Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments External Roadways: ❑ CR 19 is classified by the County as a collector road and requires a minimum 80-foot right-of-way. The applicant shall verify the existing right-of-way. The documents creating the right-of-way shall be noted on the change of zone plat. A 40-foot right-of-way shall be dedicated on the final plat. The change of zone plat shall label the CR 19 right-of-way as, "40-foot County Road Right- Of-Way,to be dedicated on Final Plat." ❑ CR 19 serving this PUD is paved. A traffic study is not currently required, based on the proposal of limited development and anticipated traffic impact on surrounding roads. This development will add approximately 100 trips per day to CR 19. ❑ Additional right-of-way shall be required adjacent to the bus pullout area equivalent to the width of the pullout lane. Revisions must be made to the change of zone drawings, and this right-of-way shall be dedicated on the final plat. Furthermore, the applicant shall show details of the bus pullout on the Road Plan&Profile drawing to be submitted with the final plat materials. ❑ Appropriate referral agencies shall be contacted regarding the bus pullout, especially the school district of jurisdiction. The applicant shall provide to the Public Works Department written documentation regarding this issue along with the final plat application materials. Internal Roadways: ❑ County Code requires that PUD developments pave internal roadways. This development accesses paved County Road.19. ❑ The internal roadway right-of-way shall be 60-feet in width including cul-de-sacs with a minimum 65- foot radius, and dedicated to the public. The typical roadway cross-section should be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the change of zone plat. The cul-de-sac edge of pavement radius shall be 50-feet minimum. Stop signs and street name signs will be required at all intersections. ❑ The applicant shall correctly mark 20-foot utility and drainage easements for Lot 1 and Lot 9 along CR 19 on Sheet 2 of the Landscape Plan,and Sheet 2 of the Zone Change Plat for Distant Thunder PUD. ❑ The Typical Road Cross Section shown on Sheet 2 of the Zone Change Plat for Distant Thunder PUD shall identify the 12-foot travel lanes as being"Paved". ❑ The applicant shall coordinate the typical road cross-sections shown on Sheet 2 of the Zone Change Plat for Distant Thunder PUD and Sheet 2 of the Plan and Profile Multiple Lot Access Road to be identical. The Typical Cross Section on Sheet 2 of the Plan and Profile Multiple Lot Access Road shall be corrected to include 4-foot gravel shoulders on either side of the 12-foot paved travel lanes. ❑ The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal. ❑ Intersection sight distance triangles at the development entrance will be required. All landscaping within the triangles must be less than 3'h feet in height at maturity,and noted on the final roadway plans. ❑ Easements shall be shown on the final plat in accordance with County standards (Sec.24-7-60) and / or Utility Board recommendations. "Easements shall follow rear and side lot lines whenever practical and shall have a minimum total width of twenty(20) feet apportioned equally on abutting properties. Where front line easements are required, a minimum of fifteen(15) feet shall be allocated as a utility easement." The applicant shall show and dimension 20-foot perimeter easements for the parcel on Sheet 2 of the Zone Change Plat for Distant Thunder PUD. EXHIBIT Page 1 of 2 2004-1345 C Tice applicant shall submit to Public Works stamped,signed and dated final plat drawings and roadway/construction& grading plan drawings for review(with the final application) and approval. Construction details must be included. This is consistent with County Code: Sec. 24-3-50, "The minor subdivision final plat submitted shall contain the original signatures and seals of all parties required." Drainage: ❑ The Drainage Investigation & Erosion Control Report for Distant Thunder - PUD dated April 2002, by Messner Engineering, Inc. is acceptable. ❑ The Grading Plan sheet shall verify and match the length of 18-inch CMP culvert shown in the plan and profile views. The plan view depicts approximately 200-feet of culvert, whereas the profile view shows 40-feet. This correction shall be made with the change of zone submittal materials. ❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage for the final application. Front, rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line swales shall be considered. Building envelopes must be planned to avoid storm water flows, while taking into account adjacent drainage mitigation. ❑ Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted with the final plan application. ❑ The Engineering Geology Report for Zadel PUD, dated May 30, 2001,by Church&Associates, Inc. is acceptable and states that groundwater was not encountered in soil test holes. ❑ The applicant has submitted an Improvements Agreement According to Policy Regarding Collateral For Improvements (Private Road Maintenance), which is under review by Pubic Works staff. This agreement must be approved by the BOCC prior to recording the final plat. Recommendation ❑ The Public Works Department recommends approval of this change of zone. The applicant shall address the comments listed above at the specific step of the review process stated. The review process will continue only when all appropriate