HomeMy WebLinkAbout20040037.tiff HEARING CERTIFICATION DOCKET NO. 2004-10 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT#1216 FOR MINERAL RESOURCE DEVELOPMENT FACILITIES, INCLUDING OIL AND GAS SUPPORT AND SERVICE(STORAGE AND REPAIR OF DOWNHOLE OIL FIELD TOOLS) IN THE A(AGRICULTURAL) ZONE DISTRICT - LANCE MESSINGER A public hearing was conducted on January 28, 2004, at 10:00 a.m., with the following present: Commissioner Robert D. Masden, Chair Commissioner William H. Jerke, Pro-Tern Commissioner M. J. Geile Commissioner David E. Long Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated January 9, 2004, and duly published January 15, 2004, in the South Weld Sun, a public hearing was conducted to consider the request of Lance Messinger fora Site Specific Development Plan and Amended Use by Special Review Permit#1216 for Mineral Resource Development Facilities,including Oil and Gas Support and Service(storage and repair of downhole oil field tools)in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney,made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He gave a brief description of the location of the site and surrounding uses, and stated nine referral agencies reviewed this proposal and all responded with comments that have been addressed through the Conditions of Approval and Development Standards. Mr.Gathman stated there is an existing oil and gas support operation on the site permitted under Use by Special Review Permit#1216, and this amendment is proposing an additional 9,000 square-foot warehouse,as well as a possible office and warehouse at the north end of the site, which would be reviewed through the Site Plan Review process. He stated one water well permit has expired and the remaining well permit is for indoor use only, therefore, the applicant will use watering services provided by A and W Water Services for landscaping. Mr. Gathman reviewed photographs of the area and the site, and proposed the Board insert a new Development Standard #15 to state, "Water for outdoor irrigation shall be provided by A and W Water Services or other off-site water provider until either a well is provided for outdoor irrigation from the Colorado Division of Water Resources or public water is provided to the site." Responding to Commissioner Jerke, Mr. Gathman stated the applicant has ceased using the existing well for landscaping irrigation because it is designated for indoor use only. 2004-0037 PL1308 c'* , PL, f&L HEARING CERTIFICATION - LANCE MESSINGER (AmUSR#1216) PAGE 2 Char Davis, Department of Public Health and Environment, stated she has no comments at this time. Donald Carroll, Department of Public Works,stated there is an existing structure on the site and the applicant is proposing future warehouses north of the current facility. He stated this amendment will reduce the number of accesses to a total of four. Responding to Commissioner Masden, Mr. Carroll stated all four accesses are from Weld County Road 25.5;there is no direct access to U.S. Highway 85. Tiffane Moore,Landmark Planners and Engineers,represented the applicant and stated the existing facility is located on 2.5 acres, and the overall site is nine (9) acres. She stated there are two existing accesses,the applicant has eliminated some of the proposed accesses,the new building is 9,000 square feet,the proposed landscaping is consistent with the existing features,and they will construct concrete and asphalt pads for loading. Ms. Moore stated the existing well does serve the facility; however, it will be disconnected from the irrigation system and the applicant will use A and W Water Services for irrigation purposes. She stated there will be an irrigation pond north of the proposed warehouse to allow for drainage,fencing and screening will be consistent with the current design,the yard will be surfaced with road base,and the plans included a specific pallet of plants to choose from for landscaping. No public testimonywas offered concerning this matter. In response to Commissioner Masden,Ms. Moore stated she and the applicant have reviewed and concur with the Conditions of Approval and Development Standards as proposed and modified. Commissioner Geile commended the applicant on a well-designed and maintained facility and he moved to approve the request of Lance Messinger for a Site Specific Development Plan and Amended Use by Special Review Permit #1216 for Mineral Resource Development Facilities, including Oil and Gas Support and Service (storage and repair of downhole oil field tools) in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included adding a new Development Standard #15 to state, "Water for outdoor irrigation shall be provided byAand W Water Services or other off-site water provider until either a well is provided for outdoor irrigation from the Colorado Division of Water Resources or public water is provided to the site", and renumbering as appropriate. The motion was seconded by Commissioner Jerke,and he commented the well-maintained site makes it more agreeable to allow an expansion.
