Thank you for providing the newspaper article regarding the Eskildsen water well impact. Brad Turner, the reporter for the Daily Times-Call, had previously been in the COGCC Public Room to review the extensive file on this complaint. This is an active and ongoing remediation project (No. 1587). The initial complaint from Mr. Eskildsen was on March 10, 2002. It was reported that gas was present in both the Art Eskildsen and the Bonnie Eskildsen water wells. Both water wells are completed in the Laramie/Fox Hills aquifer. Based on laboratory analyses, the water wells had been impacted by"thermogenic" methane. For your information, the gas produced from oil and gas wells is"thermogenic" methane. Thermogenic methane gas is formed by the thermal breakdown of organic material in rocks resulting from high temperatures created by deep burial. "Biogenic" methane gas occurs in most near-surface environments and is a principal product of the decomposition of buried organic material. In Weld County many of the coal zones in the Laramie/Fox Hills aquifer contain biogenic methane gas. The closest oiUgas well to the Eskildsen water wells is the Scheidt State VV 16-13 operated by Patina Oil & Gas Corp (Patina). During workover operations in March and April of 2002, holes in the casing were found and subsequently repaired. Based on available information and analytical evaluations, it was determined that the source of the gas in the Eskildsen water wells was likely the Scheidt State VV 16-13 well. A Notice of Alleged Violation (NOAV) was issued to Patina on June 19, 2002. Corrective action included the submittal of a Form 27— Site Investigation and Remediation Workplan. The submitted workplan was conditionally approved by the COGCC on December 27, 2002 (see attached copy). Also attached is a partial timeline of events provided by Patina that was required by the COGCC with the submittal of the Form 27. cc,- c'.v// ,wL. Laboratory results are then forwarded to the COGCC for review. The well water is being pumped into a storage tank where it is "de-gassed" prior to domestic use. During the summer, the water is pumped from the well onto the Art Eskildsen property for irrigation purposes. Deep Rock drinking water has been provided to the Eskildsen household by Patina since April of 2002. I hope that this summary of the complaint answers some of your questions and/or concerns. Cox Patina Oil & Gas Corporation 804 Grand Avenue Platteville, CO 80651 RE: Scheidt State VV 16-13 /Remediation#1587 SWSW Section 16—T1N—R67W Weld County, Colorado Dear Mr. Cox: As you are aware, a Notice of Alleged Violation (NOAV) was issued to Patina Oil& Gas Corporation (Patina) on June 19, 2002. The NOAV required Patina to submit a Form 19— Spill/Release Report and a Form 27—Site Investigation and Remediation Workplan for the continued monitoring and abatement of the methane gas present in the Eskildsen water wells. Please note that the NOAV had an incorrect date of December 27, 2001 for the alleged violation. The correct date should be the date of initial sampling at the Art Eskildsen water well,which is March 20,2002. Most recently, additional sampling of the Eskildsen water wells was conducted on September 5, 2002. The Art Eskildsen water well was also sampled on March 20 and July 29,2002. The Bonnie Eskildsen water well was also sampled on July 29, 2002. The results of the gas composition and isotopic analyses indicated mixtures of thermogenic and biogenic gas in both water wells. However,the gas in both water wells is different. All analytical results from both water wells and other available data were provided to Anthony Gorody,Ph.D.with Universal Geoscience Consulting, Inc. in Houston, Texas for further evaluation. Mr. Gorody concluded that the methane gas present in the Bonnie Eskildsen water is most similar to the Codell gas that is produced in the Scheidt State VV 16-13. The methane gas present in the Art Eskildsen water well has very different characteristics and Mr. Gorody's attempt to determine the source of the small amounts of thermogenic gas in this well is not conclusive. A copy of his evaluation is attached. As previously reported, casing leaks were repaired in the Scheidt State VV 16-13 during March and April of this year. Cox 12/27/02 Page 3 of the gas in the Bonnie Eskildsen water well is most likely the Scheidt State VV 16-13 and the gas in the Art Eskildsen water well also may be from this oil/gas well. Therefore,the workplan is approved with the following conditions: ➢ Provide the COGCC with a chronology of all abatement measures and sampling events undertaken by Patina at the Art Eskildsen and Bonnie Eskildsen water wells. ➢ Gas meters were installed at the Eskildsen water wells by Patina