The sheriffs office recommends the following improvements for this gravel pit
operation:
1. The sheriffs office requests that gravel trucks transporting materials out of the
area on county roads assure that their loads are covered, thus reducing loose
materials on the roadway and the amount of damage to vehicles.
2. The Sheriffs Office also requests that gravel trucks and other vehicles leaving
the site do not bring foreign materials on to the roadways on their tires. This
may be accomplished by paving a short distance prior to entering the public
roadway.
3. The sheriffs office would however be willing to provide a program entitled
Crime Prevention Through Environmental Design to the developer. This
program reduces the likelihood of criminal activity at a specific location by
"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Reference is made to the above-mentioned project located in Section 30, Township 1 North,
Range 66 West,Weld County, Colorado.
If any work associated with this project requires the placement of dredged or fill material, and
any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the
United States at this site, this office should be notified by a proponent of the project for proper
Department of the Army permits or changes in permit requirements pursuant to Section 404 of the Clean
Water Act. Waters of the U.S. includes ephemeral, intermittent and perennial streams, their surface
connected wetlands and adjacent wetlands and certain lakes,ponds, drainage ditches and irrigation
ditches that have a nexus to interstate commerce.
Work in waters of the U.S. should be shown on a map identifying the Quarter Section, Township,
Range and County of the work and the dimensions of work in each area of waters of the U.S.

Pursuant to the State Engineer's August 7, 1995 memorandum to county planning
directors, this office is no longer providing comments on land use actions that do not involve a
subdivision as defined in Section 30-28-101(10)(a), C.R.S. This referral does not appear to
qualify as a"subdivision". However the following comments are provided for your information.
We have reviewed the above referenced proposal to create a gravel mining operation on
a 190-acre parcel.
Based on the submitted information it appears that the Gravel Mining operation will cause
depletions to the South Platte River due to evaporative losses from exposed ground water and
operational losses. A Temporary Substitute Water Supply Plan or court approved
augmentation plan must be obtained to replace the depletions caused by the operation.
Gravel pit operators typically must first obtain approval from the Colorado Division of
Minerals and Geology(DMG) prior to mining. As part of that process the applicant will need to
address the potential concerns of State Engineer's Office as they relate to water rights.

Kim,
The applicant states that they've worked with us on the improvements to WCR 6, and that is true.
However, I was unable to find my copy of the original traffic study. Was the mining operation and the
batch plant both included in the original study? If they were, then I think we're fine. But, if the batch plant
is an addition, I will need new total peak hour counts. We'll want to make sure that the storage length is
long enough. The signal will help, but if we ever have to go to a protected left, then we'll want to make
sure that we have ample room for storage.

Amendment to a Site Specific Development Plan and Special Review Permit for Mineral
Resource Development Facilities; including open pit mining and materials processing; including
a Concrete and Asphalt Batch Plant and a Concrete & Asphalt recycling Plant in the A
(Agricultural) Zone District.

1. A building permit shall be obtained prior to the addition of the concrete and asphalt batch
plants and the Concrete and Asphalt Recycling Plant. A plot plan shall be submitted when
applying for building permits showing all structures with accurate distances between structures,
and from structures to all property lines.
2. A plan review is required for each building for which a building permit is required. Plans
shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of
plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Building wall and opening protection and limitations shall be in accordance with UBC Table
5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with
UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by the Zoning
Ordinance.

6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
7. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain whether the buildings are existing or new.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
preview of the Use by Special Review Standards, Weld County Code Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 6 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance,
Section 20-1-30, as a collector status road, which requires an 80-foot right-of-way at full build out. There is
presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of
SETBACK in the weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback measured
from the future right-of-way line.

