• • RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #3720 - CLAIR AND DEBORAH ORR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land,to be divided into two parcels, as shown on the plat known as Recorded Exemption #3720, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for Recorded Exemption #3720 was submitted by Clair and Deborah Orr,800 8th Avenue#321,Greeley,Colorado 80631,for property which is located in part on the following described real estate, to-wit: Lot B of Fourth Amended Recorded Exemption #1274; being part of the S1/2 of Section 4, Township 4 North, Range 64 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS,this request is to divide the property into parcels estimated to be approximately 95 acres and 5 acres, and WHEREAS,the Board finds that the requirements of Section 24-8-40. M.are met regardless of three amendments to the exterior boundaries of Lot B of RE#1274 since June, 1993, because such amendments did not create additional lots out of the original configuration of said Lot B. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the hereinabove described parcel of land be,and hereby is,exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Recorded Exemption#3720 by Clair and Deborah Orr is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 1053-04-3 RE-3720. 2004-0354 RE3720 p APP RE #3720 - CLAIR AND DEBORAH ORR PAGE 2 B. In accordance with Chapter8,Article II,of the Weld County Code, Lot Ashall be granted one residential/agricultural access. Direct access from a public road shall be limited to one access per legal parcel for residential use, no circle drives or additional accesses shall be granted. The road shall be graded and drained to provide all-weather access. Accesses shall be placed in such a location as to have adequate sight distance in both directions,and shall not be placed below the crest of a hill or where physical obstructions are present. C. Lot B shall use the existing residential/agricultural/oil and gas/ditch road access points necessary for agricultural operations as no additional accesses shall be granted. D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert, please contact the Weld County Department of Public Works to adequately size the culvert. E. Weld County Road 48 is designated on the Road Capital Improvement Plan in the County-Wide Road Impact Fee Code Ordinance,Section 20-1-30,as a local gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 48 shall be delineated right-of-way on the plat. This road is maintained by Weld County. F. Weld County Road 53 is designated on the Road Capital Improvement Plan in the County-Wide Road Impact Fee Code Ordinance,Section 20-1-30,as a collector status road,which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 40 feet from the centerline of Weld County Road 53 shall be delineated on the plat as right-of-way reservation for future expansion of Weld County Road 53. This road is maintained by Weld County. G. The West Greeley Soil Conservation District has provided information regarding the soils on the site. The applicant shall review the information and use it to positively manage on-site soils. H. The applicant shall address the requirements of Weld County School District RE-7 as stated in the referral response dated December 3,2003. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. 2004-0354 RE3720 RE #3720 - CLAIR AND DEBORAH ORR PAGE 3 The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. J. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code,the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, H, I, M, and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of the Section 23-3-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate Zoning and Building Permits. 3) Prior to the release of Building Permits,the applicant shall submit a recorded deed describing the lot upon which the Building Permit is requested with the Building Permit applications. The legal description on such deed shall include the lot designation and Recorded Exemption number. 4) Prior to the release of Building Permits, the applicant shall submit evidence to the Department of Planning Services that Lot A has an adequate water supply of sufficient quality, quantity, and dependability. 5) Prior to the release of Building Permits for any structure exceeding 3,600 square feet,the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code. 6) Should noxious weeds exist on the property,or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 7) Effective January 1,2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County-Wide Road Impact Fee Program. 8) Weld County's Right To Farm statement, as it appears in the Weld County Code, Appendix 22-E, shall be placed on the Plat. 2004-0354 RE3720 RE #3720 - CLAIR AND DEBORAH ORR PAGE 4 3. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. 4. