HomeMy WebLinkAbout20041125.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JAMES BOYD AND JOHN BOATMAN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,James Boyd and John Boatman,VI #0300295, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of April, 2004, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, James Boyd, property owner, and Bob Erving, representative, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 22, 2004, to allow adequate time for the property owners to complete the removal of the noncommercial junkyard and bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. The"Commercial Vehicles"(semi's and other commercial equipment)shall be removed from the property or a Use by Special Review application shall be completed and submitted to the Department of Planning Services. All of the"Commercial Businesses"(such as but not limited to, landscaping, auto and/or vehicle storage or auto repair, shall be removed or a Use by Special Review application shall be completed and submitted to the Department of Planning Services. Agriculture in the COUNTY is considered a valuable resource which must be protected from adverse impacts resulting from uncontrolled and undirected business, industrial and residential land USES. The A(Agricultural)Zone District is established to maintain and promote agriculture as an essential feature of the COUNTY. The A(Agricultural)Zone District is intended to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land USES. The A(Agricultural) Zone District is also intended to provide areas for the conduct of USES by Special Review which have been determined to be more intense or to have a potentially greater impact than USES Allowed by Right. The A(Agricultural)Zone District regulations are established to promote the health, safety and general welfare of the present and future residents of the COUNTY. (Weld County Codification Ordinance 2000-1) Sec. 23-3-20. Uses allowed by right. No BUILDING, STRUCTURE or land shall be USED and no BUILDING or STRUCTURE shall hereafter be erected, structurally altered, enlarged or maintained in the A (Agricultural)Zone District except for one (1) or more of the following USES. However, one (1) amateur (HAM) radio operator's crank-up antenna may be extended to a maximum of one hundred fifty 1 (150)feet in height, provided that its resting or"down" position does not exceed seventy(70)feet in height. The following BUILDINGS, STRUCTURES and USES shall be allowed in the A (Agricultural) Zone District so long as they are clearly incidental and ACCESSORY to the USES allowed by right in the A(Agricultural) Zone District. Such BUILDINGS, STRUCTURES and USES must be designed, constructed and operated in conformance with the bulk requirements contained in Section 23-3-50 below. ACCESSORY USES within the A (Agricultural)Zone District shall also be subject to the additional requirements contained in Articles IV and V of this Chapter. Note: The combined GROSS FLOOR AREA of all ACCESSORY BUILDINGS constructed after the original effective date of this Chapter (August 25, 1981) on LOTS in an approved or recorded subdivision plat or LOTS part of a map or plan filed prior to adoption of any regulations controlling subdivisions of less than ten (10) acres shall not exceed four percent (4%) of the total lot area, except in the Mixed Use Development Area (MUD), which shall adhere to MUD development standards. However, in no case shall such an accessory building exceed twice the gross floor area of the primary residence on the lot except by variance. Any accessory structure made nonconforming by application of this Section may be repaired, replaced or restored in total. A. STRUCTURES for storage of equipment and agricultural products. Converted, partially dismantled, modified, altered or refurbished MOBILE HOMES or MANUFACTURED HOMES shall not be utilized as an AGRICULTURALLY EXEMPT BUILDING or for the storage of equipment or agricultural products. B. BUILDINGS for confinement or protection of LIVESTOCK, within the limitations defined in Section 23-3-50 below. Converted, partially dismantled, modified, altered or refurbished MOBILE HOMES or MANUFACTURED HOMES shall not be utilized as an AGRICULTURALLY EXEMPT BUILDING or for the storage of equipment or agricultural products. C. MOBILE HOMES used as SINGLE-FAMILY DWELLINGS for persons customarily employed at or engaged in FARMING, RANCHING or GARDENING subject to the additional requirements of Article IV, Division 3 of this Chapter. D. HOME OCCUPATIONS. E. OFFICE incidental to the operation of the USES Allowed by Right as listed in Section 23-3-20 above. F. MOBILE HOME subject to the additional requirements of Article IV, Division 3 of this Chapter. G. Roadside stands when the products offered for sale are grown on the premises. Such stands shalt be situated not less than fifty (50)feet from the PUBLIC right-of-way. H. SIGNS, in conformance with the provisions of Article IV, Division 2 of this Chapter. I. Noncommercial junkyard. J. Any other STRUCTURE or USE clearly incidental and ACCESSORY to the operation of a Use Allowed by Right in the A(Agricultural)Zone District. K. TEMPORARY Accessory STRUCTURE. More than one (1)TEMPORARY Accessory STRUCTURE in the A (Agricultural)Zone District may be permitted for the purpose of storing agricultural goods inside the unit. A MOBILE HOME may not be used as a TEMPORARY Accessory STRUCTURE. A TEMPORARY Accessory STRUCTURE may be permitted upon a determination by the Board of County Commissioners that: 1. Electricity is the only utility which will be connected to the TEMPORARY Accessory STRUCTURE. 2. The TEMPORARY Accessory STRUCTURE will not be used on any basis as a DWELLING or as overnight or TEMPORARY housing for any person. 3. The applicant has demonstrated that no reasonable alternative exists to using the TEMPORARY Accessory STRUCTURE for agricultural purposes. 4. The property upon which the TEMPORARY Accessory STRUCTURE is to be located must not be in a platted subdivision. 2 5. The property upon which the TEMPORARY Accessory STRUCTURE is to be located must be on a LEGAL LOT. 6. The property owner must substantiate in writing that the TEMPORARY Accessory STRUCTURE is necessary to the agricultural operation of the property. 7. The applicant shall not remove any structural component of the TEMPORARY Accessory STRUCTURE making it unmovable. 