Department of Pub cf COLORADO Health and Environment CASE NO.: MZ-547 NAME: Olando Ltd. Liability Co. //. The Weld County Health Department has reviewed this proposal. The applicant proposes a 9 lot minor subdivision on 73.26 acres. The minimum lot size is 5.14 acres with an overall density of one septic system per 8.14 acres. There are two water wells located on the property in the vicinity of Lots 1 and 5 (well permits 228114 and 228115 obtained in 2000) that are not identified on any maps or discussed in the application. Additionally, the application refers to 'principal and accessory residential structures' on the lots. The Department requests more information on both of these items. This application was previously reviewed under case numbers Z-547 and SCH- 24. The application has satisfied Chapter 24 of the Weld County Code in regard to water and sewer service. The application states the water will be supplied by North Weld County Water District. A water service agreement between the applicant and North Weld County Water District has been included in the application materials. Sewer will be provided by individual sewage disposal systems. Preliminary information in the geotechnical report conducted by Terracon, dated May 21, 2004, and submitted in the Change of Zone application indicates percolation results are acceptable, and that shallow bedrock was identified on the property. This may require some septic systems tp be mounded. Because of the large lot sizes and probability of conventional septic systems, the Department is not requiring primary and secondary septic envelopes on the lots. However, all septic systems must meet all setbacks, including the 100 foot setback to a well and surface body of water. The Department recommends approval with the following conditions: 1. Water service shall be obtained from the North Weld County Water District. 2. A Weld County septic permit is required for each proposed septic system,which shall be installed in according to the Weld County individual sewage disposal system regulations. Each septic system shall be designed for site-specific conditions, including, but not limited to: maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 4. During development of the site, all land disturbances shall be conducted so that EXHIBIT LJ 2004-2599 nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. Water Division 1,Water District 1 Dear Ms. Lockman: We have reviewed additional information submitted to this office on June 28, 2004 on the above referenced proposal to subdivide a 75.34-acre parcel described as Lot B of the Recorded Exemption RE- 2016, into nine single-family residential lots. As mentioned in our previous letter dated June 18, 2004, the North Weld County Water District (District) was listed as the source of domestic water. Since a concern was raised regarding the District's commitment to the subdivision, a copy of a Water Service Agreement from the District was provided with this additional information, however the District did not sign the Agreement. The Agreement indicates that, the District will provide water to the subdivision per terms and conditions of the District. Based on current records on file in this office, the District currently has an adequate uncommitted water supply to provide the water associated with this project. Furthermore, a 'Water Supply Information Summary' was also provided, however no estimates on the water requirement for the subdivision were indicated. According to the information in the Water Service Agreement the District will furnish 70% of an acre-foot [228,000 gallons (0.69 acre-feet per year per lot)] of water per tap per annual water year if the allotment for the Colorado-Big Thompson (CBT) project water, as determined by the Northern Colorado Water Conservancy District, is 50%or greater. The District will restrict the delivery as necessary when the CBT allotment is less than 50%. Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers the opinion, that contingent upon water service being provided by the District, the proposed water supply will not cause material injury to existing water rights and the supply is expected to be adequate. We recommend that the County obtain a signed copy of the Water Service Agreement from the District prior to the final approval of the subdivision. The State Engineer's Office previously commented on this subdivision when the referral was submitted as Owl Creek Acres and the proposal was to subdivide the 75.34-acre parcel into seven single-family residential lots, by our letters dated August 3, 2000, September 8, 2000 and January 11, 2001. r The North Weld County Water District (District) is still listed as the source of domestic water. It is indicated that a Water Service Agreement from the District was included in the referral material, however no such agreement was included. The District previously agreed to supply water to a total of seven lots in the Owl Creek Acres. A Water Service Agreement was provided to this office on August 16, 2000. Based on current records on file in this office, the District currently has an adequate uncommitted water supply to provide the water associated with this project, however, now that the 75.34-acre parcel is to be subdivided into nine lots this agency cannot render an opinion until either a letter of commitment or a copy of a new Water Service Agreement is received from the District. Furthermore, a "Water Supply Information Summary' form (copy enclosed), which, was provided to the county along with the State Engineer's August 7, 1995 letter, was not included in the referral material. As stated in the State Engineer's letter, this form is required to be submitted along with each subdivision in order for this office to respond to the county. Pursuant to Section 30-28-136(1)(h)(II), C.R.S., it is the State Engineer's opinion that sufficient evidence was not submitted documenting that the proposed water supply can be provided without causing injury to the existing water rights. The Public Works Department cannot require paving of this minor subdivision through strict interpretation of the code. It oes not appear to be urban in scale and does not appear to directly abut, or be located near, other urban developments. Having nine residential lots the development will produce, on average, 86 vehicles per day. Considering this,the subdivision development can be served sufficiently by a gravel roadway as outlined in Peter Schei's June 8, 2004 memorandum. However,the Public Works Department will not refuse the applicant's proposal to pave the internal roadway(s). This proposal makes sense as the internal road(s)will directly enter onto SH 392. As previously mentioned, we will accept maintenance for the internal paved roadways after the appropriate warranty period has expired. Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments External Roadways: ❑ Access to State Highway 392 will require compliance with the existing permit from the Colorado Department of Transportation (CDOT), including: rights-of-way, reservations, improvements, and future expansion. The State Highway right-of-way is not clearly identified or labeled on the change of zone plat. An amended change of zone plat shall be resubmitted. ❑ SH 392 serving this development is paved. This development will introduce approximately 86 additional vehicle trips per day to the roadway system. The residential traffic added to the roadway system will not have enough impact to require off-site roadway improvements. A traffic study is not required,based on the proposal of limited development and anticipated low traffic impact on surrounding roads. Internal Roadways: ❑ This development has direct access to SH 392. ❑ The internal roadway right-of-way shall be 60-feet in width including cul-de-sacs with a 65-foot radius, and dedicated to the public. The typical roadway section of interior roadway should be shown as two 12-foot gravel lanes with 4-foot gravel shoulders on the change of zone plat. The cul-de-sac edge of pavement radius shall be 50-feet. Stop signs and street name signs will be required at all intersections. ❑ Intersection sight-distance-triangles at the development entrance will be required. All landscaping within the triangles must be less than 3'h feet in height at maturity,and noted on the final roadway plan. ❑ The applicant shall submit to Public Works stamped,signed and dated final plat drawings and roadway/construction&grading plan drawings for review(with the final application)and approval. Construction details must be included. This is consistent with County Code: Sec. 24-3-50, "The minor subdivision final plat submitted shall contain the original signatures and seals of all parties required." ❑ Easements shall be shown in accordance with County standards and/or Utility Board recommendations, also dimensioned on the final plat. Stop signs and street name signs will be required at SH 392. ❑ The applicant shall submit an Improvements Agreement According to Policy Regarding Collateral For Improvements (Private Road Maintenance) with the final plan application. Page 1 of 2 • Orainaae• ❑ The Final Drainage And Erosion Control Report for Owl Creek Estates dated May 21, 2004, by North Star Design must be revised and resubmitted to Public Works. o The engineer must address a larger off-site tributary water shed area showing the 'big picture' drainage surrounding the proposed development. o The engineer shall discuss a possible flood hazard of Owl Creek, especially the inundation area along the creek caused by a 100-year storm, since the creek crosses SH 392. The State Highway may restrict the flows of Owl Creek during a major storm event. (There may be areas of lots that adjoin Owl Creek, which are not suitable for building.) o The engineer shall specifically research and document the 100-year storm, and the over-topping event of Howards Lake. There does not appear to be any consideration for an over-topping event of the lake and the potential damaging effect on residential homes downstream. U A final drainage report stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted with the final plan application. The 5-year storm and 100-year storm drainage studies shall take into consideration off-site flows both entering and leaving the development. Increased runoff due to development will require detention of the 100-year storm developed condition while releasing the 5-year storm existing condition. ❑ The final drainage report shall include a flood hazard review documenting any FEMA defined floodways. The engineer shall reference the specific map panel number,including date. The development site shall be located on the copy of the FEMA map. ❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage at final plan. Front, rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line swales shall be considered. Building envelopes must be planned to avoid storm water flows,while taking into account adjacent drainage mitigation. ❑ Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted with the final plan application. Recommendation ❑ The Public Works Department recommends approval of this change of zone. The applicant shall address the comments listed above at the specific step of the review process stated. The review process will continue only when all appropriate elements have been submitted. Issues of concern must be resolved with the Public Works Department prior to recording the change of zone and final plats. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3-20 B.13 do not need building permits, however a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 2. MEMORANDUM To: Sheri Lockman From: David Tuttle 4�J Date: June 15, 2004 Subject: Mz-547 The Sheriffs office has no problem with the rezoning of this land for the stated purpose, however upon development; the Sheriff's Office recommends the following improvements for this housing sub-division: 1. The sheriffs office requests that builders and developers designate an area by the entrance of the sub-division in which to place a shelter for school children awaiting the school bus. This area should also include a pull off for the school bus which enables it to safely load and unload children out of the roadway in the event the bus is unable to drive down the street due to road conditions. 2. Either a mail distribution within the sub-division or a central drop off location within the sub-division should be developed so that residents do not have to cross a county roadway to obtain their mail. 3. The name of the street within the sub-division and street addresses should be presented to the sheriffs office for approval. This will eliminate duplication of street names within the county. . 4. A permanent sign should be placed at the entrances to the sub-division detailing the name of the sub-division, and address. There should be a plan developed to maintain this sign. 5. If the roadways within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the sheriffs office will have limited traffic enforcement powers. 6. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 7. The sheriffs office is very supportive of homeowner funded homeowners associations. These associations provide a contact for the sheriff's office and a means for maintaining common areas. 8. If there is an oil or gas well within this sub-division. This needs to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. What I should have put in the permit was that the oil/gas well access can remain, provided the existing use continues. At such time as the well is abandoned, the access serving it must be removed. Ed Or 826 9th Street Greeley, Co 80631 RE: Owl Creek Estates Platte Valley Schools would like for you to review the following information that the district sent in letters dated June 2, 2003 and September 9, 2003. In both letters we are asking for the following: Request the development have a minimum of a 100-footturn around point where the driveway to the subdivision connects to Hwy 392. This is necessary to safely pickup and drop off passengers in this area without backing up or stopping the bus on the Highway during inclement weather conditions. There is no door-to-door service for subdivisions and this area is to be maintained by the subdivision property owners in all weather conditions. We would ask that you provide a safe place off of Highway 392 that would be safe for all students while waiting for the bus. The bus will approach the stop from either th.e east or west depending on AM or PM routes. • • The district does not see any of the safety issues stated above on the plan that was submitted and received on June 4, 2004. We would be glad to extend a positive recommendation once these issues have been addressed. Also the cash-in-lieu for each lot/building site still remains in effect as stated on the original plans.