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. Section 24-8-40.M-The proposed recorded exemption is not pad of a recorded exemption or subdivision exemption which was done in conjunction with a recorded exemption approved within the last ten (10)years unless the original exemptions had an application pending as of October 25, 1995. This provision shall not apply in any Commercial or Industrial Zone District. The subject Recorded Exemption has gone through four amendments. In accordance to Section 24-8-110 of the Weld County Code the amendments recorded on January 3,2001 and March 17, 2003 did change the time provision in that an exterior boundary of the Recorded Exemption was affected. Mr. and Mrs. Orr are not eligible to apply for this Recorded Exemption until March 17, 2013. The 2001 and 2003 Amendments affected two exterior lots created prior to zoning.These lots,which were less than 80 acres, were required to do lot line adjustments utilizing the Subdivision Exemption process to retain their legal/buildable status.This procedure is not done in conjunction with Recorded Exemptions. It is only by chance that the lot line changes proposed affect both a Recorded Exemption lot and a lot less than 80 acres thus requiring both processes. The Code describes four types of Subdivision Exemptions: 1) In conjunction with a Recorded Exemption to separate one additional existing habitable residence 2) For the adjustment of property lines between two (2) contiguous parcels 3) For the creation of lots for the purpose of financing 4) For the temporary use of a parcel for public utility facilities 2004-0354 Subdivision Exemptions for lot adjustments are not exempt from affecting e time provision. Section 24-8-100, which describes boundary changes which are exempt, states, "Where a boundary change results in a change of acreage between Lot A, Lot B, Lot C or the SE Lot done in conjunction, thereby not creating an additional building site or changing the exterior boundary of the original Recorded exemption or Recorded Exemption, Subdivision Exemption combination." Should the Board of County Commissioners approve this request, the Department of Planning Services' staff -- recommends the following conditions be attached: - __ - 1. (Ordinance 2002-11) 8) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States,ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts,including noise from tractors and equipment;slow-moving farm vehicles on rural roads;dust from animal pens,field work,harvest,and gravel roads;odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply b oved out of the way of residential develop ent without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)with more than 3,700 miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. Our comments and requirements are as follows: COMMENTS: WCR 53 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance, Section 20-1-30 as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback measured from the future right-of-way line. WCR 48 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance, Section 20-1-30 as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This is maintained by Weld County. Coo elation with Local Governments Encoura ed. The ability of the District to provide adcquatc educational opportunities for its student Liit upon, among other matters, the availability of adequate land,or in he alternative atin is theavailability of funds to purchase adequate land. Since the approval of residential land development applications by local governments with territory within the boundaries of 'the District substantially impacts the District's ability to meet its obligations to the public, the District shall encourage and request that such local government entities refer to the District all residential land development applications for review and comments concerning the adequacy of public school sites and facilities. Further,the District shall encourage and request that such local government entities consider the District's: comments in conjunction with the review and processing of each individual residential development application,and cooperate with the District in regard to the rn ligation measures established in this Resolution. The District shall promptly review the referred development application and promptly submit its comments recommendations and requests consistent with the policy set forth in this Resolution,to the appropriate local government. 2. Land Dedicmion Re In connection with any application for residential land development to any local government pending territory new the boundaries of the District, the District shall recommend and request that the following land dedication standards be imposed by such local government as a condition of development approval,except to the extent that the District through its Superintendent or designee,has determined that the best interests of the District would be served-by the payment of the fees set forth in paragraph 3 hereof,in lieu of such land dedication. Land shall be dedicated to the District in an amount equal to the greater of:(a) 10 percent of the total size of the approved development,or(b)calculated at the rate of two acres for every 1,000 new residents seasonably projected by the District for the development. I Fees in Lieu of Dedication In the event the District, through its Superintendent or designee,determines that dedication of land is not in the best interests of the District,the District shall recommend and request that the following fees be paid in lieu of such land dedication,as a condition of approval of the development application by the local government The fees shall be calculated as follows: (a)5750 for each new single-fancily residence;(b)5585 for each unit in a duplex or triplex;and(c)5420 for each unit in a multi-family structure other duplexes or triplexes. 