Dear Wendi & Monica:
I would again like to thank you both for the courtesies extended to me in
finalizing the application for Use by Special Review (USR) in the above referenced
matter. I spoke with Wendi on Friday, April 16, 2004, to advise her that it was my belief
that we would have the completed application finished today, and that we would be
forwarding it to Todd Hodges for delivery to your offices. I further wished to confirm
that Monica had indicated that we would not have to provide a copy of an affidavit of a
certified list of the names and addresses of all of mineral owners and lessees with this
application. I did check with two local "land men" and neither one of them could even
begin to commence the task in the time period provided. Wendi indicated that since I had
been dealing with the mineral lessees, and had a business relationship with most of the
companies leasing on the Rothrock properties, I could research my personal files to
determine which mineral leases were in force as pertains to the referenced property.
After a review of my files, I have determined that the only applicable lease appears to be
as follows:
One Active lease between Encana Energy Resources as lessee
and Gittlein (Frank and Katherine by assignment) as lessor
I have prepared an affidavit that to the best of my knowledge and belief, as
counsel for the surface owners, David and Darleen Rothrock, that this is the only mineral
lease in effect at this time on this property.