elements have been submitted. (Private Road Maintenance). In speaking with John Zodel, the applicant, his intent is to have the County accept Distance Thunder for public maintenance as it will be built to County standards. This form should be readjusted or replaced with the Public Road Maintenance form signed and resubmitted. I have reviewed the transportation portion. The site grading, street grading, street base, street paving, street name signs, and road culverts are associated with the transportation portion. I have verified quantities and unit costs. All figures appear to be adequate to complete the project. Department of Public `j • COLORADO Health and Environment CASE NO.: PZ-600 NAME: John Zadel/Distant Thunder The Weld County Health Department has reviewed this proposal. The application has satisfied Chapter 27 of the Weld County Code in regard to water service. Water will be provided by Central Weld County Water District and sewer will be provided by individual sewage disposal systems. The minimum proposed lot size (2.0acres) coupled with the overall density of one septic system per 9 acres does meet current Department policy. A letter of availability from Central Weld County Water District was provided in the application materials. The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service. Sewer is proposed to be provided by individual sewage disposal systems. Preliminary percolation data from Church and Associates, dated May 31, 2001 was included in the application. Percolation rates were poor, with rates ranging from 60 to 240 minutes per inch. Weathered claystone was also found at shallow depths (4 feet). These preliminary findings indicate that most sites will require engineered septic systems. Additionally, because it is anticipated that most of the systems will have to rely on evaporation for disposal of wastewater, the systems will be extremely large. The applicant has designated two septic system envelopes on each lot as the Department requested (the envelopes are labeled at 12,000 square feet, but measure 10,500 square feet). Language preserving the secondary absorption field envelope for its future use has been placed in the draft covenants. The Department has seen the referral from the Town of Dacono stating that this development is in the proposed Dacono Sanitation District Eastern Service Area, and that the eastern trunk line is anticipated to be completed in the same time frame as the development. The Department recommends that sanitary sewer be utilized whenever possible. The Department recommends approval with the following conditions: 1. Water service shall be obtained from the Central Weld County Water District 2. A Weld County septic permit is required for each proposed septic system,which shall be installed in according to the Weld County individual sewage disposal system regulations. Each septic system shall be designed for site-specific conditions, including, but not limited to: maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. Language for the preservation and/or protection of the absorption field 'areas'shall be placed in the development covenants. The covenants shall state that activities such as permanent landscaping, structures,dirt mounds,animal husbandry activities, or other activities that would interfere with the construction, maintenance,or function of the fields should be restricted over the absorption field areas while in use. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 5. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 6. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 7. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months in duration,the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 8. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. PZ-600 1. Building permits shall be obtained prior to the construction of any building or structure including bus shelters, signs and entrance gates, if provided. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3-20 B.13 do not need building permits, however a Certificate of Compliance must be filed with the Planning Department. An electrical permit is required for any electrical service to the building and a plumbing permit is required for any water for washing or watering purposes in the Ag building. 2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt buildings. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 1997 Uniform Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Notary Public My commission expires: Page 2 of 2 MEMORANDUM WineTDO: Chris ATE: August 4,t hman, Planner II 2003 COLORADO FROM: Kim Ogle, Planner III , SUBJECT: Distant Thunder PUD, PZ-600 John Zadel, applicant The Department of Planning Services has reviewed the Landscape Plan and Improvements Agreement for Private Road Maintenance and offers the following comments: On-site landscape treatment consists of six plant material species. In each instance the cultivar is not listed. A cultivar shall be determined prior to acceptance of the Landscape Plan. The staggered placement of the trees and shrubs is acceptable at the entry road focal point. There are plants placed to the north and south of Distant Thunder Road as accents to the entry. The entire site makes use of existing natural grasses and vegetation of undetermined genus and species in all areas identified as open space. The applicant has identified the appropriate seed mix for each area delineated on the Landscape