HomeMy WebLinkAbout820626.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 545 - WESLEY AND JACKIE BROWN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 545, being the property of Wesley and Jackie Brown, described as part of the NW4, Section 19, T6N, R64W of the 6th P.M. , Weld County, Colorado, being more particu- larly described in Exhibit "A" , attached hereto and incorporated herein by reference, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the hereinabove described parcel of land owned by Wesley and Jackie Brown be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) prior to obtaining a building permit for a new residence the applicants must secure a septic permit from the Weld County Health Department; 2) the applicants must agree to an additional thirty (30) foot reservation south of the centerline in order to achieve the sixty (60) foot width south of the centerline. The reservation should be recorded on the plat; and 3) provision should be made for both parcels to be served by one access, the access should be recorded on the plat as requested by the Division of Highways . 820626 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 21st day of April, A.D. , 1982 . The parcel of land on which this request is being made is described as part of the NWT Section 19, T6N, R64W. The property is located bur (4) miles northeast of Greeley on Highway 392. The property contains approximately forty (40) acres of Class IIE irrigated and IVE non-irrigated soils. The request is to split the property into parcels of thirty (30) acres and ten (10) acres, more or less. The applicant wishes to sell ten (10) acres to his son who is involved in the mule raising operation. The applicant will continue to live on the thirty acre tract. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1 . The request complies with section 9-2C of the Weld County Subdivision Regulations submission requirements. 2. The request complies with section 9-2E of the Subdivision Regulations as follows. - The forty (40) acres, more or less, under consideration will allow agricultural and related uses to be the pre- dominant uses. The uses will be compatible with existing surrounding agricultural uses. The forty acre lot has not been used for farming for many years, 1, Wesley A. Brown, bought the land in January 1969, and at that time it was not being farmed. Apparently the land is unsuitable for crop production. Conse- quently, all the determinations of the Board of County Commissioners can be met, First, the intent of the district seems to be mixed. (See attached map taken from tax assesor ' s maps ) There are five lots to the east of the �-rooerty which seem to be primarily residences, very little agricultural :r ranching activity seems to be going on . The lot immediately to the east of ay property has horses and raises hay. Across the road, - ig'hway 392, to the north is a recent structure, a horse training facility and residence. West of the proposed site a lot of al roximately 20 acres w' ere horses are kept and some hay is grown , and a 3o acre lot which 1.n farmed, Since I have been raising mules and my son-in-law who will own the new lot is also interested in raising mules , this seems to be consistent with the intent of the district. The use, then, of the lots for a residence and the purpose of grazing mules, mares , and a jack seems to he compatible with the existing land uses in the area° Also, these uses would be com7'atible ith the future develop- ment of the surroundin: area. Assuming th t the future develop- ment , ill be agricultural and ranching, the uses are consIsten t 2 with the county plens for the future. Concernin_ the flood plain, we will co{rply with any zoning ordinances and District regulations regarding the ele— vation of the residence. We would not want to build a house that would be damaged by floods, so we would want to build the house hiAh enough to keep this from haepening. The size of the proposed lot is ten acres ( or it could be twenty or pore if necessary) which is more than enough to meet t: e minimum requirement of a one cre lot. This proposal seems to be ' in compliance with the Weld County Comprehensive Plan . The request to divide the forty acre lot is being made to provide my daughter and her husband a place to build a residence and continue to raise mules. (They live with me at th.e present time, end he has been helping me to train these animals ) Only one residence is ever intended. No further division of the property is intended or desired. These intended uses, therefore, seem to comply with the Plan of the County. Since we i �tend only one division and no further development, and since the lot is as large or larger than surrounding lots , it seems to be consistent with efficient and orderly development of the area. The acdessibility is on problem. HiGhway 392 is contiguous on the north end for one eighth of a mile. Also, the Yorth Weld County Water District line is on the north endof the property so water sup •ly should be no eroblem. A septic tank and leech lines will be constructed which will exceed the Weld County Health Department requirements X so twat there will be no '_ roblems with sewage and drains. I have owned the lot since 1969 and have not divided it previously, so it is not part of a recorded exemption or sub- division. The proposed use of the land does not evade section 1 -3 of the Weld County Subdivision Regulations. There is no intent to evade any of tie requirements, now or in the future. Since all the intents and regulations of the Eoard of Counter Commissioners will be observed, the health, safety, and welfare of the inhabitants of the neighborhood and county will not be endpnsered. Projected traffic on State Highway 392 indicates the need for a total 120-foot right of way, 60 feet each side of the highway centerline. The existing right-of-way width is only 60 feet, 30. feet each side of the centerline. Therefore, we ask that an additional 30 feet be reserved or, preferably, dedicated in order to achieve the 60-foot width south of the centerline. 2. Access to this property is currently provided by a private driveway to the existing residence. Based upon the State Highway Access Code, this property is entitled to only one means of access. If this exemption is approved, provision should be made for serving both of the new parcels through one access. The existing driveway can be relocated in order to serve these parcels; however, this will require the issuance of a Permit for Access.
