HomeMy WebLinkAbout20043491.tiff RESOLUTION RE: APPROVE EXTENSION OF FRANCHISE WITH CHAMPION BROADBAND WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Champion Broadband("Champion")is a cable company which currently holds a cable franchise with Weld County ("County"), which Champion acquired on or about September 30,2004,from Galaxy Cable, Inc.,and the transfer of such franchise was approved by Resolution #2004-2864, on September 27, 2004, and WHEREAS, said Franchise is scheduled to expire on December 18, 2004, and WHEREAS,Champion has requested an extension of the Franchise for ninety(90)days so that Champion will have additional time to reach an agreement with County for the renewal of the Franchise it recently acquired from Galaxy Cable, Inc., and WHEREAS,it is in the public interest to extend the current Franchise for an additional period of time so that cable service to the public will not be interrupted, and WHEREAS,after review,the Board deems it advisable to extend the current Franchise for a period of ninety (90) days, or until March 18, 2005. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado,that the Franchise originally granted by Resolution#881200 on December 19, 1988, and most recently transferred to Champion Broadband by Resolution #2004-2864 on September 27, 2004, be, and hereby is extended. Weld County records indicate that cable services are provided to residents in the area around the River Valley Mobile Home Park located near Del Camino and the Enchanted Hills and Casa Grande Subdivisions, for a total of less than 500 subscribers. The franchise Champion acquired less than three months ago is scheduled to expire December 18, 2004. Champion is a limited liability corporation, which essentially gets the legal protections of a corporation, but may be taxed as a partnership. Champion is owned by Mark and Dave Haverkate, who personally direct and manage the operation of the company. The company currently provides cable service to over 10,000 customers who reside in Wyoming, suburbs of Los Angeles, and also in parts of Denver and Lakewood, Colorado. Mark Haverkate states that he has been active in the cable industry for over 26 years, holding various positions with different companies prior to starting his own company in 1999. Dave Haverkate has requested that this Board grant an extension of the Franchise to Champion for an additional ninety days so that they have time to reach an agreement with the County to renew the franchise.
