RE: APPROVAL OF RECORDED EXEMPTION NO. 677 - NICK J. SEKICH
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels ,
as shown on the plat known as Recorded Exemption No. 677 , does
not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 677 was sub-
mitted by Nick J. Sekich for property being located in Part of
the East 1/2 , Section 14 , Township 3 North, Range 68 West of the
6th P.M. , Weld County, Colorado, being more particularly des-
cribed in the plat which shall be provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into par-
cels of 50 acres and 26. 01 acres, more or less, utilizing both
parcels as small farms .
NOW, THEREFORE , BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove des-
cribed parcel of land be, and hereby is, exempt from the definition
of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office
of the Weld County Clerk and Recorder . The plat shall be drawn
in accordance with the requirements of Section 9-2C . (4) of the

Weld County Subdivision Regulations . The plat shall be submitted
within ninety days from the date of approval by the Board of
County Commissioners.
The above and foregoing Resolution was, on motion duly made

Re: Recorded Exemption #677
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Nick Sekich for a recorded exemption. The parcel of land on which this
request is being made is described as Pt. Eh, Section 14, T3N, R68W of the 6th
P.M. , Weld County, Colorado.
The property is located 2 miles East of Mead on WCR 34. The property contains
approximately 76.01 acres of Class IIe (prime) , IIIe (prime) irrigated and
IIIc, IVe nonirrigated soils. The parcel of land under consideration is the
total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 50 acres and 26.01
acres, more or less. Both the fifty (50) acre and twenty-six (26) acre parcel
are proposed to be used as small farms.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
The 76.01 acres, more or less, under consideration will
be compatible with the existing surrounding land uses and
with future development of the surrounding area as
permitted by the existing Agricultural Zoning. The
proposal is also consistent with the intent of the "A"
Agricultural zone district. The Town of Mead has
indicated they have no objections to this request.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land.
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from WCR
34.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall he drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.

Dear Board Members:
The reason we are asking for a recorded exemption its to divide a 76 irri—
gated acres of land into 2 Parcels one will be 50 acres the other 26 acres.
The 76 acres is zoned agricultural and our full intent is for the land not
only to remain agricultural but to extend it to the fullest use of the land.
For the last few years this 76 acres has been used for producing a hay
crop no special care was taken to highly improve the quality or quanity.
It is just a small parcel of land to the present owners compared to thier
other parcels.
The purchases of the 50 acres are planning on using the land to its full
use. They will be working to improve the crops & to raise a few head of
stock. They plan to hire a contract farmer to put in the crops. Mr.
Graziano plans to put up new fences, a new home and barn.
Mr. & Mrs. Graziano would of liked to have purchased the whole 76 acres
but with the cost of land in Colorado & throughout the U.S. has exceeded
what the land can produce in income. The only way a small farmer can
possibly get into farming is to have another income. I might add that
Mrs. Graziano is from a farming family.
Being from Iowa myself and having owned a farm one of the major concerns
concerns today is that the small farmer is becoming extinct. The family or
small farmers are being pushed out by large corporations and conglomerates.
The remaining 26 acres will be sold to be used as a small acreage also.

(1) The land is zoned agricultural & will remain so.
(2) The surrounding area is a farm community, some large but several
smaller farms.
(3) Both Parcels will have ample road frontage. The 50 acre Parcel
will have appoximately 1000 foot road frontage on Weld Co. Road,
Number 34 & the 26. acres will have about 580 foot road frontage
on Weld Co. Road #34. This Parcel of land is about 1 mile East of
I-25. The road surface is gravel for about 3/4 miles then turns
to black top just before you can inter 1-25. There is a I-25 exit
and entrance on Weld Co. Road #34.
(4) We have a Water Tap Permit for the 50 acre Parcel. The water line
is on Weld Co. Road #34. The other 26. acre Parcel will need to
put in a well. In talking with Rich Bell with the State Engi—
eering Office, there should be water at 100 ft. The purchaser also
could put in a larger water line but for one home, this is cost
prohibited.

Dear Board members :
We presently own a five acre parcel of land in Adams county,
on which we have our house and a horse barn. The barn
facilities have become insufficient for our needs since we
now have a stallion and several mares. Our desire to move
was stimulated by the realization that it would be too
difficult to modify these facilities to provide an adequate
arangement. -
The Sekich property provides us with an opportunity to plan
adequate facilities and more importantly, raise our own hay.
We plan on using approximately one acre for the house, barn,
training arena and associated drives, etc. The remainder of
the property will be cultivated for hay production. To this
end, we have discussed the proposal with Mr . Sekich and he
has put us in touch with a contract hay grower. We do not
have the equipment necessary to farm the land and to
purchase this equipment is uneconomical . The land can be
farmed by a contract farmer on a crop sharing basis, which
would provide adequate hay for our needs and a reasonable
profit for the contract farmer.
The acreage is presently being tilled for reseeding. We
plan to plant a crop of small grains, followed by a fall
seeding of hay. This will give the acreage the needed crop
rotation before again planting hay. We also plan to have
the soil conservation department survey the land—so that we
can make any necessary improvements in the acreage to
increase production and wisely manage the soil .
In this fashion, we believe that we can maintain the
agricultural nature of this land yet also provide us with
the necessary facilities . We feel that this arrangement
would be beneficial to the county and the surrounding
landowners.
