HomeMy WebLinkAbout20042915 HEARING CERTIFICATION DOCKET NO. 2004-90 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1464 FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY,AND A SINGLE FAMILY DWELLING UNIT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A OF THE WELD COUNTY CODE (AN APARTMENT) IN THE A (AGRICULTURAL) ZONE DISTRICT -ALFONSO BORREGO A public hearing was conducted on October 20, 2004, at 10:00 a.m., with the following present: Commissioner Robert D. Masden, Chair Commissioner William H. Jerke, Pro-Tern Commissioner M. J. Geile Commissioner David E. Long Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Michelle Martin Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 1,2004,and duly published October6,2004, in the Fort Lupton Press,a public hearing was conducted to consider the request of Alfonso Borrego for a Site Specific Development Plan and Use by Special Review Permit#1464 for an Oil and Gas Support and Service Facility, and a Single Family Dwelling Unit other that those permitted under Section 23-3-20.A of the Weld County Code(an apartment)in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney,made this a matter of record. Michelle Martin, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She gave a brief description of the location of the site and surrounding uses. She stated 14 referral agencies reviewed this proposal, and they all responded favorably or provided comments that have been addressed through the Conditions of Approval and Development Standards. She further stated staff received no correspondence from the surrounding property owners,and she requested the addition of Condition#1.R,to state,"The applicant shall contact the Weld County Sheriffs Office to discuss the Crime Prevention Program, as outlined in their referral, dated May 3, 2004." In response to Commissioner Jerke, Ms. Martin explained the applicant originally applied for an apartment; however, they now intend to convert the existing residence into an office once they are issued a Certificate of Occupancy for the future home. Char Davis, Department of Public Health and Environment, stated the site will be serviced by the Central Weld County Water District and a septic system. Donald Carroll, Department of Public Works, stated the site is accessed from Weld County Road 50,which is a local paved road with an average daily traffic count of 500 to 600 vehicles. He explained the applicant will be required to use the east access for the proposed use and the residence. 2004-2915 PL1745 /40/q «� //dy-6y HEARING CERTIFICATION -ALFONSO BORREGO (USR#1464) PAGE 2 Ken Alles of Alles and Associates, Inc.,represented the applicant and stated the proposed use will be very similar to a nearby, recently approved, oil and gas facility. He stated this is not prime farmground,and it is well suited for the proposed use. In response to Commissioner Geile, Mr.Alles stated there are currently no facilities at the site. Responding to Commissioner Jerke, Mr. Alles stated this site does not produce very good grazing because it is a low area and the water from the site runs to the northeast corner; however, the site is surrounded by prime farmground. No public testimony was offered concerning this matter. In response to Commissioner Masden, Alfonso Borrego, applicant, stated he concurs with the addition of Condition#1.R, as well as the remaining Conditions of Approval and Development Standards. Commissioner Geile moved to approve the request of Alfonso Borrego for a Site Specific Development Plan and Use by Special Review Permit #1464 for an Oil and Gas Support and Service Facility, and a Single Family Dwelling Unit other that those permitted under Section 23-3-20.A of the Weld County Code (an apartment) in the A (Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included the addition of Condition #1.R, to state, "The applicant shall contact the Weld County Sheriffs Office to discuss the Crime Prevention Program,as outlined in their referral,dated May 3, 2004." The motion was seconded by Commissioner Jerke,and it carried unanimously. There being no further discussion, the hearing was completed at 10:20 a.m. This Certification was approved on the 27th day of October, 2004.
