HomeMy WebLinkAbout820083.tiff RESOLUTION RE: GRANT REQUEST TO VACATE LESLIE STREET BETWEEN 4TH AND 5TH STREETS IN BRIGGSDALE, COLORADO WHEREAS, thee:-Board of County Commissioners of Weld County, Colorado, pursuant to Colorado. statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado has received a request from Evert Bissell, Superintendent of School,-District No. RE-10J in Briggsdale, Colorado, concern- ing the vacation of Leslie Street between 4th and 5th Streets, and WHEREAS, the Department of Engineering Services of Weld County, Colorado has studied said request for vacation and has recommended to the Board that said request be granted. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld. County, Colorado that the request to .vacate Leslie Street between 4th and 5th Streets in Briggsdale, Colo- rado be, and hereby is, granted. The above -and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 13th day of October, A.D. , 1982. Scheltinga, Director of Engineering subject: Vacation of Leslie Street, Briggsdale Attached is a letter from Ebert Bissell, Sverintendent of RE-10J School District is Briggsdale. Mr. Bissell requests vacation of Leslie Street between 4th and 5th Streets in the town of Briggsdale. The School District owns both blocks either side of Leslie Street between 4th and 5th Street, and has school buildings in both blocks. Mr. Bissell e*plai.ned that school children are continually crossing Leslie Street to go firm building to building. It is also the school district's intent to fence the area, making it more secure and safer for the school children. Because there are existing streets aaupletely surrounding both blocks, and because access will not be restricted for any other property owner, I re connend the Board of Weld County Comnissioners approve Mr. Bissell's request and vacate Leslie Street between 4th and 5th Streets in the trim of Briggsdale. Box 758 Greeley, Colo. 80632 Dear Mr. Scheltinga: This is a request to vacate Leslie Street between 4th and 5th Streets in Briggsdale, Colorado. At this time Leslie Street divides Block 12 from Block 13 which are both owned' by the School District. Since there are roads on all sides of Blocks 12 and 13 the_e'losure of Leslie Street would not deny access Co any other location in the village of Briggsdale. The only traffic that should be allowed on this portion of Leslie Street should be emergency vehicles and school buses. We are considering the possibility of fencing in the School grounds (Blocks 12 and 13) but would not want to do this until Leslie Street between 4th and 5th Streets is vacated. Cox PO Box 47 Cheyenne, WY 82001 Dear Mark: Enclosed please find the materials you requested concerning a request to the Board of County Commissioners to vacate county roads. The 1889 resolution sets out the section lines which have been declared public roads in Weld County and I believe your property is included in those areas. I have included a copy of the Colorado Revised Statutes, 43-2-301 through 43-2-303, covering vacation proceedings. The road petitions, I believe, are self explanatory. If you are the only landowner interested in the vacation, then of course, you may be a single petitioner. When the Board receives the completed petition(s) it will advertise and hold a public hearing to determine whether or not the vacation request should be granted.