as an abatement measure to monitor the flow rate of gas from each well. Patina has periodically monitored the meters and submitted the results to the COGCC on a bi-weekly basis. Flow has not been recorded in either water well since July of 2002. It has been reported that the meters may have been disconnected during well maintenance and not properly re-connected. Patina shall confirm that both meters are functioning properly by January 15, 2003 and report to the COGCC accordingly. If the meters are not functioning properly, Patina shall schedule repairs as soon as practicable and resume the periodic monitoring and submittal of results. Should the current meters fail to adequately measure the flow rate of gas from the Eskildsen water wells, Patina shall propose an alternative method of monitoring. ➢ Patina shall sample for methane in water at both Eskildsen water wells. Water samples shall be collected before entering the reserve tank and after exiting the reserve tank to determine the general effectiveness of the de-gassing of the well water. Laboratory results shall be submitted to the COGCC for review by January 15, 2003. Should methane concentrations not decrease appreciably after the residence time in the reserve tank, additional abatement measures may be required. Additionally, methane sampling shall be conducted monthly and the results reported to the COGCC also on a monthly basis. ➢ Patina shall also sample for BTEX in water at both Eskildsen water wells. Water samples shall be collected before entering the reserve tank. Laboratory results shall be submitted to the COGCC for review by January 15, 2003. Additionally, BTEX sampling shall be conducted monthly and the results reported to the COGCC also on a monthly basis. ➢ Patina shall attempt to collect gas samples from both water wells on a quarterly schedule. Each gas sample shall be analyzed for gas composition and isotopic properties, including Delta C-13 of methane, Delta D of methane, DIC— Dissolved Inorganic Carbon, and Delta C-13 of DIC. Laboratory results will be evaluated to determine the status of biogenic and/or thermogenic characteristics. ➢ Patina shall provide adequate periodic inspections and maintenance of the batement equipment to ensure that it is operating properly. It was brought to Roger's attention that Art had been experiencing gas and or water bubbles in their water. Roger immediately notified John Nussbaumer and Scott Reasoner. March 10,2002 - Art Eskildsen's original complaint to the COGCC. March 18,2002—Letter from the COGCC (Colorado Oil & Gas Conservation Commission). The letter specified the Scheidt State VV 16-13 had a possible casing leak and a water well in the area has possibly been contaminated as a result of the leak March 20, 2002—John Nussbaumer met Randall Ferguson of the COGCC at the wellsite. They took gas and water samples of the Scheidt State VV 16-13 and both Eskildsen's water wells located in Township 1N, Range 67 W, Section 16 SWSW. March 27,2002 —Moved in rigged upon the Scheidt State VV 16-13, found holes in casing at 1,300'. Repaired holes in casing by doing an annular fill. 620 sacks of cement pumped from 1593' to surface. March 27, 2002—Patina obtained gas sample from Scheidt State VV 16-13 and sent to Empact Analytical for compositional analysis April 4, 2002—Cement was drilled out and a bond log was run showing good integrity of cement. The 3 'A" casing was pressure tested to 500# for fifteen minutes. This pressure test was witnessed by COGCC. April 5,2002—Patina coordinated Deep Rock for drinking water for both Eskildsens. April 12,2002—Patina contracted Boulder Water Well Service to set up fresh water systems for both contaminated water wells. April 22,2002—Gas meters were installed on wellheads so the gas production could be monitored and recorded. April 30,2002 —Patina obtained water samples from both wells and analyzed for BTEX and TDS. May 16, 2002—Patina paid $400 to Art Eskildsen for damages due to the casing repair on the Scheidt State VV 16-13. May 17, 2002 —Cleaned water tanks. May 18, 2002—Problem with Art's fresh water pump. Boulder Water Well Service changed out packing on centrifugal pump. Patina paid for repairs. May 23, 2002 - Patina obtained water samples from both wells and analyzed for BTEX and TVH. May 28,2002—Patina received a copy of a letter from Randall Ferguson of the COGCC to Art Eskildsen, which was a reply to Art's original complaint and an update of the status of the tests. June 4,2002 —Patina received a copy of a letter from Randall Ferguson of the COGCC to Art Eskildsen with gas test results. The gas samples were analyzed for gas compositional properties, isotopic properties, carbon 12 and 13, and hydrogen/deuterium. Composition