Home My WebLink About20043616.tiff • AMENDMENT TO AGREEMENT FOR MUNICIPAL JAIL SERVICES THIS AMENDMENT TO AGREEMENT is made this day of 20_, by and between the Town of LaSalle, hereinafter referred to as the "Municipality," and the County of Weld, a political subdivision of the State of Colorado, hereinafter referred to as "County." WHEREAS, on or about June 2, 1997, the Municipality and County entered into an Agreement for Municipal Jail Services ("the Agreement") for the purpose of using the Weld County Jail for the incarceration of its prisoners, and WHEREAS, said Agreement sets the rate on a per offender per day basis which the Municipality is obligated to pay for incarceration of Municipality's prisoners in the Weld County Jail, and WHEREAS, both parties acknowledge that there is a need to set said rate at the amount set by the Joint Budget Committee of the Colorado General Assembly for reimbursement to Colorado counties for holding backlogged Department of Corrections' inmates on a annual basis, said rate to continue for one year, beginning January 1 of the year following the selling of the rate and continuing to and until December 31 of such year, and WHEREAS, this Amendment to Agreement is for the purpose of accomplishing such change to the Agreement to set said rate as stated herein. WITNESSETH: NOW, THEREFORE, for and in consideration of the mutual covenants, conditions, and promises contained herein, the parties hereto agree to amend the Agreement as follows: 4. DURATION This Agreement shall be effective upon final execution by the appropriate officers of both parties. This Agreement shall begin January 1, 2005, shall continue through December 31, 2005, and shall be automatically renewable year to year after that date unless sooner terminated by notice from either party in accordance with Section 5 of this Agreement. At the time this Agreement is terminated, the Municipality shall retake all the Municipality's prisoners. 9. COST AND REIMBURSEMENT A. Except as otherwise provided in this Agreement, all costs of housing the Municipality's prisoners, pursuant to the terms of this Agreement shall be fixed and reimbursed at the per offender per day rate set in the previous year by the Joint Budget Committee of the Colorado General Assembly for reimbursement to Colorado counties for holding backlogged Department of Corrections' inmates. Said rate shall begin January 1 of the year following the setting of the rate and continuing to and until December 31 of such year. The remaining provisions of the Agreement shall remain the same.
