HomeMy WebLinkAbout20042561 791 RESOLUTION RE: REVOCATION OF CHANGE OF ZONE #437 - LIFEBRIDGE CHRISTIAN CHURCH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated September 23, 1987, the Board did approve Change of Zone #437 from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for R-1 (Low Density Residential) Uses, R-2 (Duplex Residential) Uses, and Oil and Gas Production Facilities for CRS Investments, Inc., on the following described real estate, to-wit: N 1/2 of Section 5,Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS,the Board has received a request from LifeBridge Christian Church, c/o Tetra Tech, RMC, 1900 South Sunset Street, Suite I-F, Longmont, Colorado, 80501, to revoke Change of Zone#430,said revocation being Condition of Approval#1.D of Change of Zone,PZ#1004,which was approved by the Board of County Commissioners on July 9, 2003, and stated the following: "The applicant shall submit a written request for the vacation of Change of Zone #430 for the Bayshore Planned Unit Development, on the grounds that the application was abandoned. The Change of Zone was not completed and there is no evidence of the Planned Unit Development in the title work." WHEREAS,said Condition of approval#1.D incorrectly identified the Change of Zone to be vacated as COZ#430,which had previously been denied by the Board of County Commissioners; however, it was the clearly the intention of the Board to vacate approved COZ#437, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said revocation. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that portion of Change of Zone#437 now owned by LifeBridge Christian Church be, and hereby is, revoked. BE IT FURTHER RESOLVED that pursuant to Section 27-8-50 of the Weld County Code, the Board of County Commissioners hereby orders the recorded PUD(Planned Unit Development) Zone District for R-1 (Low Density Residential) Uses, R-2(Duplex Residential) Uses,and Oil and Gas Production Facilities, be and hereby is, reverted to the original zone district, A (Agricultural). TO: Board of County Commissioners COLORADO DATE: August 17, 2004 RE FROM: Kim Ogle, Planning Manager `'- - SUBJECT: Conditions of Approval, PZ-1004 Request to vacate a portion of Change of Zone 430 for the Bay Shore PUD The applicant, Life Bridge Christian Church, has requested in a letter dated July 29, 2004, that Weld County Government vacate a portion of Change of Zone 430 for the Bay Shore PUD which is sited within the property boundary of lands owned by the Church and under review for the current Change of Zone application (PZ-1004) which was approved by this Board on July 9, 2003. Condition of Approval number 1.V, under the heading "Prior to Recording the Plat" states: "LifeBridge Christian Church shall submit in writing a request for the vacation of the Change of Zone case number COZ-430 for the Bayshore PUD, on the grounds that the application was abandoned. The change of zone was not completed and there was no evidence of the PUD in the title work."
