HomeMy WebLinkAbout20043420.tiff RESOLUTION RE: APPROVE VARIOUS DOCUMENTS FOR EXCHANGE OF REAL ESTATE AND AUTHORIZE CHAIR TO SIGN -TOWN OF NEW RAYMER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Exchange of Real Estate Including Land and Any and All Improvements and a Quit Claim Deed between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and the Town of New Raymer, with further terms and conditions being as stated in said agreement and deed; said property being described in Exhibit A, attached hereto, and WHEREAS, a hearing before the Board was held on the 24th day of November, 2004, at which time the Board deemed it advisable to continue said matter to December 6, 2004 at 9:00 a.m., and WHEREAS, at said hearing on the 6th of December, 2004 after review, the Board deemed it advisable to approve said agreement and deed, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for Exchange of Real Estate Including Land and Any and All Improvements and the Quit Claim Deed between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Town of New Raymer be, and hereby is, approved. BE IT FURTHER RESOLVED that the effective date of said exchange of real estate be at such time as Weld County has completed construction of its new grader shed. Box 758, 915 10th Street, Greeley, Colorado 80632, hereinafter referred to as "Weld County;" the TOWN OF NEW RAYMER, a municipal corporation of the State of Colorado, whose address is P.O. Box 146, 226 Baird,New Raymer, Colorado 80742, hereinafter referred to as "New Raymer;" and Stuart A. Corbett and Sally Rae Corbett, whose address is P.O. Box 14, New Raymer, Colorado 80742, hereinafter referred to collectively as "the Corbetts." WITNESSETH: In consideration of the mutual promises and covenants contained herein, the payment of the sum of$2,100 from New Raymer to the Corbetts, and the respective values of the real properties which are the subject of this Agreement, Weld County, New Raymer, and the Corbetts agree to exchange properties located within the boundaries of the Town of New Raymer, Colorado, as follows: Weld County shall receive title to the property which is described in the attached Exhibit "A,"being currently owned by the Corbetts (Lots 2 and 3, Block 1, Centennial Subdivision) and New Raymer(Lots 4 and 5, Block 1, Centennial Subdivision). The Corbetts plan to convey all right, title, and interest in Lots 2 and 3, Block 1, Centennial Subdivision to New Raymer, in exchange for the payment of the sum of$2,100 from New Raymer. New Raymer shall then convey to Weld County Lots 2, 3, 4, and 5, Block 1, Centennial Subdivision. In exchange for said property, New Raymer shall receive from Weld County the property described in the attached Exhibit "B." Said property is currently owned by Weld County, Colorado, and is used for the housing of a motor grader at New Raymer, Colorado. The properties as exchanged shall include any and all improvements currently located thereon. The agreement for the exchange of said properties is subject to the following conditions: 1. The exchange of the properties between New Raymer and Weld County shall be on an even basis and shall not require the exchange of further consideration. 2. The Corbetts shall furnish to New Raymer a Quit Claim Deed for Lots 2 and 3, Block 1, Centennial Subdivision, in consideration of payment of$2,100 to the Corbetts by New Raymer. 3. New Raymer shall furnish to Weld County a Quit Claim Deed for the property described in Exhibit "A." Either Weld County or New Raymer may, at its sole cost, purchase title insurance for the property to conveyed to it. 4. General taxes on Lots 2 and 3, Block 1, Centennial Subdivision shall be apportioned to the date of delivery of the Quit Claim Deed from the Corbetts to New Raymer, based upon the most recent levy and the most recent assessment. 5. All of the properties to be conveyed pursuant to the terms of this Agreement shall be free and clear of all liens for special improvements installed as of the date of the parties' signatures hereon, whether assessed or not; free and clear of all liens and encumbrances, and except the recorded and/or apparent easements; subject to all applicable building and zoning regulations. Title for each property shall be merchantable in the respective owners prior to the date of the exchange. 6. The date of exchange of the properties to be conveyed pursuant to the terms of this Agreement shall be the date of delivery of the Quit Claim Deeds. The hour and place of closing shall be agreed to by each party. 7. Possession of the properties to be conveyed pursuant to the terms of this Agreement shall be delivered to the respective new owners upon closing and shall not be subject to any leases or tenancies. 8. The parties hereto represent and warrant as of the date hereof and as of the date of the closing that neither the execution of this Agreement nor the consummation of the transaction provided for herein constitutes, or will result in, any breach of any of the terms, conditions, or provisions, or constitute a default under any indenture, charter, by- law, mortgage, loan agreement, lien, lease, license,judgment, decree, order, instrument, or other verbal or written agreement to which the seller is a party of or is subject to, or to which the property is subject to, except as provided herein. 