The three gravel pits operating in this vicinity are Camas (which is owned by Aggregates, Asphalt Paving, and
Mobil Premix). In 2000, the three operators combined and provided the County with an updated traffic study
for improvements to the intersection of US Highway 85 and WCR 6. Through that traffic study, a right turn lane
(free right) on to the acceleration lane and the light was installed at this location to accommodate gravel,
asphalt, and material hauling from this location.
REQUIREMENTS:
Access: The applicant shall utilize the existing access point to the facility from WCR 6.
The amended USR is identifying the south portion of the property to border (WCR 4) a section line with no
maintained county road at this location. In researching the County records, there is a 60-foot right-of-way
available west of US Highway 85 to the South Platte River on the section line. If the applicant proposed to
utilize this section line access, two items must be addressed:
1. A Nonexclusive Right-of-Way Agreement to utilize County right-of-way if available with
additional requirements to accommodate heavy hauling.
2. Verification from CDOT for an additional access, to verify the access permit, or for any
additional requirements that may be necessary for an upgrade of the access permit off
of US Highway 85.
Improvements Agreement: There is an existing Road Maintenance Agreement with C & M Companies a.k.a.
--Aggregate Industries for this location (WCR 6) which stays with the USR plan use. All conditions
ocompanying this Road Maintenance Agreement are still in affect.

Future Right-of-Way: The applicant shall reserve an additional 10 feet of property that is parallel to WCR 6
right-of-way for future build out.
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any
additional requirements that may be needed to obtain or upgrade the permit on existing or proposed accesses
to US Highway 85 that is parallel to the property.
Section Line Access and Right-of-Way: The applicant has identified a 25-foot minimum setback from the
section line where WCR 4 could possibly be. As I indicated above, the County has a 60-foot right-of-way, 30
feet on either side of the section line identified at this location. The set back is measured from the existing or
future right-of-way line. Adjust your 25-foot minimum setback from the right-of-way line, not the section line.

Environmental Health Services has reviewed this proposal to amend an existing gravel
mining operation. This proposed amendment area is located in the 1-2 and 1-3 zone
districts and will extend the mining operation an additional 1-2 years. Processing
equipment exists at the site currently.
Among the Development Standards included in USR-905 was a stipulation that a septic
system is required for the proposed office. The Department finds a septic permit
(SP-0000429) for the office was applied for. However, the permit was never issued or
given final approval. This Department requires that this permit be closed as a part of
this amended application. If the system was installed, it may require an I.S.D.S.
Evaluation by a registered professional engineer if the employee usage has increased.
In the event the system is found to be inadequate, the system must be brought into
compliance with I.S.D.S. regulations. Portable toilets are acceptable on the working
face of the site for up to 6 months at a time.
In the original USR application, there was no provision in the Development Standards
for providing water for employees at the site. The application states that bottled water
is provided for drinking water uses. This is acceptable if the site duration is extended
for 1 to 2 years (a relatively temporary use). However, the Department is aware of
USR-1350 and the intent to process mined materials from that site to this one. In the
event this is approved (pending proposed code change outcome) the life of this site
could be extended significantly. In that case, the Department feels that the site should
provide a permanent water supply, (i.e. well, community system, etc) to serve the
sanitary needs of the staff and visitors of the facility.
Therefore, the Department recommends that the following requirements be met prior to
allowing the plat to be recorded:
1. Submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions
Permit from the Air Pollution Control Division, Colorado Department of Health
and Environment, if applicable.
2. Submit evidence of an approved dust abatement plan from the Environmental
Health Services, Weld County Department of Public Health & Environment.

3. Submit evidence of a CPDS Permit from the Water Quality Control Division of
the Colorado Department of Health for any proposed discharge into State
Waterways, if applicable.
4. Submit evidence of an approved waste handling plan, from the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
5. Submit evidence of an Underground Injection Control (UIC) Class V Injection Well
permit from the Environmental Protection Agency (EPA) for any vehicle
maintenance facility located on the site that is equipped with a floor drain.
Alternately, the applicant can provide evidence from the EPA that they are not
subject to the EPA Class V requirements. (New EPA rule effective 4/5/2000).
6. Submit evidence that septic permit (SP-0000429) has been closed. If the system
was installed, it may require an I.S.D.S. Evaluation by a registered professional
engineer if the employee usage has increased. In the event the system is found to
be inadequate, the system must be brought into compliance with I.S.D.S.
regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Fugitive dust shall be controlled on this site. The facility shall be operated in
accordance with the approved dust abatement plan at all times.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a

solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance conditions.
5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7CCR 1101-14).
6. This facility shall adhere to the maximum permissible noise levels allowed in
the Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
8. All potentially hazardous chemicals must be stored and handled in a safe
manner in accordance with product labeling and in a manner that minimized
the release hazardous air pollutants (HAP'S) and volatile organic compounds
(VOC'S).
9. The applicant shall operate in accordance with the approved "waste handling
plan".
10. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11. In the event washing of vehicle will occur on site, the applicant shall ensure
that any vehicle washing area(s) shall capture all effluent and prevent
discharges from the washing of vehicles in accordance with the Weld County
Code, the Rules and Regulations of the Water Quality Control Commission,
and the Environmental Protection Agency.
12. Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to Individual Sewage Disposal Systems.
13. Adequate toilet and handwashing facilities shall be provided for employees
and patrons of the facility.
14. Portable toilets may be utilized on sites which are temporary locations of the
working face and portable processing equipment, etc., for up to six months at
each location.

15. The facility shall provide a permanent, adequate water supply for drinking and
sanitary purposes if mining resources from USR-1350 are processed on this
site (significantly extending the life of the site). Bottled water is acceptable for
the extended mining of this site due to the inclusion of 1-2 and 1-3 property
only.
16. The operation shall comply with the Occupational Safety and Health Act
(OSHA).
17. The site shall comply with the Mine Safety and Health Act (MSHA)
18. The operation shall comply with all applicable rules and regulations of the
Colorado Division of Minerals and Geology.

The following comments are made to the above noted plan review. The Uniform Fire Code, 1997 Edition,
governs these comments and resulting requirements and other codes or standards referenced within the Fire
Codes, as adopted by the City Council of Brighton.
General Comments:
1. Portable fire extinguishers shall be a minimum of 2A40BC and mounted 3 to 5 feet from the floor.
Traveling distance shall not exceed 75 feet between each extinguisher.
2. Plans for the onsite storage/dispensing systems for vehicle/equipment refueling operations shall
be submitted to the Fire District for approval.
3. The access road into the facility shall be a minimum of 36 feet in width. Access road shall be
constructed of all weather construction capable of handling Fire department apparatus.
4. Due to the lack of adequate water supply in this area,the Fire District is requiring onsite storage of
firefighting water supply. This issue will be addressed when building plans are made available to
the Fire District for review and approval. Please have the applicant contact the Fire District to
discuss this issue further.
5. As no building plans or construction drawings have yet been submitted to the Fire District for
review,the need for any automatic fire detection/suppression systems cannot be determined at this
time.The need for any such systems will be addressed when plans are submitted to the Fire
District.

Dear Mr. Ogle:
Thank you for the opportunity to review the expansion to mining operations proposed by
Aggregate Industries at the southwest corner of Weld County Road 6 and US Highway
85. The Fort Lupton Planning Commission met on October 14, 2003 and discussed the
application. As a result of the Commission's review, we offer the following comments
and concerns:
1. Weld County Road 6 is a signalized intersection with US Highway 85. This
condition, by default gives WCR 6 status as a future arterial. A minimum of 100-
120 feet of right-of-way should be dedicated to the County for future construction
of the roadway to arterial standards.
2. It is recommended that no mining be allowed on "Cell 4"which acts as a buffer
between the existing mining operations and Highway 85.
3. If mining occurs within cell 4, it is recommended that the overburden piles be
located away from Highway 85; or, the overburden piles could be used to create a
sculptured landscape berm. The berm may not hide operations; however, if done
properly could be an attractive amenity for the Highway 85 corridor in the future.
4. It is recommended that the concrete batch plant operations cease when mining
operations cease, or the site will continue to include large unsightly piles of
recycled concrete and asphalt.

5. The City does not support the use of the site for future industrial. The site is long,
narrow, has poor access and is in or near the floodplain. The City would prefer a
plan that reclaims the site for agricultural purposes, wetlands or water storage.
6. The US Highway 85 Access Plan, which was adopted by Intergovernmental
Agreement, shows a future interchange at Weld County Road 6 US Highway 85.
It is likely that this interchange would occupy much of the property where the
Batch Plant is located. It is recommended that the County place a condition upon
the Special Use that would terminate the use at the time the interchange is
constructed.
