Re: Recorded Exemption #619
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Gary and Susan Alles for a Recorded Exemption. The parcel of land on
which this request is being made is described as the South 1/2, Northeast
1/4, Section 23, Township 5 North, Range 65 West of the 6th P.M. , Weld County,
Colorado.
The property is located approximately three (3) miles Southeast of Greeley on
Weld County Road 47. The property contains approximately 80 acres of Class I,
IIs, Ile (Prime) irrigated soils.
The request is to divide the property into parcels of 78 acres and 1.5 acres,
more or less. It is the intent of the applicant to sell the smaller parcel,
and keep the larger parcel in agricultural production.
Based upon the submitted information and policies of the County, the Department
of Planning Services staff recommends the request be approved for the following
reasons:
1. The request complies with Section 9-2 C. of the Weld
County Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:
830879
Board of County Commissioners
Page 2
June 6, 1983
- The 80 acres, more or less, under consideration will
allow uses which are consistent with the intent clause
of the Agricultural Zone District. The uses will be
compatible with existing surrounding uses.
- The proposal is in compliance with Section 1-3 of the
Weld County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan;
therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The Central Weld County Water District has indicated adequate
water service is available for this proposal.
- The proposed lots are not part of a recorded exemption within
the last five (5) years.
- The two lots proposed will have adequate access from Weld
County Road 45-1/2 and Weld County Road 47.
- The Weld County Health Department has indicated, in a letter
dated May 13, 1983, that both lots will have adequate sewage
capacity.
The Department of Planning Services staff recommendation for approval is
conditional upon the applicant submitting a mylar plat to the Department of
Planning Services' office to be recorded in the office of the Clerk and Recorder.
The plat shall be drawn in accordance with the requirements of Section 9-2C. (4)
of the Weld County Subdivision Regulations. The plat shall be submitted
within ninety (90) days from the date of approval by the Board.

To; Board of County Commissioners,
( Request for recorded exemption. )
(1) The purpose for this request is to separate the lr acres
(more or less) tract from the remaining 79 acres, so the small
tr-ct nay be sold.
(2) The small tract has an older wooden frame, throe bedroom home,
three snail sheds, and a small horse corral. At the present tine
we are renting this house out.
(3) As we are presently renting this house, there e would not be
an increase in the number of hones in the area; i:herefore the
approval of t;ds request is consistent:, with the comprehensive plan.
We do not contemplate any construction on the remaining acreage as
our farni-nz headquarters are 1 ni) e south of this site.
(4) T '.is exemption request is consistent with the intent of the
district -s it :rill. not chan"e the agriculture character of the
area.
(a) Use of the tract oul'.. be t:',e same as any other agriculture
residence.
(6) Existing zone is agriculture, •i:1::; s; i in compliance.
(7) This proposal will not change 'the character of the neighborhood,
end certainly will not interfer 7!ith the orderly deveiopme:^t of
the area should th.'.s occur in future years.
Site has a Central. Weld Water tap, domestic well. but not
operational e.t ;present tine; and a. snail well for ca.<<tle or horses.
(9) The entrance to -t'iis tract is from Weld County Ind. 47.
(10) Proposed o;te is not in an overlay district.
(11_) Cony of deed is attached.
(12) One final consideration is that we would lie to transfer
responsibility for upkeep on the Douse to -the owners (rather
than letting renters tear it up) ; and it would certainly
ups. r ade our financial situation, and in turn the well being
of the county also.
Thank you for consideration of the mater,