9. All of the conditions stated herein shall be in full force and effect, notwithstanding the conveyance of the said parcels by Quit Claim Deeds, and shall not merge with said Quit Claim Deeds. 10. Weld County and New Raymer agree to pay for, solely at each entity's own expense, any costs made necessary for the use it intends for the property being conveyed to it pursuant to the terms of this Agreement. 11. The parties agree that all of the improvements which are currently located on the properties to be conveyed pursuant to the terms of this Agreement shall remain. The properties are located on the southeastern portion of New Raymer, Colorado. The scope of the assessment included Lot 2 owned by Stuart and Sally Corbet, and Lot 3, 4, and 5 owned by Town of New Raymer, of the Centennial Subdivision. The ESA was based on a site visit to the property on October 26, 2004, an off-site reconnaissance of adjoining properties, interviews, a regulatory records review and a review of site history. Environmental Health concludes that an environmental condition has not been identified for the subject property and that additional environmental studies should not be required to assess environmental liabilities associated with the subject property. The properties ownership on record is Stuart and Sally Corbet and Town of New Raymer. However, the properties have recently been obtained by Weld County. The said properties will be referred to hereafter as the subject properties or subject site. The subject site is located on the south side of State Highway 14 and east of County Road 129, in New Raymer, in Weld County, Colorado. This work was performed in general accordance with ASTM Standard Practice E 1527 — 00 protocols for conducting environmental site assessments. The Phase I ESA included the following tasks: • Visual survey of the subject property, and cursory review of adjoining properties, to observe for recognized environmental conditions; • Review of various records to help identify recognized environmental conditions associated with the property; • Interviews with owners/occupants to obtain information indicating recognized environmental conditions associated with the property; • Preparation of this final report which details the assessment findings and includes supporting documentation. The purpose of this Phase I ESA was to accumulate data on present conditions and historical uses of the subject and nearby property and assess the potential environmental impact that these conditions and uses may have had on the site. This report discusses the presence e of materials or substances that could contribute to a potential recognized environmental condition on the subject property. 1.1 Exceptions to ASTM Standard Practice E 1527-00 • Credentials of the environmental assessor have not been included with the report but are available upon request. 1 • Local agency files were reviewed in lieu of an interview with a local official. 2.0 SITE DESCRIPTION A summary of the site location and environmental setting is provided in the following sections 2.1 Location The subject property consists of four lots, lot 2 consisting of 0.232 acres having a parcel number 072302001002, in the Centennial Subdivision of part of Antelope Addition and a Part of Pawnee Addition, lot 3 consisting of 0.328 acres, lot 4 consisting of 0.419 acres, lot 5 consisting of 0.442 acres having a parcel number 072302004000, in the Centennial Subdivision of part of Antelope Addition and a part of Pawnee Addition. Although the City of New Raymer lots show to be separate lots having different lot numbers the parcel number includes these lots when observing the properties in the Weld County Arcview Geographic Information System (GIS) data base. The subject properties are located toward the southeastern portion of the Town of New Raymer, Colorado and appear to be vacant land. The subject properties are located within the northeast quarter of the northeast quarter of Section 3, Township 7 North, Range 58 West. The properties location is depicted on Figure 1, which was modified from a portion of the U.S. Geological Survey (USGS), Raymer quadrangle, Topozone topographic map. The property is bounded by Colorado Highway 14, on the north, by Weld County Road 129 on the west, by Diversified Operating Corporation on the south, and vacant land owned by Town of New Raymer on the east. 2.2 Site Topography/Drainage A review of the current USGS topographic map for the Raymer Quadrangle was conducted. Based on the topographic maps, the elevation of the subject properties is approximately 4779 feet above mean sea level. Topographically, the site is gently sloping with a drop in elevation from the northwest to southeast. Natural surface drainage of the site area flows towards the southeast. According to the Federal Emergency Management Agency (FEMA) maps, the property is not within a 100 year floodplain boundary. 2.3 Regional Geology The subject property is located in the White River formation or Group. The soils are well drained, slowly permeable soils on smooth plains. These soils are formed in calcarious, loamy eolean material. Slope is 0 to 6 percent. 