HomeMy WebLinkAbout20040839.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING PETITION FOR ANNEXATION TO THE CITY COUNCIL, CITY OF EVANS, COLORADO, FOR PORTION OF WELD COUNTY ROAD 394 AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Petition for Annexation of certain portions of Weld County Road 394, being more particularly described in said petition,to the City Council of the City of Evans, Colorado, and WHEREAS,after review, the Board deems it advisable to approve said petition, a copy of which is attached hereto and incorporated herein by reference, conditional upon the following: 1. An agreement between the City of Evans and County of Weld shall be executed prior to the date of the final hearing on the annexation to address the designation of a haul route for any gravel mining operations which will be operating on properties annexed to the City of Evans, road maintenance for those roadways which are part of the haul route,mitigation of impacts to said roadways,and safety of persons traveling on said haul route. 2. Failure to reach an agreement prior to the date of the final hearing on the annexation shall result in the County of Weld withdrawing said petition. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Petition for Annexation of certain portions of Weld County Road 394, being more particularly described in said petition,to the City Council of the City of Evans, Colorado, be, and hereby is, approved, conditional upon the above.
