RE: APPROVAL OF RECORDED EXEMPTION NO. 650 - BUD AND JOYCE
HUNZIKER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 650 , having been requested by
Bud and Joyce Hunziker, described as the Southeast 4, Section 27 ,
Township 2 North, Range 67 West of the 6th P .M. , Weld County,
Colorado, being more particularly described in the plat which
shall be provided by the applicants and known as Exhibit "A" ,
said plat to be recorded, does not come within the purview of
the definition of the terms, "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973 , as amended, and
WHEREAS, this request is to divide the property into par-
cels of 3 acres and 157 acres, more or less, to allow the Hunzikers
to provide a home site for their daughter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove de-
scribed parcel of land be, and hereby is, exempt from the de-
finition of the terms "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval
is conditional upon the applicants submitting a mylar plat to
the Department of Planning Services to be recorded in the office
of the Weld County Clerk and Recorder. The plat shall be drawn
in accordance with the requirements of Section 9-2C. (4)''' of the
Weld County Subdivision Regulations . The plat shall be sub-
mitted within ninety (90) days from the date of approval by the
Board of County Commissioners .

Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Bud & Joyce Hunziker for a recorded exemption. The parcel of land on
which this request is being made is described as SEA Section 27, T2N, R67W of
the 6th P.M. , Weld County, Colorado.
The property is located approximately 2.5 miles northeast of Frederick on Weld
County Road 16. The property contains approximately 160 acres of Class Ile,
IIe(prime) , IIIe, IIIe(prime) & VIe irrigated and IVe, VIe & VIIs nonirrigated
soils.
The request is to divide the property into parcels of 3 acres and 157 acres,
more or less. The Hunzikers would like to provide a 3 acre home site for
their daughter and son-in-law.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
- The 160 acres, more or less, under consideration will
allow uses which are consistent with the intent clause of
the Agricultural Zone District. The uses will be
compatible with existing surrounding uses.
- The proposal was reviewed by the city of Frederick and was
found to comply with their long-range Comprehensive Plan.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The Central Weld County Water District has indicated
adequate water service is available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from Weld
County Road 16 and Weld County Road 21.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.

TAP FEE AGREEMENT
THIS AGREEMENT, made and entered into this` 4,-,1 day of r/2./ , 19
by and between the CENTRAL WELD COUNTY WATER DISTRICT, hereinafter caYled the
District, and Bud Hunyiker and Joyce M. Hunziker
hereinafter called Customer, WITNESSETH:
WHEREAS, District has been organized as a legal body and is.known as,the
Central Weld County Water District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring
to join said District, or —_ — and,
WHEREAS, Customers are desirous of acquiring nn water tap of _5/8
inches in diameter from the said District,
NOW, THEREFORE, in consideration of the premises and the terms of this agreement.,
it is mutually agreed as follows:
1 . Customer agrees to pay the tap fee of $ 2900.00 •
Dollars.

2. In the event it is not economically feasible to extend the water to the
property line of Customer, which matter is in the entire discretion of District,
then all sums paid hereunder shall be returned to Customer and the agreement shall
be null and void.
3. The description of the premises for which these taps are beirq purchased

4. This agreement, when approved by the Board of Directors, shall become a
legal and binding contract upon all parties hereto.
5. Customer further agrees to execute any and all easements needed by District
at no expense to District, across Customer' s property for the purpose of installing
any pipelines constructed by District. District shall be responsible for restoring
surface area back to reasonable condition at District cost.
6. It is further mutually agreed that this agreement shall extend to and be
binding upon the heirs, executors, administrators and assigns of the parties hereto.
7. Customer further agrees to the following special provisions:

It is understood that these taps were purchased for the above• described lands
and may not be transferred to other lands, without express, written consent,
in addition to the below consent, of the CENTRAL WELD COUNTY WATER DISTRICT.
I/we further authorize the Secretary of said District to do any and all things
necessary to effectuate this transfer on the books and records of said District.
I/we hereby state that all water rates and charies and other monies owed to
the District have been paid and if not, shall be held out at the closing of
the sale of my premises.