Plan. Additional information is required to address how this material is to be installed, including the rate of installation and the total square footage of the seeded areas. Typically the wildflower mix is burned in the early spring, thereby encouraging new seed development. Future correspondence shall outline the proposed maintenance and propagation measures for this development. The random rubble wall approximately six feet in height and nine feet in length with copper flashing pre-cut letters identifying the development requires additional information. Specifics shall include the depth of the footing, whether the stone is constructed of natural or man-made stone, are wall ties installed, is there a batter to the wall, the construction of the internal core, reinforcement, subsurface drain pipe. Further, are the stainless steel (SS) screws set directly into the stone wall and how are the copper pre-cut letters affixed to the letters. The plan delineates a student bus pullout, however, there is not a shelter or a mailbox kiosk delineated on the Landscape Plan. Future correspondence shall identify these elements The Department of Building Inspection should review the proposed bus stop building for compliance with all applicable codes. A general note regarding the graphic delineation of the of the grass lined swale relative to the residential driveways. The driveways should be delineated to cross the grass lined swale, and a culvert if required shall be delineated on the plans. This graphic shall be labeled accordingly. The applicant shall provide additional information regarding the wetlands located on site. For example, are these jurisdictional or non-jurisdictional wetlands. A note shall be placed and a hachere cross hatch shall be utilized to delineate the area where no disturbance and or structures are permitted associated with Lots 2, 3 and 4 of this proposed development. The applicant shall provide additional information pertaining to the initial irrigation of plant material. Irrigation for the initial two years is extremely important for the plants to become acclimated and established. There is no discussion in the text on the method of irrigation and how this will be accommodated within this PUD. The Improvements Agreement for Private Road Maintenance has estimated the cost for all non- transportation items, including landscape material, entrance sign and the re-seeding disturbed areas to be sixty-six hundred (2500.00) dollars. It is the professional opinion of the Department of Planning Services that this number is extremely low and should be re-evaluated to include the items previously discussed in this memorandum. Please provide an itemized calculation for each individual component as requested with the Change of Zone Review. At a minimum shall be a cost breakdown for the random rubble wall, the entrance area seeding and plant material proposed. The applicant shall submit a revised itemized Exhibit A of the Improvements Agreement for Private Road Maintenance for review and approval prior to providing collateral for acceptance by the Board of County Commissioners. The applicant shall check the spelling associated with the submitted drawings, and revise as required. End Memorandum. The proposed water source is the Central Weld County Water District (District). A letter of commitment for service was submitted. The water supply information summary states that each lot will require 0.5 acre-feet per year (4.5 acre-feet annually for the 9 lots). Information submitted by the District shows that the District has approximately 5,787.3 acre-feet secure water supplies for a dry year. Currently, approximately 5411.6 acre-feet has been committed, which includes this proposal. Pursuant to Section 30-28-136(1)(h)(II), C.R.S. the State Engineer's Office offers the opinion that the proposed water supply will not cause material injury to existing water rights, and with the Central Weld County Water District serving the proposal, the supply is expected to be adequate. This property is in the Dacono Planning Area and designated for Community Buffer land use in the Comprehensive Plan. The Community Buffer land use category permits residential use at a density of 1 unit per 10 acres. The Dacono Transportation Plan classifies Weld County Road 19 as a minor arterial roadway which requires a 90 feet wide right-of-way. This area is anticipated to eventually be a part of the City of Dacono. The subdivisions public improvements should be constructed to be compatible with and, at a minimum, meet the City standards. This property is within the proposed Dacono Sanitation District Eastern Service Area expansion. The planned addition to the District is in its formative stages and seems to be progressing rapidly. The intent of the District is to have the eastern trunk line extension complete by the end of 2004. If the District's plans stay on schedule it is possible that a sanitary sewer main to serve the Distant Thunder Subdivision could be completed in the same time frame. With respect to the environment and long term service, central sanitary sewer service is much preferred over septic systems (ISDS). The City of Dacono will not oppose the change of zone from A (Agriculture) to PUD subject to the following conditions: (1) Eliminate one lot of the proposed PUD subdivision. Eight lots will bring the density to one unit per ten acres and that density corresponds to the Comprehensive Plan land use designation.