4. In-Kind Contributions. The District shall be authorized to accept in-kind contributions in satisfaction of the requirements set forth in either paragraph 2 or 3 hereof,provided that such in-kind contributions represent a fair equivalent in terms of the value which would otherwise be realized under the policy set forth in such paragraphs. 5. Land Dedication Procedures. The recorded exemption is a subdivision process used to divide a lot into two (2) or three (3) separate lots. Examples of when a recorded exemption application may be submitted include creating a lot in the agricultural zone district for a single-family residential building site, separating existing improvements from agricultural land, and creating a lot in a commercial or industrial zone district for existing or future development. B. Provisions of Section 24-8-40 shall not be applied to prohibit the approval within five (5) years of one (1) additional application fora r emption on a parcel which has been part of a recorded exemption which was a r p p oved or ha an application pending as of O&tober 25,_1925_._ Nor will it prohibit the approval within ten (10) years of an additional application for a recorded exemption on a parcel which has been part of a recorded exemption which was recorded after October 25, 1995. This shall be in accordance with Article III, Section 3-14(2) of the Home Rule Charter. C. The recorded exemption application shall include the total contiguous land ownership, except in the A (Agricultural) Zone District. In the A (Agricultural) Zone District the following will apply: 1 . When a contiguous ownership equals at least one hundred sixty (160) acres, or is a parcel otherwise recognized as a complete quarter section, a portion of the lot equal to the m 1 r (eighty [80] acres) may be used in the recorded exemption application. 2. The three-lot recorded exemption application shall include the total contiguous land ownership equal to no less than one hundred sixty (160) acres, or is a parcel otherwise recognized as a complete quarter section. Two (2) of the proposed parcels shall be less than thirty-five (35) acres in size and the third parcel must be at least one hundred twenty (120) acres in size. 3. When a contiguous ownership equals two (2) or more parcels created prior to the initiation of subdivision regulations, a single parcel may be used in the recorded exemption application. (Weld County Code Ordinance 2001-1 ; Weld County Code Ordinance 2002-9) Sec. 24-8-30. Subdivision exemption. A. The subdivision exemption is intended for the following four (4) purposes: 1 . Division of a parcel of interest in a parcel which does not result in the creation of a new residential or permanent building site. The subdivision exemption may be utilized in conjunction with a recorded exemption to separate one (1) additional existing habitable residence with accessory outbuildings from any of the recorded exemption parcels providing: a. A minimum of two (2) habitable residential improvements are required. b. The residential use of the improvements must be continuous with any gap in use being less than one (1) year. c. The residential improvements must be continuously claimed and taxed as residences by the Assessor's Office. 24-48 Stipp. 4 • S Subdivisions — Exemptions Sec. 24-8-90 C. Any change to a previously approved exemption which is not a correction as defined in Section 24-8- 180 above shall follow the procedures of Section 24-8-150. D. The date for calculating compliance with the timing provisions of Section 24-8-80.H shall be the date of recording the most recent previous exemption associated with the parcel, not the date of the correction. (Weld County Code Ordinance 2002-9) Sec. 24-8-100. Exemption amendments time provisions. Time provisions do not apply to subdivision exemptions for adjustment of property lines between two .(2) contiguous parcels, for the creation of lots for the purpose of financing or for the temporary use of a parcel for pu lic utility facilities. Any change to a previously approved exemption, which is not a correction as defined in Section 24-8-90 of this Chapter, shall be processed as a new exemption, if eligible. The following improvements shall be constructed at the expense of the subdivider as stipulated in the subdivision improvements agreement by the Board: A. Road grading and surfacing. B. Curbs, if required. C. Sidewalks, if required. D. Sanitary sewer laterals, where required. E. Storm sewers or storm drainage systems, as required. F. Water distribution systems, where applicable. G. Street signs at all street intersections. H. Permanent reference monuments and monument boxes. I. Street lighting, if required. J. Landscaping, where required. K. Underground electric and communication utility lines and services, and all street lighting circuits, as required. L.