analysis from both water wells and the Scheidt State 16-13 were overlays. Organic and inorganic analyses were conducted on water from the Eskildsen well. Inorganic results were within normal ranges and BTEX results were non-detect. Biological Activity Reaction Tests were also conducted. Iron related bacteria, sulfate reducing bacteria, and slime forming bacteria were all present in the well. June 11, 2002 —Cleaned water tanks June 13,2002 —Patina paid $700 to Art Eskildsen for two ewes, 2 lambs, a calf and garden hose. June 19, 2002—Boulder Water Well Service diagnosed bad pressure tank from Art Eskildson's original fresh water system. Tank was replaced along with additional float switches. Patina paid for repairs. June 19,2002 —COGCC issued NOAV. June 20,2002 —Cleaned water tanks June 24, 2002 —Mikel Cox and Randall Ferguson(COGCC)collected gas sample from Scheidt State VV 16-13. The gas samples were analyzed for gas compositional properties, isotopic properties, carbon 12 and 13, and hydrogen/deuterium. June 30, 2002 —Float switch malfunction causing water to enter electrical system on Bonnie Eskildsen's property. Dave Lillo arrived at 4:30 p.m. and made a call to Boulder Water Well Service. Boulder Water Well Service arrived at 6:00 p.m. and found the float not anchored properly, reanchored float and tested complete system. At 11:30 p.m. Dave Lillo received a phone call from Bonnie's boyfriend. He stated they didn't have water to the house and that none of the other problems from earlier had been resolved. He was belligerent and appeared to be intoxicated. Dave Lillo met Boulder Water Well Service back at the site at 1:00 a.m. and found system working properly. The only concern found was slightly reduced water flow to the house. Dirty filters were changed out and it appeared that the filters had not been changed for a very long time. Patina paid for repairs. July 10, 2002—File Spill/Release (Form 19) and Site Investigation and Remediation Workplan (Form 27) with COGCC. July 16, 2002—Bonnie Eskildsen called Dave Lillo and stated her and her boyfriend would like to purchase a house in Loveland. After speaking with a real estate agent, it was concluded she would not be able to get fair market value for her current residence due to no potable water. Bonnie asked how long it would take to get water on the property. Dave Lillo responded that it could take 3 months to 3 years at this point. Bonnie stated that fair market value for her property is $253,000 and that she had a person lined up to rent it for$1,500 per month, but declined after finding out about the water problems. Dave Lillo told her that he would speak to his supervisors about the situation and ended the conversation. July 23, 2002 —Cleaned the Tanks and had conversation with Bonnie Eskildsen. Dave Lillo told Bonnie Patina was looking into several options to get water to her property including drilling a replacement water well on the northwest corner of her property. She stated that a well could not be drilled in that area due to the septic system. That area of the property is the leech field. She stated the only place to drill a well on her property is the place it is right now. She continued to state she wants out of the whole situation, and she has consulted an attorney. Bonnie stated she would rather not sue Patina at this point due to the time constraints and Patina could settle out of court with her for$700,000. July 26, 2002- Met w/Randall Ferguson July 29, 2002 - Mikel Cox and Randall Ferguson(COGCC) collected gas sample from both(Art& Bonne) water wells. The gas samples were analyzed for gas compositional properties, isotopic properties, carbon 12 and 13, and hydrogen/deuterium. August 14,2002 - Boulder Water Well Service came out and diagnosed that Bonnie Eskildsen's down hole pump was locked up. McDonald Farms delivered 1000 gals of fresh water to Bonnie Eskildsen. August 14, 2002 - Received bid from Boulder Water Well Service to pull Submersible pump. $3,929.00 August 17,2002 - McDonald Farms delivered fresh water to Bonnie Eskildsen. August 21, 2002 - Pulled Submersible pump at Bonnie Eskildsens. Found the liquid end locked up and the lower thrust bearing failed. Ran in the hole with a new Gould 3HP, 230V,3-W Submersible pump. Could not get pump to run that night. August 22, 2002 —After attempting to get new pump to run at Bonnie Eskildsens a decision was made by Boulder to pull pump again. Boulder moved in and pulled pump out of the hole. They bench tested the new pump at there shop and found formation fines in pump. August 23, 2002 —Boulder ran in the hole with the same pump at Bonnie Eskildsens and landed the pump intake 20' higher in the well. Tested pump and found no problems. As per Al