RE: DESIGNATION OF EMERGENCY RESPONSE AUTHORITY PER SENATE BILL 172
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the 1983 Colorado State Legislature has passed Senate Bill 172
concerning hazardous substance incidents, and providing for a state-wide
system for the prevention thereof and the response thereto, and
WHEREAS, §29-22-102(3) (b) requires that the Board of County Commissioners
of every county in the State designate, by resolution, the emergency response
authority for hazardous substance incidents occurring within the
unincorporated areas of the county, and
WHEREAS, the Office of Emergency Management within the division of
Communications appears to be the most appropriate organizational placement
within Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County that in accordance with Senate Bill 172, the Office of Emergency
Management within the division of Communications, is hereby designated the
Emergency Response Authority for hazardous substance incidents occurring
within the unincorporated areas of Weld County effective July 1, 1983.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote on the 29th day of June, A.D. , 1983.