2.4 Regional Hydrogeology and Groundwater Based on topographic observations and local drainage patterns; surface water drains to the southeast. The overall regional groundwater flow direction beneath the subject property is anticipated to be to towards southeast. There are no surface water features on the subject property. Based on information from the Colorado Department of Labor and Employment, Oil Inspection Section (OIS) the most shallow groundwater depth is 2 estimated to be approximately 15 to 20 feet deep. However, according to the Colorado Division of Water Resources, the regional water wells range from 125 to 160 feet in depth having a static level ranging from 60 to 80 feet. The New Raymer municipal water supply well located approximately one-half mile northwest of the subject properties is 1042 feet deep having a static level of 510 feet. 3.0 SITE RECONNIASSANCE/INTERVIEWS Information contained in this section is based solely on site visits performed by Weld County personnel and any specific references included in the following subsections. Photographs of the site at the time of the site visit are provided in Appendix A. 3.1 Interviews Terry Cammon of Diversified Operating Corporation was interviewed. Diversified Operating Corporation is located adjoining on the southern boundary of subject properties. Because of concerns of an illegal waste oil pit that had occurred years prior, Mr. Cammon was interviewed. Mr. Cammon spoke of an incident that had occurred on this property approximately ten years prior. He described the incident as a heater treater unit had been washed out on site and a pit had been dug to collect the wash water. He said the pit was not lined, and there was a clean-up which consisted of removal of the contaminated soil. He said the soil was contaminated with iron sulfide and sediment from a treater unit. He also said Weld County was involved with the clean-up and gave him a closure letter. However, no records of this incident at Weld County or Colorado Departments of Public Health and Environment were found. Jeff Detherage of the Colorado Division of Water Resources was interviewed. Mr. Detherage confirmed the locations of the drinking water wells and permits in the area. Discussions with Mr. Detherage showed the most likely direction of groundwater to be towards the southeast. This direction was obtained by using the Colorado Department of Transportation monitoring wells that had been installed during a remediation project located approximately one-quarter of a mile,just west of the subject properties. Laura Lee of the Colorado Department of Public Health and Environment was interviewed. Ms. Lee conducted a records review and concluded no hazardous waste incidents have occurred on the subject properties. She also concluded no hazardous waste incidents were reported to have occurred on the adjoining Diversified Operating Corporation property. 3.2 Current Land Use The subject properties consist primarily of undeveloped land that is not in use. A survey post was observed on the western portion of Lot 2. A possible water tap was observed to be located on the western portion of Lot 2. A fence was observed on the southern portion of the lots. Colorado Highway 14 is observed on the northern portion of the lots. 3.3 Buildings and/or Structures There are no structures on the subject properties. 3 3.4 Utilities Visible signs of on-site utilities were not observed on the property. However, as seen in Appendix A, utilities border the subject site. 3.5 Electrical Transformers and Other Potential PCB Sources Some older electrical transformers, capacitors, generators, and fluorescent light ballast may contain polychlorinated biphenyl (PCB) dielectric fluid. PCB is recognized as a toxic substance by the Federal Government under the Toxic Substance Control Act (TSCA). Any transformers containing PCB's at a concentration of 500 parts per million (ppm) or greater are subject to violations. Leakage from transformers containing PCB's onto soil or other permeable surfaces would present an area of environmental concern. The property was surveyed for the presence of transformers, capacitors, generators, and other potential PCB sources. No transformers or stained soils were observed. 3.6 Aboveground Storage Tanks No surface evidence of existing or former aboveground storage tanks (AST's) were noted on the subject property during the site visit, and according to the OIS of the Department of Labor and Employment, no AST's are registered at the property. However, several AST's exist along the northern portion of the adjoining property, named Diversifies Operating Corporation. 3.7 Underground Storage Tanks No surface evidence of existing or former underground storage tanks (UST's) was noted on the subject property during the site visit, and according to the OIS, no UST's are registered at the subject properties. 3.8 Hazardous Waste A hazardous material is any manufactured material that could have an adverse effect on human health or the environment. Hazardous materials would include but are not limited to: hazardous substances as defined by the Comprehensive Environmental Response Compensation and Liability Act (CERLCA); hazardous wastes as defined by the Resource Conservation and Recovery Act (RCRA); and petroleum products. Hazardous materials were not identified within the subject properties. 