Lupton, CO 80621 RE: StroMo Composting Facility Certificate of Designation Application for Class I Composting Facility Weld County Dear Mr. Smith: The Colorado Department of Public Health and Environment's Hazardous Materials and Waste Management Division (Division) has reviewed the amended Design and Operations Plan (Plan) prepared by AgPro Environmental Services. Our office received the amended Plan on September 29, 2003. The Plan is being reviewed for compliance with the state's solid waste regulations 6 CCR 1007-2 and specifically Section 14 (composting regulations). Below are the Division's comments regarding the amended Plan. 1. Proposed cost estimates for financial assurance appear inadequate for closure and post- closure activities. Currently, this facility has a $15,000 Certificate of Deposit (CD) to cover closure costs for removal/management of 50,000cy of onsite material and post- closure monitoring costs for three ground water wells. Stromo has proposed to increase the CD by an additional $5,000, resulting in total closure/post closure cost sum of $20,000. The financial assurance total does not appear adequate for managing a potential volume increase of 135,000cy (185,000cy total) of material and a minimum of five years of post-closure groundwater monitoring at this site. The estimated removal cost of$13,500 from Bogie Excavating did not provide the quantity of material for this price or the date to reflect applicable market costs. It's not apparent from Bogie Excavating's bid if the $13,500 includes both transportation costs for material going to a landfill or composting site and any associated tipping fees. The Plan states "For bio-security purposes, trucks delivering raw products may be washed before leaving the site." Provide a drawing of the washout structure and site map showing water flow direction toward the retention pond. Please be aware that washout activities may require a groundwater discharge permit from the Department's Water Quality Control Division. Mr. Chris Gates (303-692-3539) can provide additional information regarding mobile truck wash operations. 3. Mortality composting is proposed at this site. Procedures shall be developed that include at a minimum: 1) estimated composting time, 2) appropriate ingredients, 3) equipment, 4) controlling nuisance conditions, 5) construction of compost bins or windrows, 6) filling of bins or windrows, and 7) monitoring the composting process. Adequate information for composting poultry mortalities is provided in the Plan. A similar level of detail shall be provided for cow and hog mortalities utilizing the procedures described above, if these animals will be composted at this facility. 4. Approvals for additional feedstocks, changes to monitoring parameters, operational • amendments and financial assurance adjustments shall be approved by both the es" department and Weld County. Please make changes in the Plan were appropriate. The additional information and/or clarification requested in the aforementioned comments must be provided before the Division can complete its technical review of the Plan. The D&O plan was revised according to your comments dated November 21, 2003 and a summary is outlined below. 1. The previously approved financial assurance CD of$20,000 as well as the additional $5,000 CD included with the last revised submittal is still in place. However, additional estimates and financial assurance have been eliminated from this D&O and will be submitted, reviewed and approved as a separate document and amended to this D&O as the last Appendix. 2. The plans for the truck wash are included in this submittal. A drawing of the was ut and its location on the site plan is included. The truck wash is for disinfection of the tires and the container carrying dead animals. The wash will use a dilute disinfecting solution which should not impact the stormwater containment, compost or land application plans. AGPROfessionals, LLC has contacted Mr. Mike Liuz7i, who has indicated that additional requirements and permits for the truck wash are not likely. Verification of this will follow. 3. Detailed mortality composting information has been added to the appendix and the composting and nuisance portions of the D&O text adjusted accordingly. 4. LLC Composting Facility Revised D&O Truck Disinfection Plans Dear Mr. Liuzzi. As discussed in our Mid-December 2003 telephone conversation. AGPROfessionals. LLC is representing StroMo. LLC and filing a Design and Operations Plan and request for a Class I Composting facility which requires a Certificate of Designation from the Colorado Department of Public Health and Environment. The facility composts animal manures and dead poultry.hogs. and cattle. We are coordinating our efforts at the CDPH&E with Mr. Roger Doak in the Solid Waste Division. Due to biosecurity reasons at confined animal feeding operations where the dead animals will be picked up, it is necessary for StroMo. LLC to disinfect their trucks. Current plans are to have a drive-through basin containing a dilute chlorine solution to disinfect the truck's tires and the truck's trailer box will also be sprayed with a dilute chlorine solution from a garden-type sprayer. Mr. Doak's review of the plans included a comment about checking with your department about any permitting necessary for a truck wash. As discussed,we are not operating a commercial truck wash and are not technically -washing-the trucks. but merely disinfecting them. Per your instructions. I have included information regarding the plans for your review via the attached D&O plan. The plan includes a site map with the location of the truck wash basin and a detail of the construction of the basin. The plan outlines the operational procedures of the composting site but more importantly, the plan includes details of the stormwater containment area.volumes and liner construction. Additionally. the plan delineates the groundwater monitoring program which is in place. the location and construction of the wells and some of the latest groundwater monitoring information. Finally.the plan includes details of the soil types. vicinity maps.and hydrologic information. Box 758 • Greeley CO 80632 RE: Application for Certificate of Designation StroMo Composting Facility