RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING USE BY
SPECIAL REVIEW PERMIT#1394-NORTHERN COLORADO CONSTRUCTORS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on the 22nd day of November,2004,a Probable Cause Hearing was held before
the Board to consider setting a Show Cause Hearing to determine whether or not Northern Colorado
Constructors, Inc., 18100 Weld County Road 19,Johnstown, Colorado 80534,was in compliance
with certain Conditions of Approval and Development Standards contained in Use by Special Review
Permit#1394 for a Mineral Resource Development Facility(dry open pit mining for sand and gravel)
in the A (Agricultural) Zone District, and
WHEREAS, the alleged violations were said to be occurring on property described as part
of Lots 3, 4, and 5 of Lupton Meadows Subdivision; being part of the E1/2 SE1/4 of Section 24,
Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, after review, the Board deems it advisable to continue said matter to
February 23, 2005, at 9:00 a.m., to allow the Department of Public Works and Northern Colorado
Constructors, Inc.,to conclude negotiations regarding a Road Maintenance Agreement, and to allow
the company time to file its plat.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that Probable Cause Hearing Concerning Use by Special Review Permit#1394,
Northern Colorado Constructors, Inc., be, and hereby is, continued to February 23, 2005, at
9:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded,adopted by
the following vote on the 22nd day of November, A.D., 2004.
