LandProfessionals have submitted the attached e-mail dated August 27, 2004 from Molly
Sommerville with Krug & Sobel, LLC. The applicant has addressed 1.A of the staff comments
regarding an agreement with the properties mineral owners that was required to be completed
prior to scheduling the Board of County Commissioners hearing.

Dear Laurel:
I am in receipt of faxed signature pages signed by representives for EnCana Energy Resources Inc. ("EnCana") and
Highlands Acquistion Group, LLC ("Highland")for a surface use agreement to be entered into among EnCana, Highland
and Anadarko E&P Company LP and Anadarko Land Corp. (together the "Anadarko Entities")for the property referenced
above in Weld County ("Property").
As you are aware, this law firm represents the Anadarko entities with respect to applications for development that Highland
has filed or intends to file with Weld County that apply to the Property.
In light of the agreement reached among the parties and my receipt on behalf of the Anadarko Entities of the faxed
signature pages for the surface use agreement signed by Robert M. Bulthaup on behalf of Highland, the Anadarko Entities
have no objection to Highland setting the matter for hearing in Weld County.