3.9 Contamination Indicators Contamination indicators would include: stressed vegetation; staining of soil or other permeable surfaces; leachate or waste seeps; waste materials; disposal areas; construction/demolition debris; drums, barrels or containers which presently or could have formerly contained hazardous substances; unusual odors; and surface water discoloration, odor sheen or free floating product. Five bore holes were drilled by the Weld County Department of Public Works. No environmental conditions were observed at or in the holes. Contamination indicators were not identified within subject properties. 4 3.10 Air Emissions Air emissions from a given facility may be indicated by noticeable odors or dust, laboratory hoods, exterior vents and incinerators. No noticeable air emissions were observed emanating from the subject property during the site visit. 3.11 Wastewater/Effluent Discharges Wastewater/effluent discharge would include; existing or former oil/water separators, sumps, dry wells, catch basins, injection wells, groundwater/wastewater treatment systems, septic tanks, leach fields, floor drains, compressor blow down and exterior pipe discharges. No surface evidence of the wastewater/effluent discharges listed above was noted on the subject property during the site visit. 3.12 Off-Site Reconnaissance The off-site reconnaissance was completed at the same time as the site visit. The reconnaissance consisted of a survey of adjoining properties and land uses which could have an adverse environmental impact on the subject property. The following streets, properties or land uses, bordering the subject properties: • Colorado State Highway 14 on the north; • • Weld County Road 129 on the west; • • Diversified Operating Corporation on the south; • • Undeveloped land on the east. The Diversified Operating Corporation has several (AST's) along the northern portion of the property. Oil field operations and maintenance are conducted on the property. 4.0 RECORDS REVIEW Information in this section is based solely on the specific references contained within each subsection. Sources of information may include commercially available proprietary regulatory databases, regulatory agency files, directories, and aerial photographs. Appendix B contains a copy of reporting agencies environmental information, which contains the majority of information collected during the records review for this Phase I ESA. 4.1 Federal The following subsection detail Environmental Health's findings based on a review of various federal databases. 5 4.1.1 CERCLIS Database The federal Superfund was authorized to finance the cleanup of abandoned disposal sites throughout the Untied States. A computer database of abandoned or inactive facilities, the Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS), has been developed to support the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). After the EPA discovers a potential site, it is entered into the database and a preliminary site assessment is conducted. If warranted, a site investigation is conducted after which a site can be proposed for remediation and placed on the National Priorities List. The CERCLIS database did not list the subject property nor identify and CERCLA sites within a distance of one mile from the subject properties. 4.1.2 NPL Database The National Priorities List (NPL) is the Environmental Protection Agency's (EPA) database of uncontrolled or abandoned hazardous waste site that have been identified for priority remedial action s under the Superfund Program. In order for a site to be included on the NPL, it must either meet or surpass a pre-determined hazard ranking system score, be chosen as a State's top-priority site, or meet all three of the following criteria: 1) the U.S. Department of Health and Human Services issues a health advisory recommending that people be removed from the site to avoid exposure; 2) the EPA determines that the site eprese4nts a significant threat; and 3) the EPA determines that the remedial action is more cost-effective than removal action. The NPL database did not list the subject property nor identify any NPL sites within a distance of 1.5 miles from the subject properties. 4.1.3 RCRA Database The Resource Conservation and Recovery Act(RCRA) database, maintained by the EPA, lists facilities in Colorado that have notified the EPA of hazardous waste activity. Hazardous waste activities include the generation, transportation, treatment, storage, and/or disposal of hazardous wastes. The RCRA database did not list the subject properties nor identify and RCRA regulated facilities on adjoining properties. The RCRA database did not identify and RCRA regulated treatment, storage or disposal (TSD) facilities within one mile of the subject sites. Additionally, no hazardous waste generators were identified within 5/8 mile of the subject properties. 4.1.4 ERNS Database The Emergency Response Notification System (ERNS) is a listing compiled by the EPA of reported releases to the air, soil and/or water of hazardous and/or unidentified substances. This listing provides a limited amount of information on the type of material involved, the cause of the release, and damages or injuries associated with the release. 6 The ERNS database also lists the agencies notified, the responsible party, and the reporter of the release. The ERNS database did not list the subject property nor identify and release incidents on properties adjoining the subject property or within 5/8 miles of the subject properties. 