RESOLUTION
RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT #204 - J. MOODY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated June 6, 1973,the Board did approve Special Review Permit
#204 for a cattle feedlot operation for J. Moody on the following described real estate, to-wit:
Part of East 1/2 of Section 29, Township 7 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the property owner, J. Moody, P.O.
Box 210, Eaton, CO 80615, to vacate said Special Review Permit#204, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Special Review Permit#204 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded,adopted by
the following vote on the 14th day of June, A.D., 2004.

SUBJECT: Vacation of SUP-204
The Department of Planning Services has received the attached letter dated June 7, 2004 from
J. Moody. Mr. Moody is requesting that SUP-204 for a feedlot be vacated as a requirement of
Recorded Exemptions RE-3775. The feedlot is currently not in operation.
Background information:
Legal Description: Part of E2 of Section 29, T7N, R66W of the 6th P.M., Weld County, CO.
Location: North of and adjacent to County Road 76 and approximately '% mile west
of County Road 29.
SUP-204: SUP-204 was approved by the BOCC on June 6, 1973, for the expansion
and relocation of an existing feedlot operation in the A (Agricultural) Zone
District.

RESOLUTION
WHEREAS, a public hearing was held on May 29, 1973, in
the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing the petition of Martin Allard,
Route 1, Box 78, Kersey, Colorado 80644, requesting permission for
expansion and relocation of an existing cattle feedlot operation on the
following described property, to-wit:
The East Half (E}) of Section Twenty-nine (29),
Township Seven (7) North, Range Sixty-six (66)
West of the Sixth P.M. , Weld County, Colorado,
and,
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of petitioner
for the expansion and relocation of said cattle feedlot operation, and
WHEREAS, the said requested cattle feedlot operation is
located in an agricultural zone as set forth by the Weld County Zoning
Resolution, and
WHEREAS, according to Section 3. 3(3)1c) of the Zoning
Resolution of Weld County, said cattle feedlot operation or any expansion
thereof may be authorized upon the approval of the Board of County
Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all
the testimony and statements of those present; has studied the request
of the petitioner, and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners, that the application of Martin Allard, Route 1,
Box 78, Kersey, Colorado 80644, for expansion and relocation of an
existing cattle feedlot operation on the premises indicated above be,
and it hereby is granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. That petitioner shall proceed with due diligence to expand
said cattle feedlot operation and shall have up to one year from date
hereof to begin construction for the expansion thereof.
3. That when expansion and relocation of said cattle feedlot
operation is completed, same shall contain, in addition to the facilities
present at the time of hearing, those additional cattle pens, all as shown
on plat as submitted and made a part hereof by reference.
4. That all applicable subdivision regulations and zoning
regulations shall be followed and complied with in accordance with the
zoning resolutions of Weld County, Colorado.

Be it Resolved by the Weld County Planning Commission that the
application for site approval of Relocation & expansion of feedlot
covering the following described property in Weld County, Colo-
rado , to-wit: East half (E;) of Section 29, T7N, R66W of the
6th P. M. , Weld County, Colorado
be recoended (favorably) (iP ,>temeif@kci*d to the Board of County
Commissioners for the following reasons : Agrees with the land-use
policy, compatible with' surrounding land use and zoning, water is
available from North Weld Water District, design judged adequate by the
Extension office , approved by the Health Dept. Subject to construc-
tion limited to pen area shown on the submitted plan and to begin
within 1 yr. of approval by the Board of County Commissioners
