RE: APPROVE COMMITMENT OF WATER SUPPLY FOR BEARSON SAND AND
GRAVEL MINING OPERATION AND AUTHORIZE CHAIR TO SIGN - LUPTON
MEADOWS DITCH COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Commitment of Water Supply for the
Bearson Sand and Gravel Mining Operation, located in the NW1/4 of Section 19, Township 2
North, Range 66 West of the 6th P.M., Weld County, Colorado, for 50 shares of capital stock in
the Lupton Meadows Ditch Company, with terms and conditions being as stated in said
commitment, and
WHEREAS, after review, the Board deems it advisable to approve said commitment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Commitment of Water Supply for the Bearson Sand and Gravel
Mining Operation be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said commitment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 23rd day of June, A.D., 2004.

COMMITMENT OF WATER SUPPLY
WELD COUNTY COLORADO hereby commits 50 shares of capital stock of the Lupton
Meadows Ditch Company pursuant to the request of the State Engineer's Office for the sand
and gravel mining operation, known as the Bearson Pit, located in Section 19, Township 2
North, Range 66 West of the 6th P.M., Weld County, Colorado.
This commitment evidences the dedication of a renewable water supply pursuant to the
terms of the said Substitute Water Supply Plan dated March 13, 2003 with follow-up submittals
dated September 16, 2003, March 23, 2004, and June 8, 2004. This commitment shall remain
in full force and effect and so long thereafter as required by the Colorado State Engineer.
The Commitment of Water Supply for the Bearson Pit dated June 18, 2001 is hereby
cancelled and terminated.

RE: Commitment of Water Supply for the Substitute Supply Plan for the Bearson Pit, M-99-001
Dear Joanna:
Please find enclosed Weld County's updated commitment of water supply for the Bearson Pit
substitute supply plan. The commitment of water supply includes 50 shares of Lupton Meadows
Ditch Company owned by Weld County. These shares provide sufficient consumptive use credit to
offset the annual evaporative depletions in the unlikely event Weld County stops operating and
leaves the site. This new commitment of water supply replaces the former commitment of 24 shares
of Lupton Meadows Ditch Company for this site.
