The Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
WCR 90 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code
Ordinance, Section 20-1-30, as a local gravel road, which requires a 60-foot right-of-way at full build out.
There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of
SETBACK in the Weld County Code, Chapter 23, Article Ill, Section 23-3-50, the required setback measured
from the future right-of-way line.
--QEQUIREMENTS:
Access: The applicant identified the existing access point to WCR 90 as per Recording No. 02060487,
recording date was April 1, 1975, Book 119. A copy of this recorded document should be provided in the
packet.
Off-Street Parking: The off-street parking including the access shall be surfaced with gravel or the equivalent
and shall be graded to prevent drainage problems. The applicant indicated that the site will be fenced with
chain-linked fencing.
Storm Water Drainage: The applicant indicated that the historical drainage pattern will not be altered by the
proposed expansion and use. The Weld County Public Works Department will waive the storm water
requirement as the site has a proposed expansion of an additional 15 feet to the south for a total of 30' x 30'
building.

Environmental Health Services has reviewed this proposal for one (1) radio communication
transmission tower with beacon and a 30ft x 30ft transmitter building. We have no objections to
the proposal, however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
---- a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. Bottled water shall be utilized for drinking and hand washing during construction of the
transmission tower.
7. Adequate toilet facilities (port-a-potty) shall be provided during the construction of the
transmission tower.

The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Site Specific Development Plan and a Special Review Permit for one (1) radio communications
transmission tower over seventy feet in height (755 feet) in the A (Agricultural) Zone District
2n° AmUSR-1047
There are two building permits on record for this parcel. One permit was issued to add a 735
foot high tower to an existing tower. This permit was inspected but final approval was pending
receipt of an engineer letter for the foundation. This permit was expired per BOCC resolution.
A new permit was issued to remove the two existing towers and replace them with a 753 foot
high telecommunications tower.
1. Building permit BCN-030382, which was issued to remove the two existing towers and
replace them with a new tower, shall have all required inspections scheduled and approved.
2. The new tower shall conform to the requirements of the 1997 Uniform Building Code, 2002
National Electrical Code and Chapter 29 of the Weld County Code.
3. Setback and offset distances shall be determined by Chapter 23 of the Weld County Code.
Offset and setback distances are measured from the farthest projection from the structure.
4. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.