Dear Commissioners: The Colorado Department of Public Health and Environment's Hazardous Materials and Waste Management Division (Division)has completed its review of the application for a certificate of designation for the StroMo, LLC composting facility. The application was reviewed for compliance with the solid waste statute, 30-20-100, CRS, et seq. (the "Act") and the corresponding regulations, 6 CCR 1007-2 (the "Regulations"), specifically Section 14 (composting regulations). StroMo has asked the Division to review a design and operations plan that would allow the facility to accept additional feedstocks (e.g. animal material, biosolids, food waste and sludges) for composting. This would change the facility's classification from its current Class III status to a Class I composting facility and would require a certificate of designation. It is the assessment of the Division that the facility can comply with the technical, environmental and public health standards of the Act and the Regulations; if the facility is constructed and operated as detailed in the submitted design and operations plan and the requirements of the Division as stated in this letter. Based on this assessment, the Division recommends that the application for certificate of designation for StroMo may be approved by the County based on these and local criteria. If the certificate of designation is approved by the County, the following conditions shall be incorporated into the resolution granting such approval. 1. The facility shall comply with the health laws, standards, rules and regulations of the Department, the Water Quality Control Commission, the Air Quality Control Division and all applicable local laws and ordinances. I am sorry if Esther gave you a tentative date and did not get it onto our calendar. I apologize and forward her apologies also. Because of the seriousness of this problem, I have directed her and other staff to stop scheduling ANY tentative dates in the future. They will wait until they are ready to schedule the case before giving anyone dates to avoid any misunderstandings in the future. I must point out, however, that the State's letter says, "This would change the facility's classification from its current Class III status to a Class I composting facility and would require a certificate of designation." During our meetings with the planning staff and the Weld County Health Department in December, we were all aware that the State Health Department approval was necessary but forthcoming and that after discussions with Trevor Jiricek, Cindi Etcheverry and Chris Gathman from planning, they were comfortable scheduling the hearing and posting proper notice for the March 3rd hearing assuming 1) state approval would be received prior to the hearing based on letters and phone calls with the state and 2)worse case the hearing would be continued if for some reason the state letter was not received. The state did not change the designation. The project was submitted as a CD and went through P&Z as a CD. Weld County staff has known this project was a CD for over 6 months. We knew in December what the final comments from the state were and that approval was coming. I was under the impression that AGPRO and the planning department were in agreement that scheduling could run concurrent with waiting for receipt of the state approval letter. Planning said they were OK if Trevor was OK. Trevor J. gave his OK at the first of the year. Planning and I called your office and got a tentative date on March 3rd shortly thereafter. March 3rd is the target date we were under the impression we were all working for. The applicant was expecting March 3rd. It was just a shock to not hear anything different until last Friday and furthermore to get our information from the sign posting and not a letter or phone call from any staff person at Weld County. I guess either someone forgot about our agreement in December or just dropped the ball. Either way it is at the applicant's expense. The main reason for the delay is the response received from the Colorado Department of Public Health and Environment changing the classification of the facility and thus, requiring a Certificate of Designation (CD). The letter was received in our office on January 26, 2004, and therefore, the tentative date of March 3 could not be adhered to because of the 30 day posting requirement for the CD, and the staff time required for posting and scheduling the matter. As to why you were not given an opportunity to appear on the 10th with only three Commissioners present--that is not a policy or procedure followed by the Clerk to the Board. Our instructions are NOT to schedule when we know only three Commissioners will be present, although we may schedule with only four present. There are times that a case is scheduled with only four present and something comes up that reduces the number of Commissioners to three. In that instance the applicant IS allowed to have the matter heard that day or continue it at a later date; however, we DO NOT intentionally schedule cases or ask the applicant's preference about scheduling with only three present. I am sorry for the inconvenience to you and your client; however, cases are f^ scheduled as they are received, and we typically schedule six to eight weeks ahead. I also apologize for any oversight that may have occurred in the Clerk's office regarding this case, although discussions with the applicant regarding problems which occur are generally left to the Planner on the case. I received a call from John Moser this morning indicating that he found out the hearing was not on the 3rd but on the 24th, three weeks after expected. John and I also want to know why he found out via the sign posting and not from AGPRO or Weld County CAROL Harding RE: StroMo Schedule Page 3 staff. AGPRO was not made aware of the delay until John called this morning regarding the posted sign. Chris Gathman, the project planner, is out to Mexico for this week so I called the lead planner, Kim Ogle and then called the Clerk-to-the-Board, Esther Gesick. AGPRO had talked with county staff in December and scheduled the hearing tentatively on March 3rd. We understand the date was only tentative but could expect maybe a one-week