The Weld County Public Works Department has reviewed this proposal; this project falls
primarily under the Use by Special Review Standards. Weld County Code, Chapter 23, Article
II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
Access: The applicant shall utilize the existing 30-foot access easement from State Highway
392. Our most current traffic count at this location reflects 4,550 vehicles taken in a 24-hour
period in 1995. These counts are based from the Colorado Department of Transportation.
REQUIREMENTS:
Access: The Colorado Department of Transportation (CDOT) has jurisdiction over all access to
the state highways. Please contact Gloria Hess-Idler or Tess Jones at the Greeley office to
verify the access permit or to for any additional requirements that may be necessary to obtain or
upgrade the permit.
Easement: The applicant shall obtain signatures from the four adjacent property owners
utilizing the existing 30-foot access easement that the use will be changing to accommodate
heavy duty trucks and traffic equipment utilizing the proposed USR (garage service.)
Verification of signatures shall be provided to Planning Services and the Public Works
Department for verification. Please refer to your plat drawing for the adjacent property owner's
names.
Off-Street Parking: The off-street parking spaces including the access drive shall be surfaced
with gravel or the equivalent and shall be graded to prevent drainage problems. Each parking
space adjacent to the building shall be equipped with a wheel guard or curb stop where
necessary to prevent vehicles from extending beyond the boundaries of the space and from
coming into contact with other vehicles, walls, fences, or plantings.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on
site in such a manner that will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.

Environmental Health Services has reviewed this proposal for a business to do repair
work on heavy duty trucks and farm equipment.
In reviewing this application our files revealed that the septic system serving the home
incorporates a cesspool in addition to a conventional Individual Septic Disposal System
(ISDS). An ISDS evaluation conducted by Pam Smith of our Department on March 3,
1994, states that the "cesspool must be properly abandoned". Our files do not indicate
if the cesspool was properly abandoned. It is this departments concern that the system
was not properly abandoned and is still in use.

I contacted the applicant, John Walkusch, about the abandonment of the cesspool. Mr.
Walkusch said that the cesspool was abandoned around the time the home was
purchased and that he will look for documentation to show that the system was
abandoned. Should he find the appropriate documentation this issue will be resolved.
If documentation cannot be located, he will be required to provide necessary evidence
as required by this department.
In addition, the applicant proposes using the restroom facilities in his home. The
application materials submitted indicate that the residence is outside the USR
boundaries. In order to use the home facilities the applicant should change the
boundaries on the site plan to indicate the home is included in the USR application.
The other alternative is to provide restroom facilities within the shop.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall abandon the cessool in accordance with Weld County
Code. Written verification or physical evidence that the cesspool has been
properly abandoned shall be submitted to the Weld County Planning
Department and the Weld County Department of Public Health and
Environment.
2. Submit a dust abatement plan to the Environmental Health Services, Weld
County Department of Public Health & Environment, for approval prior to
operation.
3. In accordance with the Underground and Above Ground Storage Tank
Regulations (7 CCR 1101-14) a spillage retention berm shall be constructed
around the existing fuel tank . The volume retained by the spillage berm
should be greater than the volume of the largest tank inside the berm.
Alternative protective measures may be allowed provided they comply with
the Above Ground Storage Tank Regulations.
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of
Public Health & Environment. The plan shall include at a minimum, the
following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. If the applicant does not include the existing home within the USR boundaries an
individual sewage disposal system is required for the proposed shop and shall be
installed according to the Weld County Individual Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater

contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. In accordance with the Underground and Above Ground Storage Tank

5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
7. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
8. The applicant shall operate in accordance with the approved "waste handling
plan".
9. Adequate handwashing and toilet facilities shall be provided.
10.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.

The only permit on record for this parcel or address was for the installation of an evaporative
cooler. That permit was withdrawn.
1. A building permit shall be obtained for all existing structures unless evidence can be
submitted that a permit and all required inspections were performed. Existing building
applications shall include all uses to which the buildings are, or will be, used. A plot plan shall
be submitted showing all structures with accurate distances between structures, and from
structures to all property lines.
2. A plan review is required for each building for which a building permit is required. Plans for
the shop shall include a floor plan and a complete description of the extent of the work that will
be done to repair vehicles. Two complete sets of plans are required when applying for each
permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. The shop building will probably be classified as type S-3 repair garage. Fire resistance of
walls and openings, construction requirements, height and allowable areas will be reviewed at
the plan review. Setback and offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.

6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain whether the buildings are existing or new.

Landscape / Site Plan Review
The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
There was not a Site Plan submitted with the application materials. Therefore, at a minimum, the USR
Plat shall delineate at a minimum the following:
The location of all existing and proposed plant material as addressed in the application.
The existing building associated with this use shall adhere to Appendix 23-B of the Weld County Code.
The number of off-street parking spaces required for this facility is 3 spaces.
The applicant shall address the requirements of the American with Disabilities Act. For a facility of this
size, a minimum of one handicapped parking spaces will be required. Typically, one parking space
shall be van accessible with a five foot wide landing between parking spaces. Access from the parking
area into the structure has not been delineated on the plat. The applicant shall address all requirements
of the American with Disabilities Act in future drawings. All parking spaces shall have curb stops.
The internal circulation within the site is unclear. Future drawings shall delineate the proposed
circulation pattern and outdoor storage areas.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or trash
collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas
shall be designed and used in a manner that will prevent wind or animal scattered trash.
The applicant shall address the issue of on-site lighting, including security lighting in applicable. The
County Code states"Any lighting ... shall be designed, located and operated in such a manner as to
meet the following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties...."
The applicant has not delineated any on-site sign. If an on-site sign is desired, the signs shall adhere to
Section 23-4-90.A and .B of the Weld County Code. One identification sign per principal use shall be
allowed, provided that the sign does not exceed sixteen (16)square feet in area per face. Further, the
location of the sign, if applicable shall be delineated on the Landscape/Site Plat.
The applicant shall provide a buffering and screening plan for this facility. The proposed plan shall
address on-site screening from adjacent properties and rights-of-way. Upon approval from the
Department of Planning Services, the plan shall be delineated on the plat.

The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening"it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Dear Mr. Gathman:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of
May 21, 2003. The subject property is located outside the Town's Growth Management
Area, but within the Community Influence Area.
The subject property is depicted as Community Separator on the Town's Land Use Plan
map. The Windsor Comprehensive Plan states that the Community Separator land use
depiction provides for areas of open space and open lands which generally have little or no
development,with the exception of agricultural activities. The application materials indicate
that no new structures are proposed as the repair business is proposed to be located within an
existing building within an existing Weld County subdivision, therefore, the proposed
business should not be visible from SH 392. Additionally, the subject property takes access
from a private cul-de-sac and is not immediately adjacent to SH 392, therefore, additional
right-of-way dedication is not applicable in this instance.
Based upon the aforementioned information, the Town of Windsor Planning Commission
recommends approval of the Use by Special Review to the Weld County Department of
Planning Services.
