RESOLUTION RE : DECLARATION OF OPPOSITION TO THE DESIGNATION OF THE CACHE LA POUDRE RIVER AS A FEDERALLY PROTECTED WILD AND SCENIC AREA WHEREAS, the Board of County Commissioners of Weld County, Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the 98th Congress has under consideration a proposal to declare that the Cache La Poudre River in Colorado be designated as a federally protected wild and scenic area and pursuant to the Wild and Scenic Rivers Act, and WHEREAS, if said designation is declared by Congress , the result would be the inability to construct flood control projects and irrigation projects on the Cache La Poudre River, all to the great detriment of the present and future citizens of Weld County, Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado , that Weld County declares its opposition to the inclusion of the Cache La Poudre River within the Wild and Scenic Rivers Act as a federally protected wild and scenic area and further declares that their opposition shall be communicated to all appropriate officials and agencies of the United States Government. If in fact you are interested in this Soil Conservation Service project, I would suggest that you write a letter to Mr. Hammon requesting his office consider re-opening the flood abatement study of the Coal and Rock Creeks. We will keep you informed of any further progress in the matter. Please notify any other residents in your area who may also be concerned about this matter; I have already contacted Sam Little, Russell Reese, and Victor Stertz. Iiamon : Persuant to our telephone conversation on March 21 , 1978 , I am requesting that your office consider reopening a study concerning flood abatement on Coal and Rock Creeks , particularly in the area of Erie . You indicated the Soil Conservation Service had started this study some ten (10 ) years ago and a lack of sponsorship from area governments and special interest groups caused the project to be dropped . The Mid County Commissioners , Town Board of Erie , and residents of this area are very concerned over this major problem . I am certain Boulder County and the Towns of Superior , Louisville , and Layfayette are just as interested . The contract for placing the aerial markers and flying the aerial survey has been let, and technicians from this office have been measuring bridges, taking cross sections and locating bench marks, and the actual survey will begin August 5th. We will be using a new electronic distance measuring device in this survey, which might be of interest to you and the other commissioners, and once we get it into operation, I will keep you informed of its location as the survey progresses in case you would like to observe it. Wally Toevs Boulder County .269Cf FLOOD PLAIN AND FLOODWAY DELINEATION ON ROCK CREEK AND COAL CREEK THIS AGREEMENT, made this .3o day of /1iV y between the URBAN DRAINAGE AND FLOOD CONTROL DISTRICT (hereinafter • called "DISTRICT"); BOULDER COUNTY (hereinafter called "BOULDER"); WELD COUNTY (hereinafter called "WELD"); and the COAL' CREEK WATER USERS ASSOCIATION (hereinafter called "ASSOCIATION"); WITNESSETH THAT: WHEREAS, DISTRICT has previously established a Work Program for 1974 (Resolution No. 20, Series of 1973) and desired to delineate flood hazard areas; and WHEREAS, DISTRICT, in a policy statement previously adopted (Resolution No. 14 , Series of 1970) , expressed an intent to assist public bodies which have heretofore enacted flood plain zoning measures; and WHEREAS, DISTRICT has heretofore instituted an Urban Systems Engineering Demonstration Program (Resolution No. 19 , Series of 1970) , to identify drainage basins and sub-basins and the drainage problems connected therewith within the District; and WHEREAS, the U.S. Soil Conservation Service through the Colorado Water Conservation Board has agreed to provide a flood plain information study of Coal Creek and Rock Creek, and WHEREAS, the Department of Natural Resources , Colorado Water Conservation Board acting on behalf of the State of Colorado has agreed to contribute a sum not to exceed Six Thousand Five Hundred ($6,500.00) Dollars or Fifty Percent (50%) of the sponsor's cost for the Coal Creek and Rock Creek flood plain studies, whichever is less, and WHEREAS, DISTRICT, BOULDER, WELD and ASSOCIATION have agreed to provide the remaining portion of the sponsor's cost; - 2 - NOW, THEREFORE, in consideration of the mutual promises herein contained, the Parties hereto agree as follows: 1. DISTRICT agrees to function as clearinghouse for all sponsor contributions; 2. DISTRICT agrees to provide aerial photographs and targets for the study area in accordance with Soil Conservation Service speci- • fications; 3 .