4.2 State of Colorado The following subsections detail findings based on a review of various State of Colorado agency databases and files. 4.2.1 LUST Database State agencies maintain an inventory of leaking underground storage tanks consisting of reported release locations. Those locations include closures where contamination was discovered or where releases from spill, overfill and/or tank leaks were suspected or observed. This inventory did not list the subject property. However, it did identify a LUST site within approximately one-quarter of a mile from the subject properties. The LUST is located at 335 Thomas Street, in New Raymer. The site is owned by Colorado Department of Transportation (CDOT). The confirmed release was reported September 27, 1989. Oil and Public Safety, Oil Inspection Section has overseen the clean-up work at the site. 4.2.2 SPL Database The State of Colorado maintains a State Priorities List database regarding uncontrolled or abandoned hazardous waste site identified for priority remedial actions under the Superfund program. The SPL database was provided by the Colorado Department of Public Health and Environment Hazardous Material and Waste Management Division and contains similar information as the federal NPL database except at the state level only. This database did not list the subject property or identify any SPL sites within a distance of 1.5 miles from the subject properties. 4.2.3 Solid Waste Landfills Database The Colorado Department of Public Health and Environment and Weld County Environmental Health maintain databases of solid waste facilities located within the state. The database information can include the site name, class, operation type, area, estimated site life, and owner. These databases did not list the subject properties nor identify any solid wastes facilities within a distance of one mile from the subject property. 7 4.2.4 UST Database The Colorado Department of Labor and Employment, Oil Inspection Section, compiles an inventory of facilities with registered UST's and AST's located in the state of Colorado. A review of this database did not list the subject properties. The review did identify the CDOT facility LUST within an approximate distance of ''A mile from the subject property. 4.2.5 Colorado Spills Database State Spills (Spill) is a database of hazardous material spill and is provided by the CDPHE. Spill sites were not identified as being located within the search radius of the subject site. 4.2.6 Colorado Wells Appendix B contains a list of wells in Section 2, Township 7 North, Range 58 West that were registered with the Colorado Division of Water Resources. No wells were identified on the subject property. 4.3 Weld County Health Department Information from Environmental health was included in the research. However, no additional listings were indicated beyond those above. 4.4 Topographic Maps The following historic topographic maps were examined: • United State Department of Agriculture, Soil Conservation Service, soil survey map of New Raymer, Colorado, 2NE Quadrangle, from 1978 aerial photography: • USGS, Topozone, Raymer quadrangle, Zone 13 map, shown as Figure 1. The topographic maps provided a limited amount of site-specific information for the subject properties. 4.5 Historical Fire Insurance Maps Historical fire insurance maps were not available for the area of the subject properties. 4.6 Weld County Maps Weld County maps for the area covering the subject property were retrieved as part of this work. Maps from the Arcview GIS database were reviewed. These maps showed the subject property as vacant land. 8 5.0 SUMMARY OF FINDINGS Based on the site visit, the off-site reconnaissance, interviews, and the records review Environmental Health reiterates the following: • The subject properties and adjoining properties were not identified as a CERCLA, NPL, RCRA, ERNS, LUST, SPL, UST, spills or solid waste landfill facilities. • Five bore holes were drilled at a depth of approximately six feet, by the Weld County Department of Public Works. No environmental conditions were observed at or in the holes. • A survey monument exists at the western portion of the property. • A water pump or tap is located at the south western portion of the property. • Based upon information from the Colorado Division of Water Resources and regional topography, it is likely that groundwater flow is toward the southeast. 6.0 CONCLUSIONS AND RECOMMENDATIONS This assessment has not revealed evidence of recognized environmental conditions in connection with the property. Additionally, it has revealed that is unlikely that any potential groundwater contamination originating from Diversified Operating Corporation could cause the subject properties to become contaminated. No additional investigative work should be completed to further define the environmental liabilities associated with environmental conditions identified during the Phase I ESA. 7.0 GENERAL COMMENTS Environmental Health has performed a Phase I ESA in substantial compliance with the scope and limitations of ASTM Standard Practice E 1527-00. This assessment relied primarily upon readily available information and visual observations. It was not designed to provide chemical or radiological analyses, or data regarding the condition of soil and/or groundwater within the area of study.
