Home My WebLink About20040330.tiff 1� RESOLUTION RE: REVOCATION OF CHANGE OF ZONE #545 - HARVEY AND JEAN MARKHAM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated August 9, 2000, the Board did approve Change of Zone #545 from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for Harvey and Jean Markham on the following described real estate, to-wit: Part of the N1/2 NE1/4 of Section 19, Township 4 North, Range 68 West of the 6th P.M.,Weld County, Colorado WHEREAS, the Board has received a request from Harvey and Jean Markham, 650 Highway 56, Berthoud, Colorado 80513, to revoke said Change of Zone #545, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said revocation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Change of Zone #545 be, and hereby is, revoked. BE IT FURTHER RESOLVED that pursuant to Section 27-8-50 of the Weld County Code, the Board of County Commissioners hereby orders the recorded PUD(Planned Unit Development) Zone District be and hereby is reverted to the original zone district, A (Agricultural). BE IT FURTHER RESOLVED that the Department of Planning Services staff be, and hereby is, directed to amend the Official Zoning Map of Weld County to reflect the above stated action. St. Greeley, Colorado Subject: PUD Application Revision/Restart Dear Sir, Per our discussion approximatly two weeks ago, I am volountarily electing not to submit the Final Plan for the Markham PUD (Change of Zone#545 ) and ask that section 27-8-50 of the Planned Unit Development codes be invoked. Items uncovered during preparation of the Final Plan necessitate significant changes to the plan to include (a) boundary alteration, (b) five lots as opposed to four, and (c) reloc- ation and arrangement of the open space requiring major changes to the landscape plan. Per our discussion you indicated I would need to start all over at the sketch plan. Given that the road and infrasture remain the same and simply the lot lines and open space are rearranged, it would seem to merit one last review before this decision is finalized. Please review the rules and let me know if some expedited method might be at hand. Thanks for your assistance. H.
