HomeMy WebLinkAbout810562.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 478 - RHINIE AND ALICE MILLER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 11th day of February, 1981 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 478, being the property of Rhinie and Alice Miller, described as the North Half of the Northeast Quarter of Section 29 , Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows does not come within the purview of the definition of the terms , "subdivi- sion" and "subdivided land, " pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended: All of the North Half of the Northeast Quar- ter of Section 29 , Township 6 North, Range 64 West of the 6th P.M. , County of Weld, State of Colorado. The above described parcel is subject to a 30. 00 foot wide reservation for County Road along the Northerly and Easterly sides thereof. The above described parcel contains a gross acreage of 80. 00 acres more or less. The par- cel of land on which this request has been made is described as the N1 NEB, Section 29, T6N, R64W of the 6th P.M. , Weld County, Colorado. This property is located 1 mile north and 1 mile west of Gill. The property contains approximately 80 acres of Class III and VI irrigated soils. The request is to split the property into parcels of 1.14 acres, more or less and 79 acres, more or less. Mr. and Mrs. Miller wish to sell the 1.14 acre parcel to their son Richard Miller so that he may build a house on the property. Mr. Richard Miller has recently joined the family farming operation and desires to live closer to the property than at the present time. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons. 1. The request conforms to the intent clause of the Recorded Exemp- tion Procedure (Section 9-2 of the Weld County Subdivision Regula- tions), the intent clause of the Agricultural Zone District (Sec- tion 3.3.A. of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that the uses will be compatible with the surrounding agricultural uses. The request will allow agri- cultural and related uses to be the predominant land uses. There will be no reduction in the amount of land currently being used for agricultural production. 2. This request complies with the provisions of Section 9-4 A. of the Weld County Subdivision Regulations. The reasons being are as follows: I have changed my profession from working as a heavy equipment operator to farming. I am currently living in Greeley but plan to build a new home on an acre of land that my father owns. This acre is included within an 80-acre farm with no existing improve- ments. The acre that we have chosen to build on is a dry land pasture hill. This will not hinder the production of the farm in any way. Late last fall, my brother and I formed a partnership and bought our father's line of equipment, thus resulting in a large investment. Dad is retiring from farming, but will continue to run his cattle feeding operation. We will be farming my father's two farms plus two additional farms that we have rented all totaling approximately 500 acres. In addition to the farm land, there are 50 acres of irrigated pasture land that we plan to run cattle on. There are two houses on one of my father's farms. My parents live in one and my brother lives in the other. It is impossible for me to live in town and properly handle the farming duties. Both my wife and I were born and raised on the farm and are very anxious to move back on it. We have two children, ages 5 and 11 , that we want to raise in the country and have them enjoy the same type of childhood experiences that we did.