8. A TEMPORARY Accessory STRUCTURE shall not be allowed to become in a state of disrepair. Such disrepair may include a TEMPORARY Accessory STRUCTURE that is partially or totally damaged by fire, earthquake, wind or other natural causes, or is in a state of general dilapidation, deterioration or decay resulting from improper lack of maintenance, vandalism or infestation with vermin or rodents. Any such TEMPORARY Accessory STRUCTURE shall be restored to and maintained in the original condition it was in at the time it was placed on the site as established by the original inspection by the Building Inspection Department, or it shall be removed from site. 9. All TEMPORARY Accessory STRUCTURES shall be removed from the property upon cessation of the USE of the TEMPORARY Accessory STRUCTURES. 10. The TEMPORARY Accessory STRUCTURE may not be used in any manner to display a SIGN. 11. A zoning permit for a TEMPORARY Accessory STRUCTURE shall be for a period of twelve (12) months, and is renewable only by grant of the Board of County Commissioners. 12. A zoning permit for more than one (1)TEMPORARY Accessory STRUCTURE in the A (Agricultural)Zone District may be issued by the Department of Planning Services upon the determination that the criteria of Section 23-3-30 of this Code are met. If the applicant is not able to meet the criteria stated in Section 23-3-30, the Board of County Commissioners shall review the application for compliance with the criteria set out in Section 23-3-30 at a regularly scheduled meeting of the Board. The Board of County Commissioners shall give notice of the application for a zoning permit and the meeting date to those persons listed in the application as owners of property located within five hundred (500)feet of the parcel under consideration. Such notification shall be mailed, first class, not less than ten (10)days before the scheduled meeting. Such notice is not required by Colorado state statute and is provided as a courtesy to surrounding property owners (the surface estate). Inadvertent errors by the applicant in supplying such list or the Department of Planning Services in sending such notice shall not create a jurisdictional defect in the permit process even if such error results in the failure of a surrounding property owner to receive such notification. The Department of Planning Services shall post a sign for the applicant on the property in question indicating that a TEMPORARY Accessory STRUCTURE has been requested for the property, the meeting date and telephone number where further information may be obtained. The sign shall be posted at least ten (10) days prior to the meeting date. The Board of County Commissioners shall consider any testimony of surrounding property owners concerning the effects of the TEMPORARY Accessory STRUCTURE on the surrounding properties. In addition, the Board of County Commissioners shall consider compatibility of the TEMPORARY Accessory STRUCTURE with the surrounding area, harmony with the character of the NEIGHBORHOOD, its effects upon the immediate area, and the general health, safety and welfare of the inhabitants of the area and the COUNTY. Agricultural Service establishments primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or contract basis, including: 1. Sorting, grading and packing fruits and vegetables for the grower. 2. Grain and/or feed elevators. 3. Board of County Commissioners d -MOSi\®cck 1555 North 17"' Avenue Greeley CO 80631 Re: VI-0300295 Property owned by Mr. James Boyd & Mr. John Boatman Commissioners: We are property owners adjacent to the entire west side of property referenced above and are requesting that no extensions for delay of legal action nor any lengthy extension of time be allowed for compliance of pending violations to Weld County Codes. We have been neighbors to this property since 1975, when it was a functioning dairy operation. Since the demise of that operation, we have watched this property and buildings disintegrate not only aesthetically but environmentally. The owners not only engaged in numerous businesses for profit but have acquired landfills of questionable environmental safety. Most recently it took on dozens of commercial vehicles and numbers of noncommercial junkyard materials. Truckloads of fill dirt layered with chopped up tires, large chunks of concrete and boulders were dumped onto a number of acres of this some of which was approved by The Army Corps of Engineers based on restoring this area to pasture land, riding trails and agriculturally related grounds conducive to an equestrian center. A large trucking service, a tree service business, and an insulation business have leased parts of this property. Likewise the property owners began storing vehicles, Rv's, camper trailers, boats, trailers, some that were being inhabited by several individuals, with questionable sewage disposal. Additionally the property had hundreds of barrels, painted and stacked for fences etc. Many of those barrels are still in a pit which were set afire on March and are now being tested for toxic materials. Fireworks and Christmas trees (not raised on the premises) were sold from stands at the front of the property even after property owners were advised of above Code violations. The runoff from this property is channeled via a ditch that runs into the Union Reservoir which has to be a major concern for all. Many of the camper trailers, and semi-truck containers as well as mobile homes etc. have been removed and we do feel that Mr. Boyd has made some attempt to reach compliance. There are still a number of containers, and what could be considered Temporary, Accessory Structures remaining. The trucking business remains along with numerous dump trucks and trailers, and a tree removal business, as well as storage of vehicles in and outside of barns. The amount of traffic on State Hwy. 66 constitutes a significant safety factor with the number of trucks etc. entering and exiting this property from both the State Hwy. and Weld County Rd. 1. We have attempted to meet with Mr. Boyd regarding his plans for the future for his property, but have yet to do so. We applied and received a one-time recorded exemption to our property for our children to build a home,but they no longer desire to do so because of the poor aesthetics and environmental safety of this neighborhood. I believe Weld County needs to consider that this property is one of their more significant entrances to their County. It, has become such an eyesore, as well as an environmental and safety factor, that we are extremely concerned about it compromising the value of our properties, let alone the pride we feel living in Weld County.