delay. Not three weeks. Kim Ogle indicated staff found out last week when posting the sign that a solid waste site with a CD requires a 30-day posting per state statue instead of the typical 10-day posting for a regular USR. Evidently, there was some discussion about the 30-day requirement among staff and the county attorney last week. This was somehow an oversight. But, why was AGPRO and John Moser not notified of this issue last week when their discussion took place? I can understand mistakes and oversights. But, I would have appreciated a call from staff letting me know the problems and why, prior to my client finding out via the sign posting and calling me upset. The Clerk-to-the-Board said she received the file from the planning department on January 26 which could have been enough time under most circumstances. She needs a few days to process the paperwork so with the 30-day requirement the hearing could have gone on the 10th of March at the latest. But, she said two commissioner's were out on the 10th and that the commissioner's schedule was full on the 17th which put the hearing to the 24th. John Moser is not very happy about the scheduling and I am not happy about the communication. I was not made aware of the problems with the 30-day posting issue. Nor was my client or I aware of the delay until after he saw the sign posted Friday indicating the March 23rd hearing date and he called me wanting to know what was going on. But, more than that, it should be up to the applicant to determine whether they want to go before only 3 commissioner's on March 10th or wait for another date. First, this could have been avoided if the sign posting dates were handled properly in time for the March 3rd hearing and John Moser and I would like to know who's responsibility it is to allow for proper posting and notification. Second, my client should have been notified of the problem and given the option to go on March 10th. Every delay is a huge financial burden on my client. The applicant should be notified of any potential delays, given their options, and allowed to make their own decision. Not Weld County staff. I would like a written response from Weld County explaining to my client why this happened. HEALTH The Weld County Department of Public Health and Environment has reviewed this application. We recommend for approval of the compost facility with numerous recommended conditions and standards. We have attempted to simplify our referral by separating the proposed conditions into conditions of approval and development standards. The following are recommended to be conditions of approval: Prior to recording the plat: 1) The facility shall provide evidence to the Weld County Department of Public Health and . F Environment and Colorado Department of Public Health and Environment that an # appropriate financial assurance mechanism has been secured in accordance with the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2). Evidence of that appropriate financial assurance mechanism has been obtained shall be submitted the Department of Planning Services. 2) A comprehensive Wastewater Management Plan for the collection and land application of stormwater, leachate, and truck wash wastewater shall be submitted to the Weld # County Department of Public Health and Environment and Colorado Department of Public Health and Environment for review and approval. The following are recommended to be development standards: 1) The facility shall comply with the Regulations Pertaining to Solid Waste Disposal Sites and it r Facilities (6 CCR 1007-2) Regulations promulgated Pursuant to the Solid Waste Act, Section 30, Article 20, Part 1, C.R.S., as amended. 2) No permanent disposal of wastes shall be permitted at this site. Any solid waste as defined *i . in the regulations pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) received or generated at the site must be removed and disposed of at an approved sanitary landfill. - 1 - EXHIBIT K Ahltis? #/27G 3) Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive lk ea dust,blowing debris, and other potential nuisance conditions. 4) The facility shall comply with the health laws, standards, rules and regulations of the *7 Department, the Water Quality Control Commission, the Air Quality Control Division and all applicable local laws and ordinances. 5) The facility shall comply with the Colorado Water Quality Control Commission Biosolids 2s Regulations (5 CCR 1002-64). 6) Any vehicle washing area(s) shall capture all effluent and prevent discharges from tire 4-zy washing and the washing of vehicles in accordance with the Weld County Code, the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 7) The facility shall manage wastewater in accordance with its approved Wastewater Zr Management Plan. 8) Any bulk liquids or semi-solids that are stored on the site shall be stored in containers that *≥q comply with the Underground Storage Tank and Above Ground Storage Tank Regulations (7 WCR 1101-14) or in containers that have received the written approval of the Weld County Department of Public Health and Environment. This is not meant to include those liquids or semi-solids that have been incorporated into the composting process. 9) The facility shall comply with the approved Groundwater Monitoring Plan. i1 ZY 10) The facility shall have adequate equipment to dewater the retention structure. Adequate *e‘ storage capacity shall be maintained within the retention structure to ensure runoff from a twenty-five year, twenty-four hour storm event will be contained. 11) The facility shall maintain a gauge indicating the depth of wastewater and storm runoff 4e> within the retention structure. The gauge shall also indicate the depth at which pumping will be necessary to contain runoff from a twenty-five year, twenty-four our storm event. 12) The mixing pad shall be constructed in accordance with the typical mixing pad design that A3o has been reviewed and approved by the Weld County Department of Public Health and Environment and the Colorado Department of Public Health and Environment. Evidence shall be submitted to the Weld County and Colorado Department of Public Health and Environment prior to the use of each mixing pad that demonstrates the pad was constructed in accordance with the approved mixing pad design. 