WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado , and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 21st day of May, 1980 at the hour of 2: 00 o' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Tom and Beverly Trostel, 9885 Weld County Road 11, Longmont, Colorado 80501, for a Special Use Permit for a dairy operation on the following described real estate, to-wit ; Lot B Meadowland a minor subdivision No. 1313-14-1-MS-5 , a part of the East Half of the Northeast Quarter of Sec- tion 14 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a dairy operation on the above described real estate, and WHEREAS, Section 3 . 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural Zone District upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioners and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a dairy operation on the hereinabove described real estate, conforms to the purposes of Section 3 . 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of the 800520 petitioners for a Special Use Permit for a dairy operation on the above described tract of land be, and hereby is, granted subject to the Development Standards contained in the Special Use Permit and also subject to the conditions as recommended by the Weld County Planning Commission. BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated April 1, 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. Therefor, today all three votes must be in the affirmative for a positive action. If anyone feels this is a hardship they may have their request tabled until all Commissioners are present. Mr. Anson read the notice as published and reviewed the criteria to be used in making a determination on this request, in accordance with the zoning resolution. Mr. Honn read the Planning Commission' s conditional recommendation for approval and the development standards. Mr. Trostel was present and commented upon his request. Robert Konkel, adjacent landowner, was present and related his concerns with the request. Mr. Konkel feels that a dairy operation of this size will lower the value of his property. CHANGE TAPE 080-37 Mr. Trostel commented on the traffic relating to the dairy. He will sprinkle the road to keep the dust down when they are hauling in the feed for storage. This will be for approximately 10 days in the harvest season. Following discussion Commissioner Carlson made a motion to approve • the special use permit request with development standards. The request for a permit on my behalf as a close neighbor is that it be denied, based on location and impact on my residential use . Six years ago both Tom Trostel and myself were granted building permits by Weld County to build residential homes on these two properties . Since that time , Mr. Trostel has built a barn and a block building. These courses of action have tended to settle our neighborhood into a less active agricultural use. I contend that this course was agreed on by Weld County when issuance of building permits were granted and to now put the use back to a heavy agricultural use with holding pens filled with animals close to my home is a reverse in intended use . This also seems contrary to growth planning that was set in motion when building permits were originally issued . The Trostel land was not planned or built to reflect this present plan of activity. Example , house was built at rear of property to get view of mountains , out buildings are built at front to not obstruct view but at same time put them ntose to my residence. Better plan would have been out buildings as far away as possible . Finally , as a resident of Weld County, I am asking you to protect my property investment to which I feel this dairy business would devaluate my home . COMMENTS: To date our office has received two letters from surrounding property owners in opposition to this request . Copies of those letters are included in the attached packet . The Department of Planning Services staff considered possible realignment of the proposed pens as recommended in the letters. However, the staff felt that there would be no significant change in impact on surrounding property owners. The Department of Planning Services staff suggests that the Planning Commission and the applicant consider landscaping to screen the dairy operation from surrounding properties . The soils are deep, well drained soils with moderate permeability. They would support the waste disposal pit as designed. 2. There are no major irrigation systems that would be disrupted by the project. 3. The project is not located within a 100 year floodplain. 4. The area is properly zoned for this use, and in general , we find no conflict with our interests.