Chandlers instruction the pump was left off. He was instructed that the blue wire in the breaker box would need to be connected to power up the pump. August 31, 2002—Received a call from Al Chandler. He said the downhole is not running. He said that he had enough water until Tuesday. Lined up Boulder Water Well Service to check out the system on Tuesday. September 3, 2002 - Boulder Water Well Service came out to Bonnie Eskildsen's found that the blue wire in the breaker was not connected. They connected it and system checked out fine. September 4, 2002—Cleaned tanks at the Eskildsens. September 5, 2002—LTE was retained by Patina to collect gas and water samples from the water supply wells. September 11, 2002—Attempted to get approval to install sheds around both Art and Bonnie's water tanks. Bonnie instructed Patina that all work done on her property would need her lawyer's approval. September 16, 2002 —Leveled and rocked area at Arts house where shed will be built. Buried all lines 3 'h' deep. September 17, 2002 —Disconnected and cleaned tank at Arts. Had Beam Building system build a 12'x12' shed. Reinstalled tank, electrical and water lines. Everything tested good. September 20, 2002-Insulated shed at Art Eskildsens. September 24,2002 —Patina obtained water samples from the water supply wells and sent to Weld County Department of Health for analysis. October 1,2002 —Painted shed at Art Eskildsens. October 4, 2002—Received approval to install shed Bonnie's water tanks. October 7, 2002 —Leveled and rocked area at Bonnie's house where shed will be built. Buried all lines 3 'h' deep. Replaced filter—completely full of mud. October 8,2002—Disconnected and cleaned tank at Bonnie's house. Had Beam Building system build a 12'x12' shed. Reinstalled tank, electrical and water lines. Everything tested good. October 9,2002-Insulated,painted, electrical and installed vent and heater at Bonnie's house. Installed vent in Art's shed. October 10,2002 —Turned on heater (set on low) in Bonnie's shed. October 17,2002 —Float switch stuck on Art's water tank. (Repaired) Oct 29,2002 - Art Eskildsen's breaker on the control box tripped. Oct 30,2002 - Joe Armendariz (Electrician) and Boulder Water Well Service checked out the system at Arts. Everything checked out"OK". Formation fines in the pump may have caused problem. Oct 31,2002 -Breaker tripped again at Arts. Had Boulder Water Well Service change out control box. Down hole pump was pulling high amps while they were changing out the box. Nov 4th, 2002 - Pulled Submersible pump at Art Eskildsens and shop tested"GOOD" at Boulder water well Service. Nov 5th, 2002—Took Submersible pump to Pumps Inc. a distributor for Gould pumps. They found that the lower thrust bearing was bad and the motor was Marginal. The pump was covered under the warranty that the Eskildsens had. Ran in the hole with a new pump. Tested good. Cost to Patina was $1,799.31. Nov 18th, 2002 -Art Eskildsen's breaker on the control box tripped and he could not get his pump to run. Boulder Water well said the problem was down hole. Nov 19th, 2002—Boulder Water Well moved in rig and pulled Submersible pump at Art Eskildsens. Ron Neb (Electrician) added an addition separate breaker for the downhole pump. The pump came out of the hole and was twisted indicating a manufacture defect. Boulder claimed 1 week later that the pump had failed due to lack of lubrication. It either pumped off or was air locked. Nov 20th, 2002 - Boulder Water Well ran in the hole with a new Gould 3HP, 230V,3-W Submersible pump at Arts. Nov 25th, 2002—Art called, he had no water in his tank. Boulder water well Service check out the system. They found the motor was running down hole but the pump was not pumping fluid. Nov 26th, 2002 - Boulder Water Well moved in rig and pulled Submersible pump at Art Eskildsens. Ran a static level and found fluid to be at 500'. The pump had been set at 672', which indicates plenty of water in the hole. Pump must be air locking. Nov 27th, 2002 - Boulder Water Well ran in the hole with a new Gould 3HP, 230V,3-W Submersible pump w/a new downhole configuration to prevent air-locking. System checked good. December 27, 2002 —Received conditional approval of workplan from COGCC. January 15, 2003 - Mikel Cox and Randall Ferguson(COGCC) collected gas and water samples from the Art Eskildsen water supply well. The gas sample was analyzed for gas compositional properties, isotopic properties, carbon 12 and 13, and hydrogen/deuterium. The water samples were tested for BTEX and methane concentration. January 15, 2003 —The gas meter set on the Art Eskildsen water supply well was replaced with a newly calibrated meter and checked for proper installation by Patina measurement personnel. Hello