13) Prior to construction, a truck tire wash pit design shall be submitted to the Weld County #3i Department of Public Health and Environment and Colorado Departments of Public Health and Environment for review and approval. At a minimum, the design will describe, in detail, the construction of the wash pit, storm water control, wash pit maintenance, - 2 - overflow prevention, and conveyance structures to the retention structure. 14) All raw, uncomposted Type I stockpiles shall be placed in windrows within 72 hours upon IkJo receipt at the facility. In the event processing units, other than windrows, are to be incorporated at the site, a detailed description of the unit and processing requirements shall be provided to the Weld County Health Department for review and approval. The description shall include literature and other examples that demonstrate the unit is an effective composting process. 15) All Class II or III feedstock shall be placed in windrows immediately upon receipt at the #0 facility. 16) Prior to the acceptance of Type III feedstock types: a) The facility shall provide evidence to the Weld County Department of Public Health and Environment, and Colorado Departments of Public Health and Environment that the facility is accepting biosolids in compliance with requirements necessary in Colorado State Biosolids Regulation, No. 64 (5 CCR 1002-64). b) A typical mixing pad design shall be submitted to the Weld County Department of Public Health and Environment, and Colorado Department of Public Health and Environment for review and approval. At a minimum, the design will describe, in detail, the construction of the pad, the thickness of liner, method of lining, liner permeability,pad maintenance, storm water control, etc., prior to construction. c) An amended Ground Water Monitoring Plan shall be submitted to the Weld County Department of Public Health and Environment, and Colorado Department of Public Health and Environment for review and approval. The plan shall include adequate background groundwater data, in the uppermost saturated interval; in the event that sampling data indicate that a release or impact may have occurred from operations at the facility. The plan shall include additional monitoring parameters consistent with the materials that are brought onto the site. Evidence of the approved plan shall be submitted to the Department of Planning Services. The plan shall include applicable analytical parameters that will be monitored, and other applicable procedures and methods necessary to detect an impact from the operation of the facility 17) The facility shall be operated in a manner to control fugitive dust in accordance with its #1y approved Design and Operations Plan at all times. Additional dust abatement measures shall be implemented at the request of the Weld County Health Department in the event it is determined that dust is a nuisance condition. 18) The facility shall be operated in a manner to control flies in accordance with its approved '*is Design and Operations Plan. Additional fly control measures shall be implemented at the request of the Weld County Health Department in the event that flies are in such a number to be considered a nuisance condition. The plan shall also be implemented in the event the Weld County Health Department receives a significant number of fly complaints - 3 - (associated with facility) and, in the judgment of the Weld County Health Officer, there exists a fly condition requiring abatement. 19) The facility shall be operated in a manner that controls odor in accordance with its #i(0 approved Design and Operations Plan. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional odor abatement measures shall be implemented at the request of the Weld County Health Department in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold or, in the judgment of the Weld County Health Officer; there exists an odor condition requiring abatement. 20) The facility shall adhere to the maximum permissible noise levels allowed in the Industrial *i 7 Zone as delineated in 25-12-103 Colorado Revised Statutes, as amended. 21) The Special Review Permit site and facility shall be operated in compliance with any #4, required Air Emission Permit approved by the Air Pollution Control Division of the Colorado Department of Public Health and Environment. 22) The facility shall receive and process only those materials that are described in the facilities $t approved Design and Operations Plan prepared by Agpro Environmental Services, LLC, dated December 23, 2003. The Weld County Department of Public Health and Environment, Weld County Department of Planning Services, and the Colorado Department of Public Health and Environment shall be notified in writing of any additional materials proposed for composting. Written approval to proceed with composting shall be obtained from the Weld County Department of Public Health and Environment and Colorado Department of Public Health and Environment prior to receipt of the new material. Submitted information shall include operational procedures and storage procedures. 23) A metal sign shall be posted at the facility entrance. The sign shall be a minimum of three 4 a2 feet in width and four feet in length. The sign shall state the following: a) Name of operation. b) Type of facility. c) Emergency phone numbers of the facility operator. 24) If during the operational activities of this facility, information is revealed that changes the t# g currently held concept of the site, the Hazardous Materials and Waste Management Division of the Colorado Department of Public Health and Environment may request modifications to the Design and Operations Plan. In addition, regulatory changes that the Colorado Department of Public Health and Environment may implement in the future may also become binding and necessitate modifications to the Design and Operations Plan. 25) An individual sewage disposal system is required for any future structure that would -ttC, require a septic system and shall be installed according to the Weld County Individual - 4 - Sewage Disposal Regulations. A vault system shall be acceptable. If a vault is installed, pumping records shall be kept for review.
