PERMIT #542 FOR A MINERAL RESOURCE DEVELOPMENT FACILITY INCLUDING
AN OIL AND GAS SUPPORT AND SERVICE FACILITY (OIL AND GAS PROCESSING
FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - DUKE ENERGY FIELD
SERVICES
A public hearing was conducted on March 31, 2004, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certifythat pursuant to a notice dated March 12,2004,and duly published March 17,2004,
in the Fort Lupton Press, a public hearing was conducted to consider the request of Duke Energy
Field Services,do Witwer,Oldenburg,Barry and Bedingfield,LLP, fora Site Specific Development
Plan and 2nd Amended Use by Special Review Permit#542 for a Mineral Resource Development
Facility including an Oil and Gas Support and Service Facility(Oil and Gas Processing Facility)in
the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney, made this a matter of
record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal
and entered the favorable recommendation of the Planning Commission into the record as written.
Mr. Ogle gave a brief description of the location of the site, as well as a summary of the case
history. He described the surrounding property uses, and stated the site will be serviced by the
Central Weld County Water District,an individual sewage disposal system,and access from Weld
County Road 35. He stated 12 referral agencies reviewed this proposal, nine responded with
comments that have been addressed through the Conditions of Approval and Development
Standards, and staff received one phone inquiry regarding the case. Mr. Ogle further stated the
Department of Public Health and Environment, is requesting the word "Light" be deleted from
Development Standard #8, as described in Exhibit G.

Char Davis,Department of Public Health and Environment,stated Development Standard#8 needs
to be modified to delete the word "Light" because the use on the site will be more consistent with
what is allowed in the Industrial Zone District.
Donald Carroll, Department of Public Works, stated the site is accessed from Weld County
Road 35,and the facility generates three semi truck trips per day. Mr.Ogle described the proposed
amendment to the site displayed and photographs of the area.
Tim Clancy of Witwer,Oldenburg,Barry and Bedingfield,LLP, represented the applicant and stated
they have received no comments from the surrounding property owners. He explained the
construction will be minor, the new equipment will reduce the amount of CO2 generated by the
operations, and this hearing was required as part of the baseline review required of all the Duke
Energy Field Services facilities.
Joe Kuchinski, Duke Energy Asset Manager,stated the applicants residue sales to Public Service
is bumping the three percent tariff,therefore,they are planning to splice in a membrane separation
system between the tail end of the process to the delivery point. He stated that will consist of
installing filter and membrane skids, and he gave a brief explanation of how they work. Mr.
Kuchinski stated Duke Energy will be able to recover and consume 100 percent of the CO2 as fuel
gas in their engines, which will provide 75 percent of their requirements. The remainder will be
supplemented with regular fuel. In response to Chair Masden, Mr. Kuchinski stated the liquid
production is piped to the Greeley site to be separated.
No public testimonywas offered concerning this matter. Responding to Chair Masden, Mr.Clancy
stated he and the applicant have reviewed and concur with the Conditions of Approval and
Development Standards as proposed and modified.
Commissioner Jerke moved to approve the request of Duke Energy Field Services, c/o Witwer,
Oldenburg, Barry and Bedingfield,LLP,fora Site Specific Development Plan and 2nd Amended Use
by Special Review Permit#542 for a Mineral Resource Development Facility including an Oil and
Gas support and Service Facility (Oil and Gas Processing Facility) in the A (Agricultural) Zone
District, based on the recommendations of the Planning staff and the Planning Commission,with
the Conditions of Approval and Development Standards as entered into the record. His motion also
included deleting the word"Light"from Development Standard#8. The motion was seconded by
Commissioner Long, and it carried unanimously. There being no further discussion, the hearing
was completed at 2:45 p.m.
