RE: ENDORSING HR5185, DESIGNATING PORTIONS OF THE CACHE LA
POUDRE RIVER AS WILD, SCENIC OR RECREATIONAL, INTRODUCED
TO CONGRESS BY REPRESENTATIVE HANK BROWN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Congressman Brown appointed a broad-based blue
ribbon committee of environmentalists, water developers and
users, and leading area citizens of the 4th Congressional Dis-
trict to study the matter of Designating portions of the Cache
La Poudre River as wild, scenic or recreational, and
WHEREAS, after careful study and deliberation the committee
reached unanimous agreement on designating large sections of the
river as wild, scenic or recreational, and
WHEREAS , Congressman Brown has introduced HR5185 for passage
by the Congress and the President of the United States of America,
and
WHEREAS, after review, the Board wishes to endorse House
Bill 5185 designating portions of the Cache La Poudre River as
wild, scenic or recreational.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that House Bill 5185 desig-
nating portions of the Cache La Poudre River as wild, scenic or
recreational be, and hereby is, endorsed.
BE IT FURTHER RESOLVED that the Board urges passage of
House Bill 5185 in its current form.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 4th day of
April, A.D. , 1984 .

Dear Chairman Carlson:
Thank you for your letter about designating portions of the Cache la Poudre River as
wild and scenic.
As you know, Representative Hank Brown introduced H.R. 5185 a bill which would
designate portions of the Cache La Poudre as the states's first wild and scenic
river.
Because this measure protects water rights on the river, the possible development of
water storage projects , and maintains the river's beauty, I decided to cosponsor this
measure.

Dear Property Owner:
As you may be aware, the City Council has formally adopted the "Master Floodway
Plan" and the "Master Floodway Implementation Flan" for the Greeley reach
of the Cache la Poudre River. These plans outline a series of improvements to
be made to the river channel to reduce the impacts of flooding along the river.
In addition, the Implementation Plan proposes that the City become reinstated in
the Federal Emergency Management (FEMA) Flood Insurance Program.
Through the adoption of the Implementation Plan, the Council directed the staff
to initiate the rezoning of the properties within the floodway of the Cache la
Poudre River to C. D. (Conservation District) zoning as required by FEMA. A
public hearing to consider the rezoning has been scheduled before the Planning
Commission on May 22 at 1:30 p.m, in the City Council Chambers, 919 7th Street,
Greeley. The purpose of this hearing is to receive input from property owners
and concerned individuals with regard to the rezoning. Your attendance at the
hearing is encouraged.

Thank you for getting in touch about legislation to
designate the Cache la Poudre River as a federally protected
wild and scenic river .
As you may know , I recently introduced a bill in the
Senate that is identical to legislation introduced in the
House by Rep. Hank Brown . I agree with you that this
legislation is vital to the preservation of the river and
its associated fish , wildlife and recreational
opportunities .
I am pleased to learn that we agree on this issue.
With your strong grass roots support for the bill , I am
optimistic about getting it passed in both Houses of
Congress.

NOTICE OF PERMIT PENDING
The application of the Eastman Kodak Company, Windsor, Colorado 80551 for approval
of plans and issuance of a permit under authority of the Secretary of the Army
is being considered by the District Engineer, U.S. Army Engineer District, Omaha,
Nebraska.
The applicant requests permission to place fill material in the Cache La Poudre
River from mile 22.80 to mile 25.80 in conjunction with the construction of a
bank protection project located in Sections 28, 29, and 34, Township 6 North,
Range 67 West, Weld County, Colorado.
The proposed project will consist of bank reconstruction and the placement of
riprap and fill along five areas of eroded bankline.
Area 1 will involve placing an estimated 400 cubic yards of riverbed material
and riprap along 300 feet of bankline. Area 2 will consist of placing approximate-
ly 670 cubic yards of riverbed material and riprap along 500 feet of bankline.
At Areas 3 and 4 there will be an estimated 270 cubic yards of fill material
and riprap placed along 200 feet of bankline. Area 5 will involve placing approxi-
mately 890 cubic yards of fill material and riprap along 500 feet of bankline
(see attached drawing) .
The bankline will be reconstructed utilizing a dragline to acquire material from
the riverbed and upland sites. The fill material will be placed on the bank
4 feet thick to provide a base for the riprap, except at Area 5 where it will
be placed approximately 6 feet thick. The riprap will be placed 2 feet thick
on top of the fill material and sloped at a natural angle of repose (see attached
drawing) .
The purpose of the project is to restore the bank to its original condition.
Certification that the proposed activity will not violate applicable water quality
standards has been requested from the Colorado Department of Health, Water Pollu-
tion Control Division, 4210 East 11th Avenue, Denver, Colorado 80220.
In compliance with the National Environmental Policy Act of 1969 and Section
106 of the National Preservation Act of 1966, as amended, the National Register
of Historic Places and current supplements have been consulted. There are no
sites included or which have been determined eligible for inclusion therein which
will be affected by the proposed project .

In compliance with the Endangered Species Act, our review indicates that the
activity will not affect species designated as threatened or endangered pursuant
to the Endangered Species Act or their critical habitat.
The decision whether to issue a permit will be based on an evaluation of the
probable impact including cumulative impacts of the proposed activity on the
public interest. That decision will reflect the national concern for both protec-
tion and utilization of important resources. The benefit which reasonably may
be expected to accrue from the proposals must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will
be considered including the cumulative effects thereof; among those are conserva-
tion, economics, aesthetics, general environmental concerns, wetlands, cultural
values, fish and wildlife values, flood hazards, flood plain values, land use,
navigation, shoreline erosion and accretion, recreation, water supply and conserva-
tion, water quality, energy needs, safety, food protection, and, in general,
the needs and welfare of the people. In addition, the evaluation of the impact
of the activity on the public interest will include application of the guidelines
promulgated by the Administrator, Environmental Protection Agency, under authority
of Section 404(b) of the Clean Water Act (40 C.F.R. , Part 230) .
Any person may request, in writing, within the comment period specified in this
notice, that a public hearing be held to consider this application. Requests
for public hearings shall state, with particularity, the reason for holding a
public hearing. The request must be submitted to the District Engineer, Omaha
District, Corps of Engineers, P.O. Box 5, Omaha, NE 68101.
Any interested party (particularly officials of any town, city, county, state,
federal agency, or local association whose interests may be affected by the pro-
posed work) is invited to submit to this office written acts, arguments, or objec-
tions on or before, March 15, 1984. Any agency or individual having an objection
to the work should specifically identify it as an objection with clear and specific
reasons. Comments, both favorable and unfavorable, will be accepted, made a
part of the record and will receive full consideration in subsequent actions
on this permit application.
Comments received after the close of business on expiration date of public notice
will not be considered.
A permit, if granted, will be under the provisions of Section 404 of the Clean
Water Act.
A drawing showing the location and extent of the work is attached to this notice.
