served.

Hi, I wanted to let you know that we have sent one letter and one email to the Town of Hudson asking for
verification that they can provide water and sewer in the new IGA area. To date, we still do not have this
information. Until we get this a recommendation of approval may not be possible. Also, I will be out next
Thursday and Kim will cover the meeting.

Dear Mr. Landeck:
On August 19, 2003 the Weld County Planning Commission continued the Hudson IGA indefinitely. In order to
proceed with the process the Department of Planning Service needs to obtain a copy of the ordinance accepting the
new boundary and the terms of the IGA. Also needed is a map indicating that public services can be provided to the
revised boundary map.
Weld County Department of Planning Services is unable to proceed to the Planning Commission until all the
documentation is received.

I was a little confused on this so I spoke with Wendi to get a clue. I re-listened to the tape and Mike
states the IGA will be continued and the property owners would be notified of the date and time. The
Tire Mountain case was continued to September 2.
I want to make sure I get this right so this does not happen again. Is the correct process that all the
items are continued to the next meeting, irregardless of north or south, then continued to date specific
from there provided there is a quorum?
This is fine with me. I just want to make sure we follow the same written process so I don't get in trouble.

I think there was a miss up on this. What did Lee want on the Church. I think I case should have been
schedule for the next PC hearing for an indefinite continuance. I am not sure that this matters as we are
going to do this all over again, but I want to make sure we are procedurally doing this correctly. Perhaps
something needs to be in writing addressing this situation. Thanks.

A copy of the minutes from August 19 is in your box. There would be no resolution since there was no
quorum for a vote. Also, I have never done an indefinite continuance so I am not sure what you are
needing. It was indicated at the meeting that the land owners would be renotified with a date.